APPROVAL of 401 Water Quality Certification with Additional Conditions

You have our approval, in accordance with the attached conditions, to place fill in 0.07 acre of wetlands and 72 linear
feet of perennial streams in order to construct a road crossing at the Dare County Construction/Demolition Landfill site, as
described in your application received complete by the Division of Water Quality on October 23, 2002, and in additional
correspondence received November 12 and December 30, 2002, as well as January 9, 10 and 27, 2003. After reviewing
your application, we have determined that this fill is covered by General Water Quality Certification Number 3375, which can
be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. This Certification allows you to use Nationwide Permit
Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland and/or stream fills for this project (now or in the future) including future phases
of this subdivision exceed one acre or 150 linear feet of perennial streams, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification, as well as the additional conditions listed below:
1. The culvert must be designed, constructed and placed to allow aquatic life passage;
2. Stormwater management shall be done in compliance with the Coastal Stormwater Permit issued by DWQ (Permit No.
SW 7020516).
3. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, Mail Service Center 6714,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

In response to your November 20, 2002 letter to AWT, we spoke with Mr. Todd St. John in the DWQ 401
Certification Unit on January 8, 2003. From this conversation, we understand that the matter has been
referred to the DWQ Washington Regional Office (Mr. Tom Steffens). Therefore, we will be contacting Mr.
Steffens to discuss the certification request in more detail, and specifically the two questions in your recent
letter to AWT.
We also understand from our conversation with Mr. St. John that because the site has an active State
Stormwater Management Permit (Permit No. SW7020516), which was recently modified on July 1, 2002 to
include the driveway connection and other proposed facilities, this may satisfy DWQ with respect to the 401
Certification request for the driveway connection. As mentioned above, and in our December 23, 2002 letter,
we would appreciate the opportunity to discuss the project with DWQ and to resolve any issues outstanding so
the certification can move forward as soon as possible.
We appreciate the courtesy and cooperation of you and the DWQ staff, and look forward to meeting with Mr.
Tom Steffens as soon as practicable. in the meantime, if there are any questions, please feel free to contact

underway at AWT. A plan view sketch of the proposed modifications is attached for reference when we meet
with your section's review engineer. An elevation view of the same modifications is being prepared, and will
be provided when it is available.

Dear Mr. Walker:
We would like to thank 'you for the opportunity to 'meet. with you on December 91 to discuss the permit
application currently under review.by your office for the above project
As discussed in our meeting, modifications' to the entrance design are currently being completed. These
modifications are, intended to provide for a. 60-foot entrance turning radius instead of the 30-foot radius
Initially proposed. Therefore, please hold the current permit application until we can provide information on
the design modifications. We also understand from our meeting that,the'USACE Nationwide No. 14 pen;nit will
er,with the project CAMA permit, and
be issued by the North Carolina Division of Coastal Management togeth
that CAMA staff will be coordinating the permit efforts on this project from 'now.

The entrance design modifications mentioned above are almost complete Enclosed for your information'is a
plan view of the new entrance conflguration,shown,in relation "to the previous,entrance design. Based on 'a
comparison of the entrance modifications, with„ the previous "permit application information submitted on
October 21, 2002, we have concluded the?following. ,
1) There will be no.'addidonal wetland impacts created from fill,material for the modification as compared
to the initial information provided With" the 'original application submittal. (Our calculations for the
initial submittal were conservative and therefore slightly overstated the initial impact. The information
Initially provided is now consistent with the impacts from the proposed modification.)
.2) The culvert length and size reportedt in 'the initial application '.will not change under the design
modifications.
.3) The modified design will add approximately 1,274 square feet of horizontal road entrance `surface,
instead of sloped area as was In the initial design:.Hoiwever,'thls area was included in the Initial area
calculations 'as horizontal area . even though at the, time, ' it was intended to be sloped. This area will
now be maintained by use of soldier piles and a lagging wall system instead of ,sloped roadside fill. As
a result, the impervious area reported in the initial application already accounts for the design
modifications as well.
In summary, the initial design's impacts were overstated in the *' original information provided. The
information initially provided now correctly reflects the impacts expected from the design modifications.

We are writing in response to your October 28, 2002 letter concerning the 401 Water Quality Certification for
the above project. This provides the additional information requested about the project's stormwater
management practices.
As discussed by telephone with you on November 1, 2002, stormwater runoff generated by the proposed
driveway connection will be treated as follows. Because the road will slope to the interior of the property
away from US264, stormwater from the new entrance will be directed along the road edges via': stabilized
swales to a point approximately at Station 4+00 (see the drawings submitted with our October 21t
certification request). At this point, the stormwater will be directed and dispersed into the adjacent wetland
areas for treatment, as indicated on the attached sketch.
It is our understanding that this approach is satisfactory to the 401 Wetland Certification Unit. If additional
information or detail is required, please contact us at 919-466-9246.

