Dear Mr. Anderson,
On April 23, 2019, Kelli Park and Sue Homewood, of this office, met with Kim Sue, of the
Mooresville office, to inspect Anderson Aggregates, LLC (herein known as Anderson
Aggregates), for a potential illegal discharge into surface waters of the State. This site is located
in Davie county at 872 Main Church Road in Mocksville, NC.
.DWR staff observed a discharge from the above facility entering a tributary to Elisha Creek (Class
C Waters). This constitutes a violation of NC statutes and regulations designed to protect the
water quality throughout the state. The specific violations are listed below:
I. Discharge Without a Valid Permit
§ NC General Statute 143-215.1. Control of sources of water pollution; permits required.
(a) Activities for Which Permits Required. - Except as provided in subsection (a6) of
this section, no person shall do any of the following things or carry out any of the
following activities unless that person has received a permit from the Commission
and has complied with all conditions set forth in the permit:
(1) Make any outlets into the waters of the State.
(6) Cause or permit any waste, directly or indirectly, to be discharged to or in
any manner intermixed with the waters of the State in violation of the water
quality standards applicable to the assigned classifications or in violation of
any effluent standards or limitations established for any point source, unless
allowed as a condition of any permit, special order or other appropriate

instrument issued or entered into by the Commission under the provisions
of this Article.
11. Discharge of Other Wastes
15A NC Administrative Code 02B.0211 Fresh Surface Water Quality Standards for Class C
Waters
(a) Discharge of Other wastes
(12) Oils, deleterious substances, colored, or other wastes: only such amounts
as shall not render the waters injurious to public health, secondary
recreation, or to aquatic life and wildlife, or adversely affect the palatability
of fish, aesthetic quality, or impair the waters for any designated uses. For
the purpose of implementing this Rule, oils, deleterious substances,
colored, or other wastes shall include substances that cause a film or sheen
upon or discoloration of the surface of the water or adjoining shorelines
pursuant to 40 CFR 110.3(a)-(b) which are hereby incorporated by
reference including any subsequent amendments and additions.
Anderson Aggregates must cease all such discharges immediately. Pursuant to NCGS
143-215.6A, failure to immediately eliminate the discharges subjects Anderson Aggregates
to civil penalties not to exceed $25,000 per violation, per day.
We respectfully request that you reply to this correspondence in writing within 10 days of receiving
it. Your written reply must include all actions you have taken and/or plan to take to eliminate the
discharges and correct the root causes of the discharges.
Your written reply should detail all steps Anderson Aggregates, LLC will take to remediate the
effects of the discharge summarized above, as well as prevent such incidents in the future.
If you have any questions regarding this Notice or the requirements therein, please do not hesitate
