Klimek, P.E., Director Division of Water Quality On April 18, 2007 Mr. Myrl Nisely of the Raleigh Regional Office of the Division of Water Quality (DWQ) carried out a compliance evaluation inspection of your facility. The detailed discussion and tour given by you and Mr. Gary Browner was appreciated. This was the first time DWQ had inspected this facility (see the attached checklist), so deficiencies in the stormwater program are being addressed via this Notice of Violation. The following issues are to be addressed: A well -written Stormwater Pollution Prevention Plan (SP3) dated 1998 was available, but had not been reviewed since that time. With reference to the most recent version of the permit, please update each of the topics required in the SP3. This should be accomplished by June 30, and you may expect a follow-up inspection in August 2007 to examine the revisions. 2. Enlarge and embellish the site map to include the wood waste disposal area and the full extent of the property line. Indicate the direction of rainwater flow within the plant as it travels to the perimeter ditches. Please also label the outfalls on the map and otherwise include all the details described in the site map paragraph in the permit. No quantitative monitoring is required because the facility does not use more than an average of 55 gallons of motor oil per month. 4. The plant was clean and well organized. Soon carrying out and documenting the actions required by the stormwater permit should help you maintain what appears to be good environmental stewardship. The facility permanently shut down in November 2000. In accordance with this information, NPDES General Permit NCG210201 is rescinded, effectively immediately. Please be advised that this permit rescission is based wholly upon the company no longer being in operations and that the activities which would require ecneral permit coverage at the site have ceased or been eliminated. Division staff has not visited the site to obtain independent verification. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES Permit.
