John E. Skvada, III Secretary June 27, 2014 Subject: Rescission of NPDES Stormwater Permit Certificate of Coverage Number NCG I60046ENR Raleigh.Regional Office The Lane Construction Corporation Granville County On March 27, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind your coverage under Certificate of Coverage Number NCG 160044. In accordance with your request, Certificate of Coverage Number NCG160044 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. If something changes and your facility would again require stormwater or wastewater discharge permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the proper permit coverage. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. If you have questions about this matter, please contact us at 919-707-9200, or the Stormwater staff in our Raleigh Regional Office 919-791-4200. Sincerely, ORIGINAL SIGNED B) KEN PICKLE for Tracy E. In your letter you suggested making Outfall #1 representative, but after further discussion with you and with Plant Manager Richard Hanson, we all agree that Outfall #2, located more nearly in the center of the site, will provide the best assessment of water quality in rainwater runoff. Please note, however, that semi-annual Qualitative Monitoring is to be done at all three outfalls. These observations are to be inserted into the stormwater manual. Sullins, Director Division of Water Quality August 15, 2008 Subject: Stormwater Compliance Evaluation Inspection Rea Contracting LLC --Butner Asphalt Plant Permit No. NCG 160044 Granville County On August 12, 2008 Mr. Myrl Nisely of the Raleigh Regional Office of Division of Water Quality made an inspection of the Butner asphalt facility for stonnwater permit compliance. It was a pleasure meeting Richard Hanson and James Backus. Their help facilitated the visit and was greatly appreciated. The plant was in compliance. Please see the attached inspection checklist. These observations are offered: A well -written Stormwater Pollution Prevention Plan (SP3) had been updated in June. All of the required components were accounted for, although written documentation of employee training was absent. Training is provided in Charlotte, so records are kept there. Please add documentation of attendance by the Butner personnel to this SP3. 2. Likewise, when a year goes by without spills, there needs to be a notation and signature on the page for Significant Spills. The office contained a series of SP3 three-ring binders for the years from 2000 to date. The intent of the permit is to have just one large binder that can hold the materials over a five year period. All activities during a given year such as Qualitative and Quantitative monitoring results, employee training, the spill records, and so forth are to be inserted as they are generated. This will continue each year until the volume contains records for a five-year period. Each year the manual is to be reviewed and updated where changes have occurred, with the review date displayed on an early page. In this way, the SP3 becomes a living document for a moving five-year window. That way, information is centrally located, and inspectors can then made a check on activities quickly, all in one place. 4. Records at the Division of Water Quality show that Rea provided a change of ownership notice in 2003, but the data was not changed in our database. The ownership has now been changed, but there are still mixed listings of contact persorys. Per a telephone call to you on 8/14/08, you will send a letter specifying those details. We will then correct our internal information to fully separate this facility from the rest of the Sunrock site in Butner. Your help on this is appreciated. You have raised the question of whether the concrete and asphalt stormwaters can be combined and held in a ponded mode to eliminate runoff, thereby taking away the need for either permit and the required monitoring. In order for the State to evaluate this approach, please submit to this office an engineering proposal, including design calculations and drawings to show a system capable of handling a 25 year, 24 hour storm event. There would be a freeboard requirement as part of such an arrangement, unless a satisfactory plan is presented for overflowing the holding pond to another of the ponds onsite for water reuse. The proposal is to be prepared by a North Carolina professional engineer. — Please contact me if you have comments or questions. I I -D ; Sincerely, 0 Myrl A. A check with Aisha Lau showed that she had o documentation of this plan, either. DWQ has been ignored. Tony Sample had proposgover the telephone to stop the discharge that was handling commingled Concrete and Asphalt plant runoff, and then went ahead and did so. In a telephone conversation today, Tony stated that they long ago stopped that discharge, and that "the water backs up on them and percolates into the ground". He stated that he had requested his engineers to prepare information, but that it was very low on their priority list and had been forgotten. I asked when they could still document the situation to us, and he replied that the engineers had three expansion projects in the works, implying that it was not going to receive attention anytime soon. So I told him that we would make a visit before long to better understand how the stormwater was being handled. The permits are both still active. He replied that a visit would be fine, and that all that was required by the permits was to have a SP3 on site. I added that a report covering annual sampling was also required, on which he would certify no discharge. Myrl Nisely 5/9/05 Pictures on s:\pictures 2005\concrete\SunrockButner\Sunrock5_05 The exit culvert for the commingled wastewater ditches has been sealed and had fresh crushed stone over it. The large holding ditch was roughly measured using a laser viewfinder. The holding area is about 300' long with an average width of 35' and an average depth of about 7'. Tony claims a watershed of 2.5 acres. Overflow would go to the Fines pond, which needs to be cleaned out because the solids are almost up to the standpipe at this time. The standpipe goes to a retention pond outside the berm. This overflows to a ditch that goes to one of two quarry ponds/outfalls. His engineers are still busy and may not prepare this engineering analysis anytime soon. He agreed to submit at least preliminary calculations on how much water would stand in the ditch after a 25 yr/ 24 hr storm. I chastised him mildly for offering no response to our request for engineering details in September. He commented that the company was soon to open a new Concrete/Asphalt/Quarry much like this one in Person County.
