In October of 2008 the company I was a part owner of, Innovative Recycling Services, Inc., was forced to
file for bankruptcy after the Bank we used to finance our Property and Equipment called our loans. The
reason they called our loans was directly due to the fact we could not acquire our needed permits from
NCDENR to operate a composting facility in Winston-Salem, NC.
Since we were forced into bankruptcy we lost the property we owned in Catawba County for which we
had a stormwater permit (NCG210382). The Bank took over all ownership of the property and we were
not allowed to enter the property after they seized it.
Our bank (Southern Community Bank) in Winston-Salem was sold to Capital Bank a couple of years ago,
but from what we heard, this property was sold to another investor back in 2009 or early 2010.
Even though we did everything possible to build and be successful with an environmentally friendly
company, we were shut down by DENR and by our Bank. We would recommend you send future
notices to Capital Bank or the current owner of this property. Since filing for personal bankruptcy in
2009, 1 have been mainly unemployed. My wife and I have lost a great deal due to losing our business
but we still work daily to help protect our environment and educate others to do the same.

Annual Permit Fee Open
This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs associated with
your permit. It is required of any person holding a permit for any time during the annual fee period, regardless of the facility's
operating status. Failure to pay the fee by the due date will subject the permit to revocation. Operating without a valid
permit is a violation and is subject to a $10,000 per day fine. If the permit is revoked and you later decide a permit is
needed, you must reapply, with the understanding the permit request may be denied due to changes in environmental,
regulatory, or modeling conditions.

In response to yourrenewal application for continued coverage under stormwater General Permit NCG210000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit has been reissued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Stormwater Permit NCG210000
• A copy of the Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes to the General Permit include the following:
• Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in
either the process, or in the exposed materials, to the Timber Products Industry.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for continued coverage at the next renewal of the General Permit.
• Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines
are wastewaters.
• Part II Section A — The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified.
• Part II Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with
exposed piles of certain materials remaining on site longer than seven days.
• Part II Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the
permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the
second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences.
• Part II Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark
will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct
the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.
• Part It Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to
respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management
requirements if the permittee is non -responsive, or if the responses are ineffective.
Your coverage under the General Permit is transferable only through the specific action of DWQ.

Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required

Management Act, or any other Federal or Local governmental permit that may be required.

Hi Ted,
1) DWQ has struck a deal with Gary Bilbro for his site in Hickory. I'd like to relay
the particulars to you, if you'll contact me in response to this email or my earlier
phone message. The essence of the deal is: DWQ agreed to permit flows from Gary's
site under a stormwater permit; Gary Bilbro agreed to install and maintain certain
site and operating controls.
2) What kind of communication do you need from DWQ in order to make progress on their
solid waste permit? Is this email enough? (meaning you have all you need today.) Do
you need something more? (meaning that I could get something to you Thursday or
Monday maybe) Please recognize that it may be on the order of two to four weeks
before Innovative Recycling submits a stormwater permit application and we process it
and produce the final DWQ stormwater permit.
3) can you expedite delivery of the list of facilities that we agreed on in our last
face-to-face?.

In accordance with your application for discharge permit received on April 18, 2007, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Special provisions for Innovative Recvclina Services, Inc. (IRS)
• IRS will maintain a waterproof cover over stockpiles of boiler fuel chips in which any
chips have been in place for over 14 days. (IRS will provide cover on or before the 15i°
day.)
• IRS will maintain a waterproof cover over stockpiles of mulch chips in which any chips
have been in place for over 2 days. (IRS will provide cover on or before the third day.)
• IRS will clean accumulated materials from the sediment ponds identified in the permit
application site plan as needed to maintain the capacity of the ponds, but not less than
monthly.
• IRS will submit a copy of the required Stormwater Pollution Prevention Plan (SPPP) to
the Stormwater Permitting Unit of DWQ within 30 days of its completion. The SPPP
shall contain an updated site plan based on the permit application site plan and showing
drainage ditches, sediment basins, topography, improvements, contributing areas, points
of stormwater discharge from the property, operational areas, and any other surface
features that may affect the surface flow of runoff.
• IRS will maintain in the SPPP a monthly log of visual inspections of each location where
stormwater leaves the property boundaries of the IRS site. IRS shall record observations
of any erosion features at the property line or on adjoining property, any deposition of
site, materials at the property line or on adjoining property, or other like impacts at the
property line or on adjoining property, and shall record in the SPPP remedial actions
taken in response to such observations. If remedial actions are indicated by the observed
conditions, IRS shall contact the DWQ regional office in Mooresville to request DWQ
staff consultation on the remedial response.

