Per our discussions in this meeting, it is our understanding that: 1. NCDENR accepts our position that there are only TWO industrial outfalls subject to monitoring. Crosswinds Marina has collected samples at these two outfalls in accordance with the 2009-2014 General Permit. 2. NCDENR is not requiring the submittal of a "Representative Outfall Status" form unless the Permittee decides to eliminate one of these two outfalls from analytical monitoring. 3. The SWPPP contains all the elements, including site maps, required by the current General Permit. 4. The Permittee will provide training to all employees before the end of May 2011. 5. NCDENR is reluctant to grant the marina "Conditional Exemption — No Exposure" since Boat Works is a sub- tenant on the marina's leased parcel. 6. The Permittee has satisfied all of your other concerns stated in Danny Smith's letter dated October 11 2010. 7. NCDENR accepts our findings and commitments indicated in Stormwater Services Group's letter dated March 8 2011. 8. At this time, the Permittee is not in a state of "Permit Violation." Thank you for the help you and your consultant Mr. Jim Frei provided. Near the end of the discussion, Boatworks owner Steve Heberly also joined us. These changes were noted: • The Stormwater Pollution Prevention Plan was complete, containing all the required elements. • An annual inspection was being carried out that day by Mr. Frei. • Employee training is planned in the near future. Personnel are frequently admonished to maintain BMPs such as housekeeping that protect stormwater quality. • Sampling was completed within the last week or so; results are awaited. Only outfalls 001 and 002 are required to be monitored, reflecting the areas of industrial activity. • The idea of a No Exposure exemption from this stormwater permit cannot be offered. There are potential pollutants exposed to rainwater by the marina functions. • Conditions at the Boatworks facility have been improved significantly to avoid contamination. Awareness of BMPs on the part of Mr. Heberly appears to be heightened. His area of responsibility presents the greatest potential impact to stormwater. Both the USGS quad sheet and the Site Map were provided to the Permittee as part of the SWPPP. We are not sure why these maps were not seen during your inspection. We will ensure that the required maps are inserted into the SWPPP notebook. 2. The Permittee did not contract with a consultant to perform the sample collection during the Year 1 — Period 1. The Permittee will make the necessary arrangements to ensure samples are collected during each period of the Permit term. 3. Samples were collected on June 13 2010 and December 01 2010; the DMRs were mailed to Central Files. The Permittee will make the necessary arrangements to ensure samples are collected during each period of the Permit term. 4. This Permittee is committed to reducing hull cleaning and repair residuals to the maximum extent practical by implementing best management practices. For example, all hull sanding operations are supposed to occur over a tarp and/ or use a vacuum sander to collect particulates and dust. The Permittee has instructed all employees, boat owners, and sub -contractors (hired directly by boat owners) to implement these practices to control dust and residue. 5. This Permittee has not requested ROS because samples are collected at the only two industrial outfalls at this facility. The numerous slope drains around the perimeter of the marina basin are not considered industrial outfalls as no industrial activity occurs within their limited drainage areas. Boat storage and boat trailer parking are not industrial activities as boats and trailers are intended to be submerged partially or wholly within Letter to NCDENR/ DWQ March 8, 2011 Page 2 SwSG waters of the State. This Permittee will continue to collect samples at the two industrial outfalls at least through the next two periods. 6. This Permittee conducts Qualitative Monitoring at the only two industrial outfalls at this facility. See Note 5 above for additional comments. 7. Employee training regarding Permit compliance was held on January 22 2008. The Permittee has not contracted with a consultant to provide training nor has training been provided in-house since January 2008. The next training workshop will be held in March 2011; documentation will be inserted into the SWPPP notebook at Appendix F. 8. This Permittee is committed to completing the SWPPP checklists — specifically Table 4, Forms 6 & 7, and the Compliance Task Schedule (Year 2) by April 30 2011. This Permittee will also review the previous site inspection checklists and complete the recommended action items. 9. This Permittee will meet with Steve Heberly, the owner/ operator of Boatworks within two weeks to discuss the BMPs that must be implemented. It is Mr. Heberly's responsibility to keep his leased parcel clean and in compliance with all applicable environmental regulations. The operator of Crosswinds Marina may apply for the Conditional Exemption — No Exposure Certifcation after June 30 2011. The activities at Boatworks, which is on a parcel leased from Crosswinds Marina, are the only exposed industrial activities that require this marina to obtain coverage under General Permit NCG190000. If Crosswinds Marina is granted No Exposure, then Crosswinds Marina expects NCDWQ to require Boatworks to obtain coverage under General Permit NCG190000. We will modify our Qualitative Monitoring form (Checklist #6) to reflect the new rating scale for observed water quality parameters. The Permittee will insert the COC letter and General Permit NCG190000 into the SWPPP at Appendix E. As a means to reduce the Copper and Zinc concentrations in stormwater discharges, these additional BMPs will be implemented this year. BMP No. Action Target Date 11-1 A filter fabric will be laid on top of the concrete pad at the designated 04/25/11 boat wash area. After washing and once the fabric is dry, the residue will be swept off the tarp, bagged, and disposed in a lined landfill. 11-2 Ensure that tarps or filter fabrics are placed under all boats during hull 05/15/11 sanding and hull repair operations. 11-3 Ensure that ground tarps and side curtains are in place when painting 05/15/11 boats outside. Sullins Director October 11, 2010 Subject: Stormwater Compliance Inspection Crosswinds Marina on Jordan Lake Permit No. NCG190071 Chatham County Dear Mr. Urquhart: Dee Freeman Secretary On September 30, 2010 an inspection of the stormwater program at Crosswinds was made by Tom Ascenzo and Myrl Nisely of the Raleigh Regional Office. Mr. Martin Stephani was helpful in providing the Stormwater Pollution Prevention Plan (SP3). Some, but not all, of the requirements of the permit have been implemented. Please see the inspection checklist attached to this letter. The SP3 was comprehensive, with excellent detail for all requirements. Forms had been created to help those responsible carry out the activities. However, much of the permit has not yet been implemented. The following details should be noted: Two maps for the SP3 were not available. See that these are added and kept with the rest of the manual. 