On May 15, 2000 the Division of Water Quality wrote to you concerning your plans to impact an unreported
amount of acres of wetlands and/ 1,139 linear feet of streams regarding the proposed development in Rutherford County.
This letter informed you that the project was incomplete and was being placed on hold until the additional information
outlined in the letter was supplied. To date, we have not received this additional information. "Unless we hear from you in
writing within 3 weeks of the receipt of this letter, we will consider that you no longer want to pursue this project and we
will retire the file and consider the application as withdrawn: Please be aware that reapplication for this project will require
a Certification fee and new applications.

Rutherford County
have reviewed the 401 application submitted by you for proposed stream impacts to
Morrow Creek, south'-of the City of Forest City in Rutherford County. Based--on-my-review,
additional information will be needed before a determination can be made on the 401 Water
Quality Certification. The following is a list of items needed:
1. Avoidance and Minimization. In accordance with our regulations it is requested
that you look at avoidance and minimization issues. Can the project be
reconfigured or relocated on the site to avoid or minimize the stream impacts?
2. Stormwater. A formal stormwater plan should be submitted for approval. The
Division cannot process your application until a stormwater plan is approved.
Please refer to the Wetlands/401 Unit web page for the stormwater plan
requirements. Our web page address is http://h2o.enr.state.us/ncwetlands.
3. Stream Relocation. The Division cannot process your application until a complete
relocation plan for all impacts have been approved including reference reach
information. Each reference reach site will need approval from the Division.
Also, you will need to provide detailed plans for the stream relocation using natural
stream design criteria (i.e. Rosgen type methods). Please refer to "The Draft
Technical Guide for Stream Work in North Carolina" which list the information that
is need for review. A copy of this document can be downloaded from the
Wetlands/401 Certification Unit web page.

4. A conservation easement, twenty five (25) feet on each side of the stream, will be
required for the stream relocation area. Copies of the conservation easements
must be submitted to the Division.
5. Monitoring of the stream relocation site will be required for a period of five years.
Your application is being placed on hold for our processing due to the incomplete
information. This information is needed by the Division of Water Quality in order for us to
decide whether this project is approvable. By copy of this letter we are advising the Corps of
Engineers of your project status. Your processing time will begin once we receive a complete
application.

On April 10, 2001 the Division of Water Quality (DWQ) was notified by receipt of
your applications (dated March 16, 2001) regarding your plan to fill 1.139 feet of streams
for the purpose of industrial expansion in Rutherford County. Approval from DWQ is
required to disturb these streams. Please provide seven copies of the following
information and refer to the DWQ # listed above in your reply. We are not certain
whether the Corps of Engineers will require a Nationwide or Individual Permit for this
project. Please advise us as to their decision. We also need to know from the local
government whether the Water Supply Watershed Protection rules apply.
Please call me at (919) 733-1786 if you have any questions or would require
copies of our rules or procedural materials. This project will remain on hold as
incomplete in accordance with 15A NCAC 2H .0505(c). The processing time for this

Enclosed please find the Pre-Construction Notification Application Form for Activities Affecting
Waters of the United States for the proposed AG Industries industrial expansion located in Rutherford
County, North Carolina.
AG Industries (applicant) requests USACE authorization under Nationwide Permit No. 27 to
relocate and restore approximately 1,139 linear feet of stream channel to provide level building space for an
industrial expansion project. The industrial expansion will include the construction of a new warehouse on
the southern side of the existing American Greetings plant in Cool Springs Township. Site location, project
layout drawings, and cross-sectional drawings are included with the application package.
If Nationwide Permit No. 27 is authorized for this project the applicant will prepare and submit for
review a stream restoration plan in accordance with NC DENR guidelines. The plan will include specific
details of stream bank stabilization, in-stream habitat structures, physical and biological monitoring, and
contingencies.

The proposed work consists of the clearing and grading of 49.90+/- acre property to prepare the site
for expansion. The development will include the construction of a new warehouse, parking, and
stormwater management facilities behind the existing American Greetings Facility. The site
development plan is provided on Sheet 3 of 5. Cross-sectional views are provided in Sheets 4 and 5
of 5.
13. PURPOSE OF PROPOSED WORK: The purpose of the proposed work is to prepare the site for a new
warehouse.

On March 28, 2001, your application on behalf of AG Industries for 401 Water
Quality Certification for a project in Rutherford County was received by the N.C.
Division of Water Quality. Please note that beginning January 1, 1999, the N.C. General
Assembly passed legislation requiring payment of a fee for all 401 applications. Your
application is being returned since no payment was received with the package. The fee for
applications is $200 for projects impacting less than an acre of wetland and less than 150
linear feet of streams. For projects impacting one or more acres of wetland or 150 or
more feet of streams, the fee is $475. In order for DWQ to review and process your
request, you must send a check in the appropriate amount made payable to the N.C.
Division of Water Quality attached to your applications. Also, seven copies of all
application materials are required for our review. Also, for your records, please notice
