The site is located in the southeastern quadrant of the intersection of Barber Mill Road and Dairy Road, just south of NC 42. The site is bordered to the north and west by road frontage. The site is within a larger area of lowto medium - density density residential development, pockets of commercial and industrial development, and remnant forested/undeveloped areas. 4b. A NCDWR Buffer Authorization for the project was issued by Stephanie Goss on June 6, 2019 (DWR# 19-0559). Since this buffer authorization, the Town has requested that the developer extend the proposed sidewalk to connect to Dairy Road. This extension will require the addition of a stormwater pipe to carry existing storm flowfrom the vegetated Swale along Dairy Road belowthe sidewalk to stream S1. This request is a 401 request for the addition of two rip rap dissipator pads within stream S1 and a modification to the previous buffer authorization for buffer impacts resulting from the new stormwater conveyance along Dairy Road. Comments: The proposed project is located within the Town of Clayton, and the Town of Clayton requires sidewalk improvements along Barber Mill Road and Dairy Road as part of site development and approval. The sidewalk parallels Barber Mill Road and is located within public R/W, however due to site constraints and the need to locate the public infrastructure on public property, the sidewalk must be located within 10' of the top of bank of stream S1, within the stream buffer (Site 1). Due to the flat grades present on the site however, the sidewalk within 10' of top of bank is not anticipated to reduce the stability of the stream banks. Additionally, S1 carries primarily stormwater runoff and is a very lowflow, historically degraded stream system. As a pedestrian sidewalk facility within existing public R/W, Site 1 is considered "allowable". Sites 2 and 3 result in minimal disturbance to the riparian buffer in the form of underground storm inter conveyances discharging from the stormwater treatment facilities servicing the proposed development. The existing buffer in these areas is currently well -maintained grass with no woody vegetation. The proposed drainage conveyances will result in no change to the buffer composition but will help improve stability in S1 and downstream water quality by capturing stormwater and providing treatment before the stormwater enters S1. Based on the drainage conveyances discharging treated stormwater, Sites 2 and 3 are considered "allowable". Minimal disturbance to Zone 2 will also result from the project in the form of very limited grading and revegetation of Zone 2 only, which is an exempt activity. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The proposed project has avoided and minimized impacts to Stream S1 and the riparian buffer by shifting the development as far east as practical within the property to avoid the stream and buffer along the western boundary to greatest extent practical. Stream impacts have been reduced by sizing the rip rap dissipator pads to the minimum size possible to avoid scour from the stormwater conveyances. The parking lot footprint was redesigned to avoid additional impervious impacts to the buffer. This also required the shift of the underground stormwater system, but results in less total impacts to the riparian buffer. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Impacts to streams and buffers in the property will be avoided and minimized to the extent practical during construction by avoiding them wherever practical and by locating construction access, material staging, and equipment placement within the stream or buffer. Temporary stream impacts resulting from the installation of the stormwater outlets and rip rap pads will be returned to pre-existing conditions upon completion of the project. Silt fencing will be utilized throughout the construction process, along With sediment basins and other stormwater control measures to avoid and minimize impacts to downstream receiving waters. 2. Stormwater Management Plan (SMP) Approval from Local Community_ Required The stormwater management plan (SMP) must be approved by the Town of Clayton and meet the requirements of this Certification. The SMP may not be modified without prior written authorization from the Town of Clayton. Protective Fencing All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the construction area on the project site shall be clearly marked (example- orange fabric fencing) prior to any land disturbing activities and must be maintained on the property until the project phase is completed. The plans and specifications for this project are incorporated by reference as part of the Buffer Authorization.
