A copy of the Compliance Inspection Report is enclosed for your review. Mrs. Tracey Wilson and Mr. Mike Smith were also present during the inspection and their time and assistance is greatly appreciated. Stormwater from this facility drains to Panther Creek, a Class C;Sw water located in the Cape River Basin. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Perm it-NCG160000. Site closure (NFA) is conditional upon proper public notice and any required Notice of Residual Petroleum. 2.8.1) Continuing Obligations for the Responsible Party Pursuant to 15A NCAC 2L .0407 the responsible party must notify the Department of any changes in site conditions that might affect the level of risk assigned to a release after receipt of a no further action determination. Such changes may include but, are not limited to, changes in zoning of the property, changes in use of the property (e.g., conversion of a service station or convenience store to a residence/school/recreation area/daycare center, etc.)'or changes in the use of the affected, or potentially affected groundwater (e.g., installation of an irrigation well within 250 feet of the source area of the release). The enabling statute (Senate Bill 1012) for the risk -based rule (15A NCAC 2L .0115 recodified asl5A NCAC 2L .0400) allows the Department to reopen an incident if the Department later determines that a release poses an unacceptable or potentially unacceptable risk to human health or the environment. This report must include a map of the contaminant plume with the location of all monitoring wells identified, the frequency of monitoring, a table of the constituents exceeding the groundwater quality standards, and interim standards including the analytical results and any actions taken to mitigate threats to human health. This summary report must be submitted by certified mail to the parties above no later than five working days after the CSA report is submitted to the Department. 2.9.B. Cory From: Lawyer, Mike Sent: Monday, May 18, 2009 1:46 PM To: Larsen, Cory Cc: White, Hughie Subject: RE: Barnhill Asphalt Plant Cory, I just spoke with Mr. David Glover, who signed the NOI, and he mentioned the following items, which may affect our review: -DOT has apparently moved the county line, so the facility property is now mainly, if not completely, in Duplin County (Wilmington office jurisdiction) -LQ in the Wilmington Regional Office reviewed and approved the erosion control plan -AQ in our office (FRO) is currently reviewing their application for an air permit -also, he said operation is scheduled to begin in June 2009, not November 2008 as indicated in the N01' So ... do you think the Fayetteville office should review and comment or the Wilmington office? My opinion is that since LQ in the WiRO approved the erosion control plan and WQ in the WiRO will do inspections for compliance with the NCG010000, then they should also have the industrial permit in their files as well. I'm good either way, just need to know so that I can contact Mr. Glover back to set up site visit or let him know that it will be forwarded to WiRO for follow-up. Looks like.a new facility NCG16 application however it says the beginning operation date is Nov. 2008? Was this facility operating w/o a permit and that is why they have applied for coverage?
