This correspondence is in reference to a letter from your office dated February 28, 2002, in
regards to the plans for the filling of 0.41 acres of wetlands at Farrington Farms near US 17 and
Gordon Road in New Hanover County for residential development.
We would like to request an extension of an additional 30 days from the end of the 3 weeks
granted by you beginning on the date of postmark on the envelope, which is March 5, 2002, in
order to consult with the client and to obtain the necessary information that you have requested.
Thank you for your consideration in this matter, and please do not hesitate to contact our office if
this arrangement is not acceptable.

On March 13, 2001 the Division of Water Quality wrote to you concerning your plans to fill .41 acres of wetlands
and/or linear feet of streams regarding the proposed development located at Farrington Farms near US 17 and Gorson
Road in New Hanover County for residential development. This letter informed you that the project was incomplete and
was being placed on hold until the additional information outlined in the letter was supplied. To date, we have not
received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this letter, we will
consider that you no longer want to pursue this project and we will retire the file and consider the application as
withdrawn. Please be aware that reapplication for this project will require a Certification fee and new applications.

Dear Sirs:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.41 acres of
wetlands located at farrington Farms development near US 17 and Gordon Road in New Hanover County for
residential development as described in your application dated January 10, 2001 (received January 25, 2001).
Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or
wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as
described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H
.0507(e) and will place this project on hold as incomplete until we receive this additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative
hold.
Please provide us with information supporting your position that states your project must be constructed
as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands.
Specifically can you conduct your development by
1. deleting lot #42 since it is not buildable without wetland fill,
2. discuss whether minor lot fill is needed for lot 43 and .
3. discuss whether deed restrictions are all planned for all of the remaining wetlands?
Any documentation such as maps and narrative that you can supply to address alternative designs for your
project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to me
and to Ms. Joanne Steenhuis, Wilmington Regional Office at (919) 571-4700. If we do not hear from you in three
weeks,, we will assume -that you -no. longer -.want,. to pursue- this -project and we will consider the project as _

SUBJECT: 401 Water Quality Certification for Farrington Farms Development Corp., near

The North Carolina Wildlife Resources Commission is reviewing the project for impacts
to wildlife and fishery resources. Our comments are provided in accordance with provisions of
the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section
401 of the Clean Water Act (as amended), and North Carolina General Statutes (G. S. 113 -13 1 et
seq.).
The applicant is seeking authorization to fill 0.408 acre of jurisdictional wetlands for the
development of 3 lots at the end of a cul-de-sac in a subdivision. Our application materials are
incomplete, as no map of the project was provided. We ask that the application be placed on hold
until a complete application package is circulated for review.

wetlands - they are imposing the fill of almost the entire lot # 42
This office would approve the minor fill of lot #43 lot # 41 is already built on and the owner has no
desire to fill the wetland. It is also recommended by this office that the remaining wetlands behind
lots 63- 62- 61 & 60 have deed restrictions placed on them.

I am looking at two separate projrcts from Mitchell and Assoc.
The Tom Bowden Project 00-1419 has been on hold for additional info
once. In talking to the COE I have discovered the second application is
also wrong due to a reduction of impacts to 0.1 ac of impacts for the
COE. I have left a message for the consultant to call me.
The second project Farrington Farms .... does NOT show where the impacts
are located (although the 0.408 ac of fill is mentioned). The
preservation area is depicted on the drawings. NO avoidance was done
since it looks like an entire lot is to be filled (but I am not sure).
I'll be talking with the consultant in this one as well.

The purpose of this correspondence is for Mitchell & Associates, Inc., representing Farrington
farms Development Corp., to submit a Department of the Army Nationwide permit application for
excavation and the placement of fill in wetlands to facilitate subdivision development. The site is
located .4 miles West of Hwy 17,.4 miles North of Gordon Rd., Adjacent to West Bay Estates
and Adjacent to Alamosa Place, New Hanover County, North Carolina. Drive and Oyster Point
The applicant has considered other alternatives to the placement of fill material in wetlands to
accomplish their project goal, however, the proposed plan is the only practical alternative
available. Other alternatives were not practical, significantly more expensive to the applicant, or
involved even greater wetland impacts. The project has been designed to avoid and minimize
potential adverse effects to other wetland areas. Additional measures will be undertaken to
maintain the work in strict conformance with all permit conditions pursuant to Nationwide Permit
No. 39, as well as all other state and local requirements.
Farrington Farms Development Corp., is willing to set aside the 1.922 acres of land located in the
South-west comer of the property for mitigation purposes to offset the wetland impacts for the
proposed project.
By copy of this correspondence and completed pre-discharge notification procedure, I am
requesting Department of the Army concurrence with this Nationwide Permit No. 39 application.

This correspondence is in reference to a 2 acre out parcel of land, which is part of the
Farrington Farms Section Four Subdivision, located off of Gordon Road, Wilmington,
New Hanover County, North Carolina. -
Our firm was hired to conduct an environmental assessment of the 2-acre parcel for
reasons of mitigation. Vegetative, soil, and hydrologic data were taken at two random
locations on site.
The first plot was taken in a forested area to the south of the sewer line easement in the
wetland area. This area can be characterized as Forested Wetland (U.S.F.W.S.
Classification: Palustrine, Forested Wetland, Broad-leaved Deciduous, Intermittently
Flooded, Fresh). The overstory vegetation consists of Tulip Poplar (Liriodendron
tulipifera), Red Bay (Persea borbonia), Sweet Gum (Liquidambar styraciflua), Sweet Bay
Magnolia (Magnolia virginiana), and Swamp Gum(Nyssa,aquatica). The understory
vegetation consists of young Red Maple(Acer rubrum), Giant Cane(Arundinaria
gigantea), Honeysuckle Vine(Lonicerajaponica), Fennel(Eupatorium capillifolium),
Cinnamon Fern(Osmunda cin?amomea), Royal Fern(Osmunda regalis), Privet(Ligustrum

The New Hanover County `Soil Survey shows the area to be mapped as Murville fine
sand. A soil profile was taken where the vegetation was recorded.
Soil Profile
0-18+ 10YR 2/1 Muck with little to no sand.
Free water was observed in and unlined borehole at 12 inches. Saturated soils were
reached at 11 inches.
The second plot was taken along the sewer line that runs diagonally through the
northern corner and down the western edge. The vegetation is limited to disturbance
species like Dog Fennel(Eupatorium capillifolium), Black Willow(Salix nigra), and
