On May 9, 2011 at the request of your stormwater sampler Richard Johnson, I met with the two of you
to discuss difficulties he has encountered sampling some of the marina outfalls. The discharge ends of
stormwater conveyance pipes are typically under water in the lake during normal precipitation years. In
flood times, the water elevation can be high enough to force water backwards through the pipes, creating
a lake on the inlet end of all three pipes.
This visit determined that one of the three pipes perpetually has a wetland on the inlet end, so cannot be
considered to be a valid stormwater conveyance. The other two can serve as transports if the lake is at
what the Army Corps of Engineers considers its target level of 252.6 feet mean sea level in the summer.
(251.6 in winter). Therefore, samples must be captured at the inlets of these two pipes rather than the
outlet locations. It is the understanding of the Raleigh Regional Office (RRO) that this has been your
practice. The RRO understands that there may be times when the lake level simply precludes any
sampling if a rainy season dictates that the lake level is high enough to back lake water to the inlet
elevation for days or weeks at a time.
On two Of testing has recently shown Aluminum, Copper and Zinc and Total Suspended Solids
(TSS) above their benchmarks. You may find that these levels correspond to high TSS. An approach
that may help attenuate metal concentrations is the maintenance of a thick vegetated cover in the
conveyances to prevent soil erosion.

Inspection Summary:
Rollingview Marina has encountered two benchmark exceedances for metals in the past year, so is in Tier 1.
They contacted RRO for advice about how to sample a unique outfall situation wherein three culvert pipes installed about
1983 by the ACOE, each laid at the foot of a hill and running under a dirt/crushed stone driveway, discharge into Falls
Lake. They are under water in the lake most of the time unless drought causes a lower lake level.
Observations with the ORC showed that the middle of these three pipes essentially has a wetlands on the inlet side, so
cannot be considered to be a stormwater conveyance. The others can be sampled at the upstream end of the pipes if the
lake is at its target elevation, and is not so high as to back the water up in the pipe to the inlet. In other words, sampling
during rains depends a great deal on the lake elevation when the rain begins.
Further investigation into sources of the metals will need to be undertaken if exceedences cannot be attenuated by
increasing the vegitation in the ditches or some other BMP.

Dear Mr. Gooch:
On July 6, 2010 Myrl Nisely and Tom Ascenzo from the Raleigh Regional Office of the Division of
Water Quality conducted a site inspection of Rollingview Marina located at Falls Lake, Durham County.
Part of the site drains to the mouth of Lick Creek, and the rest to Falls Lake, Class WS-III; NSW waters
located in the Neuse River Basin,. The assistance provided by you, your son Marcus and Amy Poole was
greatly appreciated. Your facility was in compliance. The inspection checklist we used is attached.
The following observations are highlighted:
1. The Stormwater Pollution Prevention Plan was readily available and contained all the required
elements. The plan is to be reviewed annually, so adding a review date when this takes place
will be helpful for future inspections.
2. Another annual event is employee training. The latest record of this was in 2007. Conversations
revealed that all three of you clearly have a good. grasp of the stormwater program, but be sure to
provide training sometime this year and document it with an attendance sheet, the name of the
instructor and what topics are covered. Insert the sheet into the book for the next inspection.
3. Stormwater travels rapidly down the gravel roads serving the main building and the launching
ramp. Steps have been taken to install check dams to reduce the energy of the Flows, along with
cutouts every few dozen feet to direct water to the woods as sheet flow. These require frequent
maintenance because of the accumulation of silt and the new channels water can cut into the
sandy soil. You stated plans to add silt fencing at the end of the cutouts, and you agreed to
replace a barrier at the bottom of the launch road to capture eroded soil. These outfalls, three of
the six, are a challenge to manage to effectively keep sediment from reaching the lake.
4. Power washing has been moved to a maintenance building away from the water's edge, as
requested by DWQ. The resulting water is handled as wastewater.

5. Analytical, testing'is required twice per year in the new permit, with several new parameters
added, and qualitative evaluations of all outfalls are also needed semi-annually. A second round
is needed for 2010.

