Size and Location of project (water body, road name/number, town, etc.): Brush Creek and an unnamed tributary
flowing through the Brush Creek Middle School property located off of Brush Creek Road and Highway
25/70/213 north of Marshall, North Carolina.
Description of Activity: to install 80 linear feet of culvert in Brush Creek to provide vehicular access into the new
Brush Creek Middle School property. In addition 150 linear feet of culvert is to be installed in the unnamed
tributary in conjunction with site preparation for a playground area.
Applicable Law: X Section 404 (Clean Water Act, 33 U.S.C.1344).

checked), before beginning work you must also receive a Section 401 water quality certification from the N.C. Division of

Please read and carefully comply with the attached conditions of the RGP or NWP. Any violation of the conditions of the
RGP or the NWP referenced above may subject the permittee to a stop work order, a restoration order, andior appropriate
legal action.
This Department of the Army RGP or NWP verification does not relieve the permittee of the responsibility to obtain any
other required Federal, State, or local approvals/permits. The permittee may need to contact appropriate State and local
agencies before beginning work.
