We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. 4. Box 3725 Frederick, MD, 21705-3725 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Smith: You have our approval, in accordance with the attached conditions, to fill 0.02 acre of non-vegetated wetlands and to shade 0.43 acre of vegetated and non-vegetated wetlands in order to construct Phase 1 of the Whitehurst Shores Subdivision in Beaufort County, as described in your application received by the Division of Water Quality on November 22, 2002, and in plan revisions received February 4, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you.should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a. new, application for a new certification.. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in.15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification: and the additional conditions listed below: 1. Any future development plans or phases of construction and subsequent wetland, buffer and stream impacts will:be considered as cumulative with the impacts included herein in Phase 1 of the Whitehurst Shores Subdivision. You are advised that conditions included in this Certification will be placed on all future phases of construction; 2. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. This crossing is located adjacent to lots 41 and 57 as shown on sheet C1 of the CORE POINT LANDING plans that were included in the above mentioned CAMA Major. This crossing will actually take place in Phase-2 of the proposed development. PROJECT SUMMARY: The applicant proposes to construct a bulkheaded 80 lot Subdivision with an access lot and 10-slip pier at Whitehurst Shores Subdivision at Core Point. Whitehurst Shores Subdivision Beaufort County Project Setting Whitehurst Shores subdivision is being developed by Charleston Associates, LLC and is located at the end of SR 1167 (Whitehurst Road) adjacent the Pamlico River near the Blount's Creek Community in Beaufort County, North Carolina. This is a new 80-lot subdivision covering ±147 acres with ±1,600' of shoreline frontage. The majority of the property is existing agriculture fields vegetated with various upland grasses. Several hardwoods are present adjacent the shoreline of Pamlico River. The shoreline is an approximately 40' wide sandy beach that ends at a 3-5' erosion escarpment adjacent the agriculture fields. A large portion of the tract has been delineated as Section 404 wetlands by the U.S. Army Corps of Engineers and predominately is a wetland slough on the upstream (west) end of the property. The wetland area is vegetated with various hardwoods and some pines with an undergrowth of vines and shrubs in the transition area between wetlands and uplands. The project area is bordered on the upstream (west) side by wooded wetlands. The downstream (east) side is bordered by a developed and bulkheaded lot vegetated with lawn grass and several hardwoods. The property along the waterfront is not contiguous and is made up of four distinct sections segmented by private inholdings. The upstream section is made up of lots 15 and 16. The next section going downstream comprises lots 3 through 14, and the third section will make up lots 1 and 2. Lots 1 through 5 are bulkheaded at the erosion scarp with a sand beach ±30' wide. The downstream section will comprise the common access lot and this area is ±240' wide by ±50' deep. These four sections are separated by developed residential lots that are bulkheaded or have riprap. The existing properties will all have access from a proposed road that will run parallel to the river. The project site is ±4' above the normal water level (NWL). A portion of the proposed project is within the Tar-Pamlico River buffer basin jurisdiction. The Pamlico River is classified as SA-NSW by the Environmental Management Commission. The Pamlico River is not open to shell fishing in this area. Project description The applicant proposes to construct a pier, boat ramp and bulkhead on the common lot. The pier will be ±6' wide by ±304' long and have a ±6° wide by f 150' long T-head. Ten (10) slips are proposed on the waterward side (seaward) of the T-head and will be defined by five - 3' by 20' finger piers and 23 tie pilings. The total length of the pier complex will be ±340' and the existing water depth at the proposed slips is -3' below NWL. Approximately 240' of bulkhead is proposed on the common lot with the f 60' center section projecting ±5' waterward of the NWL and the sides will be winged back into the highground to preserve the beach on both ends. The proposed boat ramp is located in the center of the 60' bulkhead section and will be 15' wide and 30' into the water. The existing water depth at the end of proposed boat ramp is -1' below the NWL and the applicant proposes to excavate the slope to a -3' below the NWL. A ±82' long paved approach from the existing SR road to the proposed ramp will be constructed. A gravel parking area is proposed for the boat ramp and it will be located on the landward side of SR 1167. Whitehurst Shores Subdivision Beaufort County Page Two Approximately 1,360' of bulkhead/retaining wall is proposed for lots 6 through 16. The wall will average 40' landward of the NWL at the erosion scarp leaving the existing sandy beach natural. Six (6) 25' long wooden groins are proposed along the waterfront and they will project 25' into the river with amaximum height of 1' above the NWL. A ±6' wide by ±2,600' long boardwalk is proposed in the 404 delineated wetlands providing a nature trail and a pedestrian access within the Subdivision. A recreation area with a covered shelter and a secured boat storage area are proposed on portions of the property that are well inland. Anticipated impacts The project as proposed will result in filling of ±950 ft2 of river bottom associated with the placement of the boat ramp and bulkhead. The construction of the pier will result in the shading of ±3,024 ft2 of river bottom and the construction of the boardwalk will result in the shading of ± 15,600 ft2 of 404 wetlands. The construction of the roads will result in the filling of ±14,374.8 ft2 of 404 wetlands. The project as proposed will result in localized turbidity as a result of the construction activities.