2. The permit was issued 10/1/2009, calling for Quantitative and Qualitative sampling by the end of March 2010. No sampling was done during that period. 3. Sampling was carried out 6/13/2010, satisfying the Year 1/Period 2 of the schedule in Table 2 of the permit. The remainder of the sampling is to be accomplished per that table. 4. Analytical results for Outfall No. 002 showed TSS = 136 (benchmark 100), Copper = 0.353 mg/I (benchmark 0.007) and Zinc = 0.184 mg/I (benchmark 0.067) See Item 9 for further discussion. 5. Until and unless Representative Outfall Status is granted by DWQ, all outfalls must be sampled for the Quantitative list parameters. Representative outfall status requires written DWQ approval, and is initiated by a request in writing from you. Write a letter to the address in the footer of this letter requesting representative status for the numerous points of discharge into the lake. Again, without this approval, all outfalls must be sampled. 6. Qualitative inspection of ALL outfalls twice a year will be required, even when ROS is in effect. 7. Annual employee training should be accomplished as soon as possible, and no later than March 31, 2011. The major threat to stormwater quality comes from the poor housekeeping around the Maintenance yard. Outfall No. 002 showed several test results above the benchmark values, almost certainly related to practices at the Boatworks. The permit provides three more sampling sessions during which the values can be lowered and brought into compliance, after which Tier 1 requirements will begin. Read the permit carefully to understand what Tier 1 involves. Consultant Frei has several recommendations in checklists # 1 through 5 that should be implemented. The Division of Water Quality had revised the reporting form for Qualitative monitoring to make the evaluations from 1 to 5 rather than from 1 to 10. A copy is enclosed. The stormwater flowing to the lake was clear, and the lake was free of any oil sheen. A well -written SP3 manual was available. It contained several checklists of items known to need attention, as pointed out by the consultant. These are to be followed and the activities completed as soon as possible, and no later than the end of 2011. Of greatest signficance are the housekeeping improvements needed at the Boatworks maintenance building, and annual employee training. The training should lead to knowledgeable qualitative inspections and ability to respond to spills. RRO will reinspect in April 2011 to observe compliance with the above expectations. Several parameters failed to meet benchmark values for Outfall 2, the one serving the Maintenance facility. Also, there is an added requirement for a Solvent Management Plan. Please be sure that your plan is updated to comply with the new requirements. • Part II Section B - Revised provisions require that stormwater discharges be sampled twice per year, and that the sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been eliminated.) • Part II Section B — Monitoring for some metals has been added to the analytical monitoring requirements. • Part II Section B— Beginning with monitoring in Year 3-Period 1, revised provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part 11 Section B — Beginning with monitoring in Year 3-Period 1, this part contains a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. Your help was appreciated as it eased the inspection process. The purpose of the evaluation was to see if Crosswinds Marina would require a stormwater permit (general permit NCG190000). A thorough inspection of the manna was conducted, and it was determined that the primary source of potential contamination originated from a maintenance shop situated uphill of the lake. The maintenance shop, Boatworks, is sub -leased to another individual, but as the primary lease holder you are still delegated responsibility for the lot of land. The majority of the maintenance shop drains to wooded areas where contaminants would likely be filtered before they could reach surface water. Only a small portion of the maintenance lot actually drains to a roadside ditch that can potentially reach the lake. Currently, boats awaiting service are stored in this area, and because such boats have the potential to leak fluids, a stormwater permit is required. During the inspection, several options were discussed. It was decided that you could either: • Apply for the stormwater permit. To apply for a stormwater permit you must fill out a Notice of Intent (NOI) and submit it to the state for approval. All help was appreciated as it eased the inspection process. The purpose of the evaluation was to see if Crosswinds Marina was abiding by the guidelines provided under general permit NCG190000. A maintained stormwater program is essential for protecting the integrity of surface waters. Currently, Crosswinds does not have a stormwater permit and was told by the Army Corp of Engineers that one would not be required. The Division of Water Quality, however, requires all marinas, which have on -site maintenance, to obtain and abide by a stormwater permit. Crosswinds Marina has a maintenance facility that has the potential to contaminate Jordan Lake, a state drinking water supply. Mr. Parker stated that the property used for vehicle maintenance is actually leased to another business. As property owner, however, you are held responsible for any contaminated stormwater discharges leaving that property. The Crosswinds Marina has 10-12 outfalls all of which discharge directly to the lake. The stormwater primarily consists of parking lot runoff, but has the potential to receive water from its maintenance shop that lies uphill of the marina. To apply for a stormwater permit you must fill out a Notice of Intent (NOI) and submit it to the state for approval. Even though Crosswinds Marina does not have a stormwater permit, most components of the Stormwater Pollution Prevention Plan were present including: detailed site maps with clearly labeled storm drains, a list of potential contaminants, a spill and response plan, and emergency response. Spill and mitigation training sessions are required for all employees and new hires. Because the facility has a bulk storage container for gasoline the plan also includes a Spill Prevention Counter Control (SPCC) plan. This SPCC plan must be filed with the EPA. The only major addition to what already exists is to incorporate quantitative monitoring of the outfalls to ensure that the water quality is within ambient concentrations.
