Dear Mr. Oakes:

It is the understanding of the Division that the subject permitted facility is
no longer in operation and will _
not re -open. In accordance with this information, NPDES General Permit NCG140322 is rescinded,
effectively immediately.
Please be advised that this permit rescission is based wholly upon the activities which would require
general permit coverage at the site have ceased or been eliminated. Division staff has not visited the site
to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging
stormwater to waters of the State without a valid NPDES Permit will subject the responsible party to a
civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have
voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in
retrospect, you feel the site still requires permit coverage, you should notify this office immediately.
Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first
apply for and receive a new NPDES Permit.

This visit was made to gather information on the site for a staff report and in order to
provide guidance to Mr. Bob Fife, Environmental Manager, on setting up a stormwater
program for this site. Mr. Fife was unable to stay for more than a brief tour before
handing off the interview to Mr. Chris Black, Plant Manager. Mr. Black is a new hire,
just learning about the plant, but was receptive to my guidance and eager to protect the
environment.
This location was excavated into existence about 2.5 to 3 years ago. The Office building
and loading station are at the top of the topography, so stormwater runs in many
directions from that "plateau". At the front edge of the parking area is a concrete channel
that collects water to a culvert pipe under the driveway. This runs through a swale to a
long arcing impoundment created at the perimeter of the property. Water in this holding
pond looked muddy red. At the back of the plot are two much larger impoundments into
which drumwashes and vehicle wash-ups are discharged.. These are connected to each
other, so solids settle in the first before water flows to the second. There was about 3 feet
of freeboard in all of these ponds. Both Mr. Fife and Mr. Black stated that there has
never been any discharge from any of these impoundments. A creek runs behind these
bemned holding ponds, only a few feet beyond the property line.
There is no attempt to recycle process water at this location Unused concrete is dumped
on to the ground, then later lifted and stacked on a disposal pile. A good sized pile of this
waste is soon to be hauled to a landfill
Mr. Black went through the permit section by section with me to understand how to put
together a SPPP manual and how to implement the program.

On February 15, 2002, Joe Albiston met with Brent Oaks at the Granville Ready Mix at the
intersection of I85 and State Road 15. The Ready Mix site is as described in the application. The
cement trucks were not washing out in the pit area. There was no secondary containment for
chemicals used in the cement mixture process. The pits were operating properly, and there were
two discharge points to Hachers Branch in the Tar Pamlico River Basin.

Dear Mr. Oakes:
In accordance with your application for discharge permit received on May 22, 2002, we are forwarding herewith
the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection agency dated December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess concrete or
washes excess concrete into storm sewers or waters of the state will be operating in direct violation to both the terms of
this permit and the North Carolina General Statutes. Such a discharge shall be considered an illegal discharge and may
subject the owner to enforcement actions in accordance with North Carolina General Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless such
demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1. II. Ill.
IV. V, and VI of General Permit No. NCG140000 as attached.
This certificate of coveraee shall become effective October 19. 2002.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
