WAIVER of the 401 Water Quality Certification and Neuse River Buffer Authorization Certificate
Dear Mr. Ball:
The additional information dated October 29, 2002 requested in association with your application for a 401 Water Quality
Certification and Neuse River Buffer Authorization Certificate dated August 30, 2002 was received in the Wetlands/401 Unit
of the Division of Water Quality (DWQ) on October 29, 2002. According to our rules (15A NCAC 2H .0507(A) and 15A
NCAC 2B.0233(8)), if final action is not taken within sixty (60) days, the 401 Certification and Neuse Buffer Authorization
Certificate is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement
of written authorization for the use of 401 Water Quality Certification Number 3375 (GC3375) and the buffer rules for your
plans to impact 105 feet of stream and 10,630 square feet of buffers to construct a single road crossing (i.e., Street "A') as
described in your application. As such, the wetland and buffer impacts are approved. However, please be aware that you
must follow the plans as described within your application dated August 30, 2002 including any revisions within the
additional information dated October 29, 2002 and all other conditions of GC3375 and the Neuse River Buffer Rules,
including but not limited to diffuse flow per 15A NCAC 2B.0233(5). You must also obtain or otherwise comply with all other
required State, Federal and Local regulations, including but not limited to DWQ Standards (15A NCAC 0213.0100 and
.0200).
Please note that if additional impacts occur within the development beyond those requested within your application, this
waiver is no longer valid and a new 401 Water Quality Certification and Authorization Certificate will be required. Any
additional impacts on retained jurisdictional wetlands, waters and protective buffers will need to comply with all 401 Water
Quality Certifications and DWQ Standards. Also, please note that the DWQ reserves the right to conduct a compliance
review of your protect to ensure compliance with the wetland and buffer rules. If you have any questions, please telephone

Letter states that buffer s on pond will be honored. Actually there are two ponds. One in northwest
corner and the large pond new the road crossing. OK to issue but I would prefer to see the buffers
indicated. Also, there is a Ng pond to the north at Pine Meadows Subdiv and some of this propedy
abuts it. Perhaps just the languaQe indicating the buffer be shown on tax delineations.

Dear Mr. Dorney:
We received your September 9, 2002 letter concerning the proposed
Rowland Pond Residential Subdivision and letter sent to you
previously requesting that the application not be withdrawn.
The attached maps show the locations of the surveyed streams and
their riparian buffers as requested.
As requested the pipe under the only proposed road impact on the
site has been realigned to create less of an angle at the inlet side.
The location of the road was originally placed in such a way as to
reduce the amount of stream impacts by crossing that portion of the
channel at as much of a perpendicular angle as possible. Due to a
narrow access corridor to the property and the requirements to meet
minimum curve radii for secondary roads, the placement of the road
corridor is very limited. As a result of the revised crossing, proposed
impacts will total 6,694 ft2 in Zone 1, 3,936 ft2 in Zone 2 (i.e. less than
113 acre for entire buffer impacts), and 105 linear feet of intermittent
channel.

Areas currently wooded around the ponds within Zone 1 of the
buffers will remain wooded. The 50-foot riparian buffers will be
applied to the ponds.
Sheetflow will be provided into the buffers. The attached plans show
the proposed locations of sediment basins and level spreaders as
requested.

application regarding your plan to fill wetland for the purpose of a road crossing in Wake County.
Approval from DWQ is required to disturb these streams and buffers. Please provide seven copies of
the following information and refer to the DWQ# listed above in your reply. In particular as
described in 15A NCAC 2B .0502, we will require you to locate all streams and ponds on the
property. Please show these on maps of suitable scale (for instance 1" = 100 feet) so we can begin to
determine your projects' compliance with 15A NCAC 2H,.05 00.
1. Please realign the pipe under the road so stream flow is directed up and the down channel
without severe angles.
2. Will wooded buffers be provided on the ponds?
3. Storm water management for this project will be needed. Stormwater shall be directed to
sheetflow at non-erosive velocities through the protected stream buffers. Please provide a
design which shows this design.
Please telephone me at 919-733-1786 if you have any questions or would require copies of
our rules or procedural materials. This project will remain on hold as incomplete in accordance with
15A NCAC 2H .0505(c). The processing time for this application will begin when this information is

Dear Mr. Dorney:
On behalf of Douglas Ball (property owner), we hereby request authorization and written
concurrence from the NC Division of Water Quality (NC-DWQ) that the project
complies with the 401 Water Quality Certification associated with Nationwide Permit 14
and the Neuse River Basin Riparian Buffer Rules (Buffer Rules). A Pre-construction
Notification Application (PCN) is attached, as well as an agent authorization form.
The proposed project consists of a residential housing development and is located
immediately west of Dwight Rowland Road (SR 2753) approximately 1400' west of the
intersection of Dwight Rowland Road and SR 2754 in the community of Willow Springs,
North Carolina. The property is approximately 45 acres in size. Please refer to the
USGS topographic map attached for the location of the project.
In order to access the majority of the property, a road must be constructed and cross an
intermittent stream channel. The channel is depicted on the Wake County Soil Survey
and is therefore buffered. No permits have previously been issued for this site so there
are no Action ID #'s or DWQ Project #'s. The US Army Corps of Engineers does not ?U
require notification for stream channel impacts utilizing Nationwide Permit 14 that
propose impacts less than 150 linear feet to perennial channels or any impact to t?+
intermittent channels. For this reason the USACE is not being copied on this submittal.
The proposed road crossing will impact 91 linear feet of buffered intermittent channel.
Proposed buffer impacts will total 7,011 ft2 (i.e. less than 1/3 acre). To minimize

impacts to the channel, the road has been aligned so as to cross the creek at a
perpendicular angle. Also, to decrease the channel impact resulting from side slopes, a
headwall is being used and the road is being constructed at the lowest possible elevation.
No cumulative impacts to the watershed are expected as a result of this project because
the surrounding properties are forested or are in agriculture and the project site has
riparian buffers on the channels contained on-site.
NC-DWQ's current policy does not require mitigation for cumulative wetland impacts
less than 1 acre or for cumulative stream impacts to perennial streams less than 150 linear
feet per project. Because the cumulative permanent impacts to channels are to an
intermittent channel only and are still less than 150 linear feet, no stream mitigation
should be required by NC-DWQ. The proposed site plan will impact less than 1/3 acre of
buffers (an "allowable" activity) and for this reason no buffer mitigation requirements are
expected.

buffered channel is required in order to install the roadway required to provide access to the
house lots on the property.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The proposed road and its resultine stream channel impact, is needed to access the house lots
on the majority of the property from Dwight Rowland Road. The road has been aligned so as to
cross the creek at a perpendicular angle to minimize the impacts. Also, to decrease the channel
impact resulting from side slopes, a headwall is being used and the road is being constructed at
the lowest possible elevation.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stmigide.html.
