John A. and Rachel Buck Pamlico County Project Setting The applicant owns a 5.5-acre tract of land adjacent to the Bay River in Bayboro, Pamlico County, North Carolina. The property is on the west bank of the Bay River and is the site of Hurricane Boatworks. Hurricane Boatworks is a commercial repair and storage facility for large vessels. Most of the property is covered with gravel, and is used for parking and dry boat storage. A large metal building houses the repair shop. There are approximately 200 feet of coastal wetlands between the high ground and the open water of Bay River. An existing channel and boat basin extends from the river landward into the property. The vegetation bordering the channel and basin is dominated by Spartina cynosuroides and Juncus roemerianus. At the western end of the basin, a travel lift facilitates the launching and retrieval of vessels serviced at the boatworks. The business office is located to the north of the basin, approximately 250 feet landward of the river. The project area is bordered on the north and south by undeveloped tracts of land vegetated with pine trees, wax myrtle, catbriers, and small hardwood trees. The marsh continues along the waterward side of the adjacent properties. The Bay River forms the eastern border of the project property. Water depths in the area of the proposed pier range from -7 feet NWL at the waterward end of the structure to -3 feet at the landward end. The Bay River is approximately 500 feet wide at this location, and a Federally maintained channel runs through the middle of the water body. There is a 46-foot setback requirement from the edge of the federal channel. The Bay River is classified SC SW NSW by the Environmental Management Commission and is not open to shell fishing at this location. The property is located in the Neuse River Basin, and is subject to the Environmental Management Commission's (EMC) Neuse River Basin Nutrient Sensitive Waters Management Strategy. Project Description The applicant proposes to construct a 6-foot by 445-foot elevated walkway over the marsh leading to an 8-foot by 140-foot floating pier and an 8-foot by 174-foot floating T-head. As described in the applicant's narrative, the proposed pier would provide slips for 10 vessels in excess of 50 feet in length. The applicant proposes to provide haul out services for vessels at the facility in the event of a hurricane. A permanent restroom facility will be available to marina customers at the business office. The applicant proposes 8 feet wide accessways to provide stability on the floating structures. Anticipated Impacts The project as proposed would impact 27,170 ftz. Approximately 2,670 R2 of coastal wetland would be shaded by the proposed elevated walkway. The pier and associated slips would usurp 24,500 R2 of public trust area, of which, the platform and pier would shade approximately 2,700 f12 of creek bottom. A(1(, ? ?? 200 AUG:3o; 2 co We currently operate a rather large full servicd boatygA_ the,Ba Ri a utr?- iNr ton capacity marine travelift by means of a Prearrla r'River to a tubasuh, which is bordered on the sides by two very--tightty-constructed-4'-Wide X 3' AGL dock/walkways constructed entirely on land at waters edge. These are simply constructed using 4"0" pressure treated materials installed in the ground with hand held post hole diggers. This work was done in 1992 under Permit 12-92 and a modification to permit 12.92, which allowed us to build the walkways. We also built the travelift well adjacent to the "turn basin" under Permit 12.92. At the time we built these things, all of it worked very well, but since that time, our business has grown. We have a larger "travelift" and the size of the vessels has increased dramatically. We now haul out commercial shrimp boats to 60' in length and 21'6" width, and recreational yachts to 70' in length and these small walkways will not contain the larger vessels. Consequently, we have no place to tie them before and after haul out and repairs, we have a real need for adequate docks for up to 10 vessels this size. We would offer up to eight of these "alongside slips" for rental to the recreational boating public, leaving us two slips for transient and other vessels of this length, size and draft awaiting haul out and for repairs. Neither of the two walkways adjacent to the turn basin has ever been used as a marina, nor were they intended to be. Although, there are tie up cleats attached to them at regular intervals; these are held in place only by very light fasteners so as not to damage the walkway by customer boats temporarily moored to them. We also welded tie up cleats to our safety rails bordering the travelift well for the same purpose. Sometimes Monday morning is a nightmare to our customers and us if too many boats are in the turn basin and travelift well. There are no electrical or water hookups on the walkway docks at the turn basin, again because it is not used as a marina in any way. We propose to construct a timber walkway, 6' wide x 445" long, across the marsh from the "high ground portion of our property to the waters edge, and extend it 30' into the Bay River in order to gain access to water of sufficient depth to attach an 8' wide by 140' long floating platform dock which will be terminated by an 8'X175' offset T in the deeper water. (See attached map) Tile termination point of this system will be located 76' shoreward of the Federally Maintained Channel of the Bay River (minimum set back is 46' by US Army Corps of Engineers) and will actually be 30' shoreward of these guidelines. We will install electrical and water hook-ups for eight large vessels on the offset "T" dock which will allow two 60' vessels to tie up at the very end of the 8'xl40' dock (see map) if necessary to complete the 10 slip capacity in the event larger vessels should completely occupy the "T" (175') dock. (See map) It is not our intent to use this dock system for more than ten boats at any one time. If our needs require a larger marina, we would like to reserve the right to apply for expansion through proper channels in the pennitting process. As a part of their contractual agreement with our marina customers, we will guarantee to remove their vessels from the water and install them in a dry storage area reserved for them in the event of approaching hurricanes. Our yard is capable of storing 50-60 boats on dry land in the 50' length class in an emergency situation provided we have 48 hours lead-time before the hurricane actually arrives. Vessel tie up will be "alongside" only with no finger piers or mooring pilings. We need the 8' width on our docks for stability, so when larger boats are tied up along side as well as convenience and safety to our customers and us. We have more than 1100' of shoreline. The total square footage of the 8'X140' and 8'X175' platform docks is 2520 square foot. Under current guidelines (4 square ft. per linear ft. of shoreline), we would be permitted to construct 4400 square foot of platform. GPS coordinates, water depths around the docks and the pier heads as well as proximity to the Federal Channel are all shown on the attached map. AUG r?o2 There are no parking requirements in Pamlico County or pump-out station requirehze?ts 00-10 marinas of 10 slips or less. However, we hope to install a permanent pump out station as soon as possible after marina is in place. According to the Pamlico County Soil Survey (USDA Soil Conservation Service), there are two soil series napped on the property, i.e. Charleston Loamy fine upland portion and Lafitte Muck in the marshland portion. The waters in this portion of the Bay River are classified SC by NCDENR and are closed to shellfishing by N.C. Division of Marine Fisheries and is not considered a Primary Nursery Area by them. Ref. Phone conversation with Chuck McKenna DEHNR Dept. of Marine Fisheries. There are no historic resources that would be affected by the project reference letter (attached) from N.C. Dept. of Cultural Resources. Attached are pictures of the travelift well, turn basin, and Pre Cama canal which access Bay River through the marsh. There will be no upland development of any kind associated with this project. The walkway across the marsh will be outlined with low level lighting at 10' intervals as will the 6'X30' and 8'X140' dock which extends into the Bay River. There will be 8 lighted power pedestals installed at regular uitervals on the offset "T" dock (which will run parallel to the Bay River Channel) to service the eight slips on the "T" dock as well as the two at the inner section of the access dock 8'X140 and 175'X8' "T" dock. There will be potable water connectors located at each of the power pedestals. All construction will be done within the prescribed 15' set back from our riparian lines. -lie I ??