Gentlemen, As you recall we had an urgent meeting with Mr. Gary Bilbro
about the need
for a water quality decision on the type of permit that may be
appropriate for his wood
waste facility in Hickory. I thought the meeting went well and had been
told things were
progressing well. .
Today, i was informed that a permit still had not been issued to the
Innovative Recycling Services
facility and that his financial backers would withdrawn their support
June 1, if the environmental
issues with the state have not been resolved.
Would you please advise me of the status of this project? Do we have
continuing environmental
concerns that cannot be addressed quickly? Are there things the client
has not addressed?

Innovative Recycling Services, Inc. (IRS), is pleased to submit this permit application for a
Treatment and Processing Permit for the old Banks site in Hickory, NC.
The proposed facility will process 8,000 to 12,000 tons per year of land clearing debris and
woody waste materials into high -quality mulches and into boiler fuels for wholesale distribution.
The current owner D.R. Banks, Inc. has been operating this facility for the past three years under
permit #18-07. The site was permitted to accept wood waste for grinding into mulch for
landscaping and boiler fuel. It is the intention of IRS to purchase this property from D.R. Banks,
Inc. and to take over the existing business and markets Mr. Banks has amassed over the past
three years.
The documentation attached includes a site plan we had developed for our proposed facility by
McGill Associates of Hickory, NC.

Innovative Recycling Services, Inc. Hickory Property Permit
Property Information:
The facility is located at 1230 13°i Street SW Hickory, NC 28602 in the County of Catawba.
The parcel ID # is 279216735615 and the entire property consists of 9.16 acres of land. The
processing area consists of just over 1.5 acres in the center of the property. Static piles and
Finished Product storage consists of another 5 + acres. The rest of the acreage is used for offsets
and roadways. Vicinity maps are included herein.
The roadway from 13`h Street will be paved down to the proposed office trailer and the ten foot
elevation of dirt on the North side of the site will be removed. The entire site will be on two
levels. The first level coming into the property will be for raw material storage, processing and
finished product storage. The lower part of the site will be for sales stockpiles.
All existing sediment ponds and storm water collection structures have been cleaned, upgraded
to current standards, and put back into service. These structures and ponds are identified on the
attached site plans. Historical inspection reports on these facilities are no longer available from
the DENR-Mooresville Regional Office as they have a practice of returning "dead" files to the
host jurisdiction; however Catawba County has no record of this information. IRS has asked
Catawba County to inspect these structures anew; this inspection should occur prior to
3/31 /2007.
Maps & Photos:
The attached Aerial Photograph (at a scale of 1" = 272') of the property and the surrounding
area was provided by the Catawba County GIS On-line system. The site is in the Longview
Township but is under the development plan of the City of Hickory. The site is bordered by
mostly wooded tracts all of which are under the same zoning classification of 1-1. IRS has
received a Special Use permit from the City of Hickory Planning Board. The Special Use Permit
was issued on March 1, 2007 (copy attached). We have also attached a Vicinity Map showing
the location of this property in relation to local towns and cities, including major thoroughfares.
Site Plan:
The Site Plan that is attached shows the property and the layout of the facility, along with all
features required by DENR: the processing areas, property lines, topography, sediment and
erosion control structures, utilities, roadways and proposed office details.
The existing Sedimentation and Erosion Control Plan (dated 1/28/2003) used for this permit
application conforms to all existing requirements from the City of Hickory and the State of NC
DENR. The Storm Water coming from the processing areas will be captured and controlled
within the ponds and the surrounding runoff has been controlled to conform to all local and state
requirements.

Siting Criteria:
Setbacks — The setbacks from the property lines are as follows
North side of processing area = 50 feet from property line
West side of processing area = 50 to 75 feet from property line
South side of processing area = 50 to 80 feet from property line
East side of processing area = 60 to 105 feet from property line
West side of property line is 260 feet from Longview Branch
East side of property line is 800 feet from closest water supply well
West side of property line is 850 feet from closest residential building
100 Year Flood Plain — FEMA flood insurance maps (see attached) show this property is not in
a flood plain and identifies the closest area to the property that is.
Depth to Groundwater - The facility is not located where the depth to the seasonal high water
table is'within 12 inches of the soil surface. All surrounding land is at least 30 feet below the
surface of the processing area due to the emplacement of fill over the years. This site is
underlain by Pacolet and Madison sandy loams, and depths to groundwater in these series is
reported at > 5 ft. and > 10 ft., respectively.
Endangered or Threatened Species - Due to the extensive disruption of natural habitats by
previous land uses, the property does not contain any endangered or threatened species, wildlife
or plants and the continued use of the facility for land clearing debris processing will not cause
any harm to any habitats.
Planning/Zoning — The property is zoned 1-1 by the City of Hickory and is in their planning and
zoning jurisdiction. A Special Use permit has been received and a copy included herein.
Legal Description — A copy of the existing NC General Warranty Deed for D.R. Banks, Inc on
this property is attached to show the Legal Description of the property. This Deed is located in
the Catawba County Register of Deeds in Book 2418, Page 1676.

