Dear Mr. Fox :
On March 18, 2002, the NC Division of Water Quality received your application for a 401 Water Quality Certification to impact 1,800
linear feet of streams and 20,000 square feet of Neuse Buffers in order to construct a dam and stream crossing at Fox Hill Farm in
Orange County. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by Mr. Steve Mitchell of
the DWQ Raleigh Regional Office, and we have discussed this application with Mr. John Thomas of the U.S. Army Corps of Engineers.
Insufficient information is available for us to complete our review of this project. Specifically, please provide the following information so
that we can complete our review of your application:
• Mr. Thomas indicated that this project may not qualify for Nationwide Permits 14 or 31, and as such would require an Individual
Permit. He noted that you are currently re-considering your proposed design. Please advise us when you have reached a final,
preferred design following coordination with the Corps of Engineers as to which 404 Permit will apply to this work.
• In your application, you stated that the stream you propose to impact is intermittent. Based upon field reviews conducted by Mr.
Thomas and Mr. Mitchell, we have determined that the stream in question is perennial, and that significant uses will be lost. As such,
cumulative impacts of 150 linear feet or more will require mitigation.
Since the stream impacts associated with this project exceed 150 linear feet, compensatory stream mitigation will be required for
this project in accordance with 15A NCAC 2H .0506(h). You have the following options for satisfying the stream mitigation requirement
associated with this project:
1. Payment into the North Carolina Wetland Restoration Program (WRP), if the WRP will accept the responsibility for conducting this
mitigation work, or
2. Preparing and implementing a stream mitigation plan.
Please note that your application will be considered incomplete until a detailed mitigation plan including a 1:1 stream restoration
component is forwarded to this office. We strongly suggest that you locate a mitigation site within the same river sub-basin as your
project. At this time we are unable to conclusively determine the stream (and possibly buffer) mitigation requirements due to the lack of
clarity in the final design.
If you decide to propose use of the Wetland Restoration Program in lieu of developing your own stream mitigation
plan, you will need to notify this office in writing in your response, and we will contact the WRP on your behalf to see if they will accept
the project. You should note that mitigation requirements proposed to be mitigated through the Wetland Restoration Program must be
rounded to the nearest linear foot increment according to 15 2r .0503(b).
Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this
project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)).

Dear Sirs:
Please find the Pre-Construction Notification Application for the above referenced site. We
estimate that the project will impact approximately 200 linear feet of intermittent stream for the
construction of a proposed dam and a stream crossing. We are requesting a Nationwide Permit
39 and 401 Water Quality certification for the proposed stream impact. It should be noted that
the proposed pond would flood approximately 1,600 linear feet of intermittent streambed.
All appropriate and practical steps to avoid and minimize impact to jurisdictional waters have
been taken. The dam is being designed to N.C. State Dam Safety and Federal Dam Safety
Standards. However, the slopes of the dam as well as the slopes of the crossing have been placed
to minimize impact to the waters. The Neuse buffer will be kept in tact around the proposed
pond.
While active mitigation is not planned, the headwaters of the pond will be graded such that the
area where groundwater will be raised to within twelve inches of the ground surface will be
maximized. In addition, the pond has been designed to minimize impact to all wetlands on the
site. By increasing the water area, the area where hydric soils and wetland plants thrive will be
increased, thus creating new wetlands.
An additional low level outlet will be included to draw cooler water from three feet below the
water surface (below the natural thermocline) in order to prevent heating of the water due to
solar influence on the pond surface.

IIL Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such 'as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties.. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial' viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed durin construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams:

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource 'functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current, guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
hLtp://h2o.enr.state.nc.us/ncwetlands/strmgide.html.

as much information as possible, including, but not limited to: site location (attach, directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)

2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that

On 02/28/02, your application for 401 Water Quality Certification for a project in Orange
County was received by the N.C. Division of Water Quality. Please note that beginning January 1,
1999, the N.C. General Assembly passed legislation requiring payment of a fee for all 401
applications, as indicated on page two of the PCN application form. Your application is being returned
since no payment was received with the package. The fee for applications is $200 for projects
impacting less than an acre of wetland and less than 150 linear feet of streams. For projects
impacting one or more acres of wetland or 150 or more feet of streams, the fee is $475. In order for
DWQ to review and process your request, you must send a check in the appropriate amount made
payable to the N.C. Division of Water Quality attached to your application.
Please note that a copy of your application is on file. Your check in the amount of $200 was received
on the above date. Please send the difference, equaling the amount of $275. The DWQ # 020297
references your file for Fox Hill Farm, is being placed on hold
