On February 4, 2002, the Division of Water QuE&y (DWQ) a=ived your letter dated January 31, 2002 to impact the
protected riparian buffers to construct a proposed pcoci at the property. The DWQ has determined that the proposed
project will require written authorization for imp >m riparian protected under the Neuse Buffer Rules (15A NCAC
2B .0233) and most likely will require a Minor V=m?mce appra%mL h order to issue this authorization the DWQ must
ensure that your project meets the No Practical A:rradves un t wed under these rules. Insufficient evidence is present
in our files to conclude that your project must be ?run"llt as planrf--:l 3m"-- protected riparian buffers in accordance with 15A

RE Lot 37 Devon Swimming Pool Design and NRB Zone 2 Variance request
Bob, I have been asked to design a septic system on the above-mentioned lot for a house
that has a swimming pool in the back yard. I am having trouble getting house, septic drain
field, and pool to fit on this lot. We have revised the house footprint several times and
reduced the number of bedrooms from 5 to 4 to reduce the size of the septic drain field
and moved the house forward 12 feet. Now my problem is that the entire front yard and
side yard is wrapped up with septic drain field and the only place I have for the pool is
directly behind the house sandwiched between the house, NRB, and septic field. I am
trying to move the house up towards the road some more if possible and shift the pool to
the left some too so I can at least get the pool out of NRB Zone 2, but I may have some of
the pool apron in zone 2 unless I can convince the pool designer to change the shape of
the pool to work around the zone 2. If some of the apron is located inside zone 2, we can
design it so that the runoff is directed back outside of the 50-foot buffer and establish
sheet flow down the hill with a level spreader. Having said all this, Can we have some of
the apron inside zone 2 if we redirect the runoff as described? If possible we will get the
pool and apron out of zone 2 as much as possible without encroaching on the septic field.
This NRB point is a spring discharge at the base of a hill and the surface water of the pool
will be about 10 to 15 feet above the spring elevation. Attached are some maps you can
look at to understand the problem and I can meet you on site if you wish.
