Forest City, North Carolina 28043 Dear Mr. Bunch: Subject: Review of 401 Certification Application A G Industries DWQ Project No. WQ 01-0540 Rutherford County have reviewed the 401 application submitted by you for proposed stream impacts to Morrow Creek, south'-of the City of Forest City in Rutherford County. Based--on-my-review, additional information will be needed before a determination can be made on the 401 Water Quality Certification. The following is a list of items needed: 1. Avoidance and Minimization. In accordance with our regulations it is requested that you look at avoidance and minimization issues. Can the project be reconfigured or relocated on the site to avoid or minimize the stream impacts? 2. Stormwater. A formal stormwater plan should be submitted for approval. The Division cannot process your application until a stormwater plan is approved. Please refer to the Wetlands/401 Unit web page for the stormwater plan requirements. Our web page address is http://h2o.enr.state.us/ncwetlands. 3. Stream Relocation. The Division cannot process your application until a complete relocation plan for all impacts have been approved including reference reach information. Each reference reach site will need approval from the Division. Also, you will need to provide detailed plans for the stream relocation using natural stream design criteria (i.e. Rosgen type methods). Please refer to "The Draft Technical Guide for Stream Work in North Carolina" which list the information that is need for review. A copy of this document can be downloaded from the Wetlands/401 Certification Unit web page. Mr. W. Mel Bunch, V.P. May 15, 2001 Page Two 4. A conservation easement, twenty five (25) feet on each side of the stream, will be required for the stream relocation area. Copies of the conservation easements must be submitted to the Division. 5. Monitoring of the stream relocation site will be required for a period of five years. Your application is being placed on hold for our processing due to the incomplete information. This information is needed by the Division of Water Quality in order for us to decide whether this project is approvable. By copy of this letter we are advising the Corps of Engineers of your project status. Your processing time will begin once we receive a complete application.
