Box 1000 Manteo, NC, 27954 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Mann: February 24, 2003 DWQ# 02-1716 Dare County You have our approval, in accordance with the attached conditions, to place fill in 0.07 acre of wetlands and 72 linear feet of perennial streams in order to construct a road crossing at the Dare County Construction/Demolition Landfill site, as described in your application received complete by the Division of Water Quality on October 23, 2002, and in additional correspondence received November 12 and December 30, 2002, as well as January 9, 10 and 27, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3375, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland and/or stream fills for this project (now or in the future) including future phases of this subdivision exceed one acre or 150 linear feet of perennial streams, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification, as well as the additional conditions listed below: 1. The culvert must be designed, constructed and placed to allow aquatic life passage; 2. Stormwater management shall be done in compliance with the Coastal Stormwater Permit issued by DWQ (Permit No. SW 7020516). 3. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, Mail Service Center 6714, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. From this conversation, we understand that the matter has been referred to the DWQ Washington Regional Office (Mr. Tom Steffens). Therefore, we will be contacting Mr. Steffens to discuss the certification request in more detail, and specifically the two questions in your recent letter to AWT. We also understand from our conversation with Mr. St. John that because the site has an active State Stormwater Management Permit (Permit No. SW7020516), which was recently modified on July 1, 2002 to include the driveway connection and other proposed facilities, this may satisfy DWQ with respect to the 401 Certification request for the driveway connection. As mentioned above, and in our December 23, 2002 letter, we would appreciate the opportunity to discuss the project with DWQ and to resolve any issues outstanding so the certification can move forward as soon as possible. Our purpose in meeting is to discuss the project information requested in your November 20th letter, and to advise the review engineer of pending design modifications for the driveway connection that are Currently underway at AWT. A plan view sketch of the proposed modifications is attached for reference when we meet with your section's review engineer. This land has continuously been under cultivation since before 1986, with the exception of the land used for the County's C/D landfill operations In the early 1990's, all cleared land was designated as "prior converted cropland" by the USACE and therefore not "wetlands". The non- cleared areas (approximately 311 acres) is considered "wetlands", and therefore the County has not undertaken land disturbing activities in this area. Based on this determination, the proposed project will only impact wetlands in order to cross the canal from high mound to high ground from t1S264 to the existing Cub Road corridor. V. Page 9 of 13 The proposed driveway connection ("the project") offers the minimum impact alternative other than not constructing the prooect The project wetlands/canal crossing affects approximately 56 feet from the edge of US264 to the high ground of the existing Cub Road corridor west of the IJS264 canal. Location of this driveway entrance connection at any other point along IJS264 would at a minimum impact approximately 400 linear feet of wooded wetlands, and would require significant fill to be placed in that area to establish a roadbed. The proposed canal crossing will connect to an existing roadbed. Unavoidable temporary impacts to the stream will be minimized by the use of silt fencing and sediment curtains upstream and downstream of the site. Culvert sizing and placement will allow the canal flow to be maintained, and will not disrupt the passage of any fish in the canal. Construction plans will require the Contractor to prevent live or fresh concrete and bags of cement from contacting the water until hardened. Filter cloth will be placed under any riprap used for the project by the Contractor. _ Viii. Mitigation DWQ - in accordance with 15A NCAC 211 .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to firesh%kater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACF, - in accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to cnsurc that adverse ellects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will b considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project, establishing and maintaining wetland and/or upland vegetated hufTers to protect open waters such as streams, and replacing losses of' aquatic resource lunctions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. if mitigation is required fir this project, a copy of the mitigation plan must be attached in order lbr USCE or DWQ to consider the application complete for processing.