Operation Plan:
This facility will process 8,000 to 12,000 tons/year of the following types of land clearing debris
and woody wastes.
• Land Clearing Debris
• High Carbon:Nitrogen (C:N) Ratio Yard Waste (no leaves, grass, or shrubbery)
• Pallets and other Kiln Dried wood (no treated wood)
• Furniture manufacturers scrap wood (non painted, stained)
• Clean Building scrap lumber (no treated wood)
This material will be processed to make mulch and boiler fuel. IRS will open the facility from
the hours of 7:30 am to 4:30 pm, Monday through Friday and from 7:30 am to 12:30 pm on
Saturday. Wood waste will be brought in by varying sizes of trucks and/or trailers. The loads of
debris will be visually inspected by the attendant for unacceptable materials. No C&D type
waste or yard trash will be allowed on site. Small amounts of unacceptable materials in a
commingled load will be manually removed to an onsite dumpster. Larger amounts of
contamination in a load will result in the entire load being rejected. Once the load of wood
debris has been approved it will be sent to the unloading area located on the Northeastern portion
of the processing area.
IRS currently has contractual commitments to supply the following volumes of processed

Mixed loads of stumps, brush and miscellaneous land clearing debris will be sorted with the use
of a 200 series Excavator. Stumps will be split and any dirt will be stored in a static pile located
on the very Northern side of the static pile area. IRS can accumulate up to 300 cubic yards of
dirt in this area. Once the dirt has a chance to dry out, it will be sent through the Screening
System and sold as clean fill dirt or will be mixed with bark/wood fines and sold as a blended

top -soil. It is anticipated less than 20 to 30 cubic yards of dirt will be accumulated, processed
and sold in a given month.
All of the wood waste will be processed through a Grinder with 3 %2" to 4" screens. The mulch
will be immediately sent though the screening system to remove the dirt from the material. The
mulch will be placed in static piles for a first stage of processing. Each static pile will be six feet
tall and fifteen feet wide. Static piles will range from 100 ft to 200 ft in length depending on the
location of the static pile in this area. As soon as possible, the mulch will be sent through the
Grinder again this time with 2" to 3" screens. This regrinding process will generate varying
types of mulch products. This twice -ground mulch will be stored in the 1.5-acre Finished
Product storage area on the Southern portion of the processing area for final processing (this
process can take up to 30 days). Finished product will be stored on site for anywhere from one
(1) to three (3) months and will be covered to minimize any potential water quality impacts to
Longview Branch. Market conditions and seasonal requirements will dictate how long the
material will be on the site in static piles. None of the onsite storage piles will be larger than 12
feet deep by 24 feet wide so as to minimize the potential for a spontaneous combustion fire. The
ultimate goal is to have the mulch processed and sold as soon as the product is ready for market.
Pallets and clean kiln dried wood will be separated and processed through a Grinder with 4"
screens. This ground wood will be put in a concrete bunker (with a capacity of 300 CY) in the
finished products area or put directly into a Walking Floor Trailer to be shipped to local
customers as Boiler Fuel. Pallet nails, staples and other metal objects will be collected and
captured in a metal box designated for this use. Full boxes of this metal will be sold to a local
metal recycling customer. Any other foreign objects, such as plastics, paper and sometimes
cardboard will be collected and placed in a front -load dumpster that will be emptied by a local
refuse hauler.
As static piles are completed, the ground under which the static pile was placed will be scraped
and prepared for another static pile to be built. Clean paths will be maintained between each
static pile to allow for access to static piles in the event of a fire. Each static pile will be
accessible by heavy equipment or a fire truck if necessary. In dry events, water from the pond
will be used to control dust coming from the roadways and/or grinding area.
IRS understands that woody material processing has a risk of fires from both equipment and
spontaneous combustion sources. IRS Fire. Management Procedures include: operating fire
extinguishers on all equipment; preventive maintenance on all equipment to minimize potentials
for leaks of combustible fluids, monitoring ground mulch piles for temperatures in excess of
180' F., and coordination (and training) with the local fire department in the event their services
might be needed.
IRS also understands that, protecting the water quality of nearby Longview Branch (more than
250 feet west of westernmost site boundary) is important. IRS has upgraded several sediment
traps to current DENR standards and they will be periodically cleaned of accumulated sediment.
In addition, for finished product piles still on -site after 30 days, IRS will cover the piles to
prevent rainfall from leaching anything out of the wood waste. This will also improve product
quality, further enhancing it's rapid sale and movement off -site. As there are no sources of

