On June 10, 2008, the Division of Water Quality received you request to rescind your coverage under
stormwater discharge Certificate of Coverage Number NCG 160179. In accordance with your request,
NPDES General Permit NCG 160179 is rescinded, effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under. an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Bill,
No major concerns. I've been to this facility a few times and met with their quality
control person. The site had one distinct outfall consisting of a single catch basin
leading to a ditch at the edge of their property. They wanted to eliminate this
ditch thereby eliminating the need for permit coverage. I actually stopped by this
facility last week and confirmed that they have filled in the ditch, plugged the
catch basin pipe and replaced the grate with a manhole cover. It would appear that
the facility can now achieve sheet flow from all areas of the plant and I recommend
proceeding with processing their rescission request.

I understand that with all the work focusing on the general permit renewals that
Sarah Young indicated
she has quite a few rescission requests that came in with renewal forms and she
has not gotten to them.

receive a response to a letter dated September 4, 2007 to rescind our water quality permit
COC # NCO160179. After calling Michael Lawyer in the Fayetteville office I was
informed that no record of any such request was received by your office. Enclosed you
will find a copy of the original letter which requested that you rescind our permit for the
same reasons as before.

Johnson Brothers Utility & Paving Company, Inc. wishes to rescind the above referenced
pennit. On August 28, 2007 we removed the point source for water runoff from our
property. This source consisted of an open surface drain connected to a ditch. The drain
was originally installed to service an oil water separator outside our vehicle maintenance
shop. However, since all of our maintenance is conducted inside and the fluids collected
by an outside vendor (Noble), the oil water separator has not been used for several years.
Because the chain is several inches lower than the surrounding pavement it created an
obstacle for the daily truck traffic at our facility. Therefore the decision was made to
remove the surface drain and the ditch and let runoff Yvater sheet flow across our facility.
I have been in close contact with Michael Lawyer in the Fayetteville office concerting
our decision to remove our point source for runoff. He has been made aware of the date
the work was completed and has been asked to inspect the site to insure everything is
satisfactory.

Got a call today from Carson Harrington with the subject facility. He said he
submitted a letter last year (September I think) to your attention requesting permit
rescission, but has not received any notification. I looked in BIMS and there is no
event concerning a rescission request. Did you ever get such a letter and if so,
what's the status?

In accordance with your application for a discharge permit received on May 1, 2006, we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit.does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.

The discharge point is a storm drain which has a pipe leading into a wooded
area. The receiving waters (if any discharge made it to one) would be a UT to
the Cape Fear River. Although they checked 'No' regarding BMPS, they actually
have secondary containment around their fuel tanks and an oil/water separator for
their vehicle maintenance area. Also, don't know if it matters but Mr. J. Carson
Harrington is not the owner of the company. If you need the owner's name and
information, please let me know and I'll get it for you. Otherwise I recommend
issuance of their Certificate of Coverage. As always, if you need any further
information, please don't hesitate to contact me.

It seems we didn't get the copy of the NOI. Could you resend? I'll go ahead
and tell you that a staff member from Aquifer Protection and myself have
already been to this site in response to a complaint. We discovered then
that they did not have stormwater permit coverage. I spoke to them about the
permit requirements and left them an application. Fairly simple site with
only one point of discharge, but I would still like to have a copy of their
completed application for our files and to review before giving the go-ahead
with permit issuance. .
