On July 9, 2008, The Division of Water Quality's Stormwater Permitting Unit received your
Notice of Intent (NOI) requesting coverage under general stormwater and wastewater permit
NCG140000 and an Authorization to Construct (ATC) wastewater treatment systems. We also received
additional information on September 9, 2008. We are returning the NOI application package as per your
request by telephone on October 16, 2008.
During review, the Stormwater Permitting Unit (SPU) verified that this project will require a
Post -Construction stormwater permit from the DWQ Central Office. This is a permit for stormwater
control of impervious area required under the State Stormwater Permitting Program, separate from the
NPDES program. A Post -Construction permit is necessary because this development project will
disturb more than an acre of land and is in a "Phase II tipped county" based on Session Law 2006-246.
Because the site is located where a local government does not already implement a satisfying program,
the DWQ Central Office must review design plans and issue a Post -Construction permit. Please find

Because a change of ownership has meant plans about the final property configuration remain
undetermined, which will in turn affect stormwater Best Management Practice (BMP) design, the NOI
application package is being returned to you with this letter so that NPDES permitting can be better
coordinated with the Post -Construction Stormwater permit process at a later date. The return of this
application does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other federal or local governmental permit or approval that may, be required.

Dear Mr. Houser:
On April 10, 2008, The Division of Water Quality's Stormwater Permitting Unit received your
Notice of Intent (NOI) requesting coverage under general stormwater and wastewater permit
NCG140000. After preliminary review, the Stormwater Permitting Unit (SPU) has determined the
submitted materials are insufficient for us to continue processing this application. The deficiencies are
explained below to help you resubmit a complete application or modify your permitting strategy.
The NOI form noted considerable distance (1900') from receiving streams and indicated
overflow from a retention pond would occur in only "an unprecedented storm event." However, the
application did not include any design information to substantiate this claim; did not demonstrate how
large the retention pond will be; did not provide calculations to show how much runoff the pond would
hold once the site was built (corresponding to what size storm event?); and did not provide an
engineering -based argument and water balance showing that the water in the retention pond would not
accumulate over time and ultimately discharge. In addition, the site plan did not show any retention
pond on site. The application also did not answer the question about whether there would be mixing
drum cleaning wastewater at this site (Question 14).
Even if no stormwater or wastewater discharges will leave the site, you are proposing to
operate a wastewater treatment system at this facility (i.e., the retention pond "holding" the
wastewater), and therefore a permit is still required. North Carolina General Statute §143.215.1(a)(2)
stipulates that a permit is required to construct or operate any treatment works. At a minimum, an
authorization to construct (ATC) and operate a wastewater system is required. The system proposed
here also does not appear to meet criteria to be permitted by rule under the Non -Discharge rules found in
15A NCAC 2T .0100 (The 2T rules govern "Waste Not Discharged to Surface Waters" and can be
found here: http://h2o.enr.state.nc.us/lau/regulations.html).

This facility has the following permitting options: (1) re -submit the NOI application for
coverage under NCG 140000 along with wastewater treatment design specifications and calculations,
sealed and dated by a P.E., that demonstrate compliance with effluent limits should wastewater
discharges occur, (2) apply for a separate Non -Discharge permit from the Aquifer Protection Section
(APS) to operate a non -discharge wastewater treatment system, or (3) apply for NCG140000 to cover
stormwater discharges only (if applicable) and apply to the APS to permit a non -discharging wastewater
treatment system. Information about the Non -Discharge application and permitting process is available
on-line from the Land Application Unit in the APS: http://h2o.enr.state.nc.us/lau/main.html
A complete NCG140000 NOI application must include three (3) sets of design plans and
specifications and provide supporting calculations that predict compliance with effluent limits. The
information should thoroughly demonstrate how potential discharges will comply with pH, Total
Suspended Solids (TSS), and settleable solids (SS) limits. If you choose to present a compliance
argument on the premise that the pond would only overflow in rare, very large storm events and that
most water will infiltrate into the ground, the application must include calculations that specify how
large a storm event would cause overflow (including all assumptions about water inputs during
operation), how the treatment system will be designed to ensure groundwater standards are protected,
and soils information to support any assumptions about infiltration. An NPDES discharge permit would
cover stormwater and/or wastewater discharges should they ever occur.
The NOI application is being returned to you with this letter. The return of this application does
not affect the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any
other federal or local governmental permit or approval that may be required. If you re -submit the
application, please send it to the attention of The Stormwater Permitting Unit, as any of the SPU staff
may be assigned to do the review.
