The proposed route goes from the west side of the crossover south of US Highway 64 Alternative West going South and East to Kingsboro Rd. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: The stream will be crossed perpendicularly to minimize the stream and stream buffer impact. In the buffer and stream impact zone the construction corridor was reduced from a 50ft wide corridor to 40ft in width. Note, the permanent maintained access corridors in wetlands and across stream channels shall not exceed 30 feet wide per the attached Piedmont Natural Gas Permanently Maintained Access Corridor Protocol. The existing pipe segment to be replaced that is beneath a wetland and stream will be abandoned in place versus removal. This method of abandonment eliminates impacts to the stream and wetland at that location and reduces impacts to the buffer zones. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Construction BMPs will be implemented to ensure minimal impacts to wetlands, streams, and stream buffers, for example, timber matting will be utilized to minimize impacts from construction equipment. 2. Please note that this decision does not assure that participation in the DMS in- lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11. This acceptance is valid for six months from the date of this letter and is not transferable. Piedmont Natural Gas does not use herbicides to maintain vegetation on permanent access corridors. Mowing equipment and tree trimming equipment is utilized where feasible to ensure there is a clear line of sight of the pipeline corridor to perform inspections per Pipeline and Hazardous Materials Safety Administration (PHMSA) regulations. Much of the inspections are conducted using aerial patrols which is why it is important to ensure the tree canopy does not cover the pipeline corridor. Piedmont Natural Gas right-of-way(ROW) maintenance staff utilize GIS software to identify permanent access corridors based on recorded property easement data imported to the company internal asset management system. Note, the ROW maintenance staff do not use construction or permit drawings to plan maintenance activities. Once a project obtains environmental permits and/or approvals, the shapefile data of the jurisdictional features delineation is imported to the internal asset management system, displaying on an environmental layer which allows the jurisdictional boundaries viewable by the ROW maintenance staff when planning maintenance activities. Piedmont Natural Gas ROW maintenance staff have been trained on the NC GC 4133 conditions for permanent maintained access corridors and are aware of the allowable maintenance widths. Often it is difficult to perform vegetation maintenance in wetlands and at stream channels where there is steep terrain or wet conditions limiting vehicular use resulting in less than 30 feet maintained, thus complying with the NC GC 4133. To facilitate permit issuance and further identify construction and schedule constraints associated with threatened and endangered species, we are requesting an informal review be completed of PNG’s proposed pipeline relocation to identify areas of concern related to protected species, and to determine if additional field surveys will be required to support the consultation. Project Description The project is located within the Tar-Pamlico River Basin, adjacent to an unnamed tributary of Walnut Creek (Figure 1). A North Carolina Department of Transportation (DOT) road widening project will impact 950ft of Line 125 along Kingsboro Road in Tarboro, NC. This project will relocate this section of pipe to a new proposed route that will be approximately 1,540ft of 6” natural gas steel transmission pipeline. The project footprint comprises an approximate 0.29-mile corridor in Edgecombe County, North Carolina. The project is needed to increase system capacity and ensure pipeline integrity. Construction is anticipated to begin in November 2020. The project area is located primarily within privately-owned land. A map illustrating the project location over United States Geological Survey (USGS) topographic map is enclosed (Figure 2). Replacement of the existing pipeline will require a construction right-of-way (ROW) ranging from 40ft to 75ft wide. Additional temporary workspaces and access roads will be utilized in limited areas dependent upon access. The entirety of the pipeline relocation will be installed utilizing open cut methods. Following installation of the pipe, the trench will be backfilled and returned to pre-construction grade. A 40ft wide permanent maintenance easement will be maintained within the wetland impact area and a 50ft wide permanent maintenance easement will be maintained for the remainder of the pipeline in an herbaceous state. The remaining temporary workspaces will be allowed to regenerate naturally. Field delineations of streams and wetlands were completed in January 2020 (Figure 3). However, to facilitate Section 401 Water Quality Certification and Stream Buffer Determination requirements from the North Carolina Department of Environmental Quality (DEQ), a PCN will be submitted to the Wilmington District ACOE office. Because no public noticing period is required under a NWP, we are requesting informal consultation with FWS regarding listed species. Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable.