On behalf of the County of Dare, enclosed are seven (7) copies of the County's USACE application requesting a
Nationwide Permit No. 14 for a driveway connection to connect Cub Road to US Highway 264. The connection
will go from high ground to high ground, and will cross the canal immediately west of and parallel to US264 in
Dare County. A wetlands boundary line has been delineated for the project and is presented in Attachment 4
of the enclosed permit application. A CAMA Major Development permit application for this same project will be
submitted to the Division of Coastal Management in the very near future. '
By this submission, and on behalf of Dare County, we request a 401 Certification for this project. Check No.
71345 from the County of Dare for $200 is attached to this letter as payment for the 401 Certification
application fee.

Land use at the driveway connection project site includes a transportation corridor (US264)
with adjacent canal wooded high ground and the existing Cub Road Corridor.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
butler impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
All cleared land on the site (approximately 525 acres) is artificially pumped and drained. This
land has continuously been under cultivation since before 1986, with the exception of the land
used for the County's C/D landfill operations In the early 1990's, all cleared land was
designated as "prior converted cropland" by the USACE and therefore not "wetlands". The non-
cleared areas (approximately 311 acres) is considered "wetlands", and therefore the County has
not undertaken land disturbing activities in this area. The specific project area for which an
NWP#14 is being requested was evaluated by the USACE (Action ID #200210865) on 7/18/02
and the wetland line mapped see Attachment 5). Based on this determination, the proposed
project will only impact wetlands in order to cross the canal from high mound to high ground
from t1S264 to the existing Cub Road corridor.
V. Future Project Plans

than not constructing the prooect The project wetlands/canal crossing affects approximately 56
feet from the edge of US264 to the high ground of the existing Cub Road corridor west of the
IJS264 canal. Location of this driveway entrance connection at any other point along IJS264
would at a minimum impact approximately 400 linear feet of wooded wetlands, and would
require significant fill to be placed in that area to establish a roadbed. The proposed canal
crossing will connect to an existing roadbed. Unavoidable temporary impacts to the stream will
be minimized by the use of silt fencing and sediment curtains upstream and downstream of the
site. Culvert sizing and placement will allow the canal flow to be maintained, and will not
disrupt the passage of any fish in the canal. Construction plans will require the Contractor to
prevent live or fresh concrete and bags of cement from contacting the water until hardened.
Filter cloth will be placed under any riprap used for the project by the Contractor. _
Viii. Mitigation
DWQ - in accordance with 15A NCAC 211 .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
firesh%kater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACF, - in accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to cnsurc that adverse ellects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will b considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project, establishing and maintaining wetland
and/or upland vegetated hufTers to protect open waters such as streams, and replacing losses of'
aquatic resource lunctions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
if mitigation is required fir this project, a copy of the mitigation plan must be attached in order
lbr USCE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall he placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

Indicate Which of the Following Apply:
There are waters of the U.S. and/or wetlands, on the above described property which we strongly
suggest should be delineated and surveyed. The surveyed wetland lines must be verified by our staff
before the Corps will make a final jurisdictional determination on your property.
Because of the size of your property and our present workload, our identification and delineation of
your wetlands cannot be accomplished in a timely manner. You may wish to obtain a consultant to
obtain a more timely delineation of the wetlands. Once the consultant has flagged a wetland line on
the property, Corps staff will review it, and, if it is accurate, we strongly recommend that you have the
line surveyed for final approval by the Corps. The Corps will not make a final jurisdictional
determination on your property without an approved survey.
Y The waters of the U.S. and/or wetlands, on your project area, have been delineated and surveyed, and
the limits of the Corps jurisdiction have been explained to you. Unless there is a change in the law or
our published regulations, this determination may be relied upon for a period not to exceed five years
from the date of this notification.
There are no waters of the U.S., to include wetlands. present on the above described property which
are subject to the permit requirements of Section 404 of the Clean Water Act (33 USC 1344). Unless
there is a change in the law or our published regulations, this determination may be relied upon for a
period not to exceed five years from the date of this notification.
j( The property is located in one of the 20 Coastal Counties subject to regulation under the Coastal Area
Management Act (LAMA). You should contact the Division of Coastal Management in
Washington, NC. at [phone] to determine their requirements
Placement of dredged or fill material in Waters of the US and/or wetlands on this property
without a Department of the Army permit may constitute a violation of Section 301 of the Clean
Water Act (33 USC 1311). A permit is not required for work restricted entirely to existing non-
wetland area. If you have any questions regarding this determination and/or the Corps of

Basis For Determination: Area meets the 3 parameters specified in the 1987 USACE

application regarding your plan to fill wetland for the purpose of landfill expansion in Dare County.
Approval from DWQ is required to disturb these waters/wetlands. Please provide 7 copies of the
following information and refer to the DWQ # listed above in your reply.
Please provide detail for the stormwater management practices since landfills are capped to
prevent infiltration and are (thereby) impervious surfaces.
Please telephone me at 919-733-1786 if you have any questions or would require copies of our
rules or procedural materials. This project will remain on hold as incomplete in accordance with 15A
NCAC 2H .0505(c). The processing time for this application will begin when this information is
received. If we do not hear from you by writing within three (3) weeks we will assume you no longer
