Staff of the North Carolina Division of Water Quality, Surface Water Protection Section, Raleigh
Regional Office, conducted a stormwater compliance evaluation inspection of Durham Scap Metal,
1035 Harvest Street, Durham, on June 5, 2013. Your assistance was very helpful and appreciated
during the inspection process.
The following observations were made during the stormwater inspection:
1. Durham Scrap Metal is a facility that engages in receiving, sorting, breaking and wholesale
trade of scrap metal. This facility operates on a 6.1 acre site.
2. The Stormwater Pollution Prevention Plan (SPPP) for this facility contained all
components required by NCG200000 with the exception of Part 11, Section A, item 7 Plan
Admendment in reference to plan review, update and significant spills occurring during the
past three years.
The facility has two outfalls. Outfall No. I receives stormwater Plow from the north, office
building, scales and Harvest street side of the warehouse of the facility site. Outfall No. 2
receives stormwater flow from the north and warehouse side of the facility. Stormwater
from the other areas of the site flow as sheet flow into the wooded areas on the southwest
and northwest side of the site. Both outfalls were accessible for sampling at the time of the
inspection.

1. Requirements:
1. Your Stormwater Pollution Prevention Plan must address Section A. item 7. Plan
Admendment. The Stormwater Pollution Prevention Plan shall be reviewed and updated
on an annual basis. The annual update shall include an updated list of significant spills or
leaks of pollutants for the previous three years or the notation that no spills have occurred
for the previous years of the annual review of your Stormwater Pollution Prevention Plan.
2. It is recommended that 55 gallon drums holding liquid or oils be placed on spill pallets
(See attached picture).
3. Documentation in your Stormwater Pollution Prevention Plan shows that analytical and
qualitative monitoring is not up to date. You must begin to monitor your Stormwater from
your site as required by Section B, Analytical Monitoring Requirements, Table 1 and
Section C, Qualitative Monitoring Requirements Table 4. It is a requirement of the permit
to complete Analytical and Qualitative sampling and monitoring in accordance with the
schedule specified in Table 2. Copy of NCG200000 attached.
Please address items 1 (1,3,) in a written response within 30 days of receipt of this letter. Please continue to
implement your Stormwater Pollution Prevention Plan. Thanks again for your cooperation during the

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Due to resource constraints,
the Division has been unable to adequately consider appropriate modifications to the permit. Therefore, the permit
has been reissued without changes from the previous permit, so all conditions remain the same. The permit term for
the reissued permit is two years, expiring on September 30, 2008. The general permit may be modified and reissued
prior to its expiration. The permit is reissued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental
Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require

In accordance with your application for discharge, the Division is forwarding herewith the subject Certificate of
Coverage to discharge under the subject state-NPDES general permit. This permit is issued pursuant to the requirements
of North Carolina General Statue 143-215 .1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this general permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit application.
Unless such demand is made, the certificate of coverage shall be final and binding.
This Permit Certificate of Coverage replaces your current NCG030206 which is hereby rescinded.

Durham Scrap Metal
Spill Containment for Used Batteries
This facility stores and accumulates used batteries at two locations:
1) Battery Area #1 is located at the central receiving shed and scales; this is a temporary storage
location. Used batteries are off-loaded by sellers onto a wooden pallet. This pallet is
typically sited under a shed roof and protected from rainfall. When one or two pallets are full
(approximately 48 batteries), the batteries are shrink-wrapped onto the wooden pallet and
moved over to the long-term battery storage area (Battery Area #2).
In order to minimize the risk of leaks and drips from batteries, a spill containment pallet (see
Figure C-1) will be provided to receive and hold the used batteries from sellers. The wooden
pallet can be placed on top of the spill containment pallet. As before, the full wooden pallet
will then be moved to the long-term battery storage area.
2) Battery Area #2 is located near the southwest corner of the warehouse (Building 1) in an
exposed location. Batteries are stored here until a sufficient load is accumulated and
transported to an off -site used battery reclamation company.
In order to minimize the risk of leaks and drips from batteries, there are two options for this
storage location: (a) construct a shallow pit; line with gravel and plastic; and construct a shed
roof. Place the full pallets in the pit and under the shed roof; or (b) provide spill containment
pallets as shown in Figure C-1 and cover with waterproof tarps.

In regards to your site visit of June 5 2013 and letter dated June 17 2013 we offer the following:
1. Mr. Jimmie Lamm, the owner, contacted us on June 17.
2. We visited his site on June 20, and he authorized us to proceed with updating his SWPPP and conducting the
outfall monitoring.
3. On June 20, we were not made aware of your June 17 letter and remained unaware until August 7.
4. Between July 1 and July 31, we updated the SWPPP and maps.
5. On August 13, we met with Mr. Lamm to discuss his SWPPP review comments and finalize the SWPPP map.
During this site visit, we were provided with your June 17 letter.
6. On August 14, we completed the SWPPP which now addresses your concerns noted in your June 17 letter. The
final SWPPP will be mailed to Mr. Lamm on August 15.
7. As of August 14, we have not been able to collect or monitor the stormwater discharges at the subject facility.
is our intent to monitor the outfalls asap and again after 60 days from the first sample collection event.
We realize this response is beyond the 30 days specified in your June 17 letter.