This letter is in response to the Notice of Violation dated October 24, 2007. I would like
to begin by saying we are a small family owned and operated business with limited
resources. As we make our living off and from Falls Lake, we would certainly not
intentionally pollute or cause damage to the water quality.
My sister is a member of the Neuse River Foundation and has served on two committees
to clean up Little Lick and Lick Creeks. The latter being the project that she is currently
involved with.
We are inspected monthly by State Parks, annually by Corps of Engineers, DWQ -
stormwater and waste water as well as other regulatory agencies. We have undergone
major'administration as well as personal changes in the last thirty months. This is not an
excuse for non-compliance however; I hope it may explain my lack of understanding the
requirement of the stormwater permit.
After the October 19`h inspection by Mr. Myrl Nisely and Mr. Daryl Norris, I had several
phone conversations with both. I have also had an on site meeting with Mr. Norris and
our own ORC for Wastewater to discuss in detail all requirements of the stormwater
permit.
To date, we have completed the majority of assembly of information for the Stormwater
Pollution Prevention Plan. I have contacted a private firm for possible help in compiling
the TTO list and solvent management plan. As of November 11, 2007, we have not heard
back from them but hope to soon. We have completed the analytical monitoring by Tri-
test as well as Qualitative monitoring by our own ORC, Richard Johnson. We hope to
have the remainder of our SPPP complete by year's end. I hope this will be expeditious
enough for your office. We also have an engineered design of our own for boat wash
water recovery system and plan to relocate our washing activity to our maintenance
facility. All of our marina vehicles and equipment are maintained off site.

I will be working very closely with Mr. Norris on the construction and implementation of
our wash water recovery system. I will also be attending a demonstration at Town Creek
Marina on November 13, 2007, of a portable wash mat recovery system.

NCG 190046. Please respond in writing to this notice within 20 days of receipt. You should clearly explain
and provide a schedule with dates that details your -efforts to come in to full compliance with your permit

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation
of the site and operations to reduce pollutant sources and prevent pollutant discharge.

forms, and a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater
Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said, please see
the above mentioned web site in order to obtain a copy of the permit such that you may fully comply with all
the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below,
constitutes violations and are subject civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the
General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or
mine dewatering pursuant to the type of General Permit until the permit expires or is modified or
revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-
stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring

o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on -site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of least 5 years for the date of the sample measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water Act.
The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
Name/ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase 1 focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation
of the site and operations to reduce pollutant sources and prevent pollutant discharge.

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said, please see
the above mentioned web site in order to obtain a copy of the permit such that you may fully comply with all
the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below,
constitutes violations and are subject civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the
General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or
mine dewatering pursuant to the type of General Permit until the permit expires or is modified or
revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-
stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
• 'Roll injview Marina

o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on -site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of least 5 years for the date of the sample measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water Act.
The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

On December 8, 2005 Mr. Christopher Wu of the Raleigh Regional Office conducted a
stormwater evaluation inspection of the Rollingview Marina on Falls Lake with Mr. Andy Gooch
and yourself, owners of the facility. All help was appreciated as it eased the inspection process.
The purpose of the evaluation was to see if Rollingview Marina was abiding by the guidelines
provided under general permits NCG190046. A maintained stormwater program is essential for
protecting the integrity of surface waters. Rollingview Marina has a maintenance facility on -site
that has the potential to contaminate Falls Lake, a state drinking water supply. The Rollingview
Manna has 3 outfalls all of which discharge directly to the lake. The stormwater primarily
consists of parking lot runoff, but has the potential to receive water from the maintenance shop
that lies uphill of the marina.
When reviewing the paperwork for the facility, it was discovered that there was no available
copy of the permit on -site. While the inspector left a general permit, the original copy details the
number of outfalls and the specifics required of them. If the original is not found another copy
should be obtained through the Division.
During a later file review for the facility it was discovered that the Rollingview Marina
stormwater permit expired in 2004. While permit fees were paid for 2005, the permit, itself, was
not renewed and this should be completed immediately.
In addition, no analytical or qualitative monitoring was conducted as required by the permit. It is
important to monitor the conditions of your stormwater to ensure that Falls Lake is adequately
protected from contamination. You should contact a contract laboratory to conduct the analytical
analyses according to the permit. Your current spray operator, Mr. Richard Johnson, is capable
of conducting the sampling. Also, qualitative monitoring is required to be conducted twice per
year (once in the spring and fall). All data are to be documented on Division forms (available
on-line) and submitted to Central Files.
