Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information. (1) It appears that, based on your Preliminary Master Plan submitted with your application, the proposed project will exceed 30% impervious cover; whereby, Division approval of your on-site stormwater management will be required as a condition of the 401 WQ Certification. This project is located in Water Supply V as such, the Division shall require that extended detention wetlands, bio-retention areas, and ponds followed by forested filter strips (designed in accordance with the most recent version of the NC DENR Stormwater Best Management Practices Manual) be constructed as part of the stormwater management plan.
