Dear Mr. Connor:
In December, 1998 the Environmental Management Commission issued a Final Agency
Decision which required Godfrey Lumber Company, Inc. to obtain an individual NPDES permit for the
subject facility. Godfrey appealed that decision and the matter is currently on judicial review in the
Wake County Superior Court in 99 CVS 01226. The Court entered a Stay of the EMC's Final Agency
Decision on May 12, 1999. The Stay was clarified by court Order dated December 21, 1999 and further
modified by court Order dated June 11, 2001.
Pursuant to the Stay Orders referenced above and in accordance with Godfrey's application for
coverage under NPDES General Permit NCG220000, we are forwarding herewith the subject certificate
of coverage to discharge under the subject state-NPDES general permit. Please be advised, however,
that if the Wake County Superior Court upholds the EMC's Final Agency Decision, DWQ will require
Godfrey to apply for an individual NPDES permit for this facility.
The NCG220000 General Permit is issued pursuant to the requirements of North Carolina
General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection agency dated May 9, 1994 ( or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable. If the ownership of the
facility changes, the old and new owners may apply for a transfer of the Certificate of Coverage to the
new owner, but the Division of Water Quality reserves the right to modify or revoke and reissue the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

Sampling for the General Permit, as listed in Part II, Sections B, C, and D, of the General Permit,
should commence with the sampling requirements beginning on July 1, 2001, for purposes of your
coverage.

regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the
Federal Water Pollution Control Act, as amended,

is hereby authorized to discharge stormwater from a facility located at
Godfrey Lumber Company, Inc

Pine Hall
Stokes County
to receiving waters designated as tributaries to the Dan River in the Roanoke River Basin in accordance with the
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III, IV, V, and VI of
General Permit No. NCG220000 as attached.
This certificate of coverage shall become effective August 7, 2001.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