nutrients in the incoming materials that IRS processes, there is no risk of nutrient -laden runoff
leaving the site. As there are no sources of pathogens in the incoming materials that IRS
processes, there is no risk of fecal coliform contamination of runoff leaving the site. In addition,
as IRS processes fresh wood waste, there is little risk of runoff containing high levels of
Biochemical Oxygen Demand (BOD) as might be encountered at a "managed decomposition"
facility like a composting operation.
In summary, the Operations Plan consists of accepting clean loads of land clearing and wood
debris of varying sizes and types. The debris will be sorted and placed in different areas for
processing. IRS will be grinding and screening the material and manufacturing both Mulch or
Boiler Fuel products for direct shipment to end users (for boiler fuel) and to retail mulch yards
(for mulch). IRS will be taking the ground Clean/Dried wood chips and in most cases shipping
it directly to local markets. IRS anticipates accepting 20,000 to 30,000 cubic yards of material
per three month period. Due to the space constraints of this facility, a combination of no more
than 10,000 cubic yards of raw material, processed mulch or finished product should be on site at
any one time.
Equipment to perform these operations consists of an Industrial Tub Grinder, a 200 series
Excavator, a D6 sized Dozer, a Wheeled Loader with Grapple and Bucket and a Walking Floor
Trailer and pulling Tractor. This equipment will be on site from four to ten days a month
depending on the quantity of material required to be processed. A 200 series Excavator and
Smaller Wheeled Loader will be on site 100% of the time for daily processing of incoming
debris and mulch or boiler fuel products.
In the business of processing wood debris there are always going to be issues with equipment,
weather and markets. IRS has a Contingency Plan to assist in the times equipment failure or
inclement weather occurs or if unforeseen constraints affect product markets.
Local rental agencies have similar equipment available for daily to monthly leasing. Our
company employs several qualified mechanics that can repair most malfunctions; however
contracts are in place with Certified Manufacture Mechanics for most of the Equipment listed.
Equipment failure is not the only problem that can occur.
The facility will not operate in heavy rain periods (more than 5" in a 24-hour period) or in icy or
snowy conditions. The facility will close on all major Holidays and will not open if the weather
conditions make it a hazard to operate the equipment or to be on the roads with the Tractor
Trailers.
Other issues that need to be managed include the markets and the local and state permit
requirements. Our markets will be constantly reviewed and enhanced. This facility will be
successful as long as there is a need to have a place to bring this type of debris and there are
strong markets for the mulch and boiler fuel products. In the event of unforeseen disruptions to
IRS's markets for the processed material that causes unacceptable increases in inventory, IRS
will: 1) cease taking in new raw waste for processing until inventories can be cleared out and/or
2) negotiate wholesale distribution arrangements with one or more composting facilities in NC
that need bulking agent. Local and State permit requirements may change from time to time, so

it will be our responsibility to keep up with these changes and to keep our facility within the
boundaries of these rules.
IRS will institute a training program for all facility employees. This training program will
consist of; the proper use of the heavy equipment, DENR permit requirements, operations plan
management, mulch and top -soil quality processing requirements, facility safety initiatives and
other items of importance for our on -site staff. Each staff member will be trained in OSHA
required first aid treatment in case of any on -site injuries.
The staff and management of IRS will keep records on the material being brought to the facility
daily for Local and State Reporting. The amount of material on site at any one time will be
recorded and the amount of product being shipped out daily will be tracked. Since IRS will not
have a scale system to track tonnages, it will be the responsibility of the management to convert
the material from Cubic Yards to tons. Periodic bulk density testing of ground material will be
done to ensure IRS reports to DENR are based on the industry standard of 1 cubic yard = 400
lbs. A report will be generated and available for local inspection on a monthly basis. Daily
records can also be reviewed by local inspectors if necessary. A full report of the facility
volumes will be sent to the Division of Waste Management, Solid Waste Section each August
with figures showing activity from the previous July I" to June I" time period. This report will
include the tonnage received, tonnage distributed and the amount of material on site as of June
30 of that year. Additional records will always be available by contacting the management of
IRS.
