Cumberland County Dear Mr. McLaurin: Reference is made to your recent request for rescission of coverage under the subject NPDES General Permit. In your letter received on December 11, 2007, you stated that your facility does not discharge stonnwater as it is contained in ditches that are placed around the facility. In accordance with your request, NPDES General Permit NCG210193 is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwiiter to waters of the State without a.valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished Permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Your time and assistance during the inspection was greatly appreciated. The site visit and file review revealed that the subject project is COv Bred by NPDES Stormwater General Permit-NCG210193. However, it has been determined that your facility does not appear to need the NPDES Stormwater Permit because of the containment ditches that have been put in place around the facility. It was revealed, at the time of the inspection, that these ditches have no outlets; so therefore, they cannot discharge from the property. Please be advised that in order to be removed from coverage under this permit, you need to send a letter to this office requesting rescission of the storrlwater permit. However, at the time of the inspection, it was noted that no discharges to a receiving stream can occur. The owner of the facility in years past, dug canal ditches around the property. The ditches act as containment ditches because none of them discharge into any other ditches or conveyances that may lead to a receiving stream. The ditches have no inlet or outlet. The stormwaler that flows from the facility property is contained within those ditches. It is determined that this facility does not need the industrial stormwater permit.
