REGAN Secretary LINDA CULPEPPER Interim Director v Subject: Notice of Violation -Notice of Intent to Enforce NOV-2018-SS-0010 Stream Standard Violations Durham County On January 11, 2018, Charlotte Dawn with the City of Durham Stormwater and GIS Services Division reported concerns of a discharge of wastewater from a stormwater detention pond at Thomas Concrete resulting in pH values between 9 and 11 in nearby streams. Jeremiah Dow and Thomas McKinney from the Raleigh Regional Office (RRO) of the Division of Water Resources (DWR) assisted by Charlotte Dawn with the City of Durham conducted an inspection at the above referenced site. The investigated areas were three (3) stormwater outfalls and unnamed tributaries to Third Fork Creek which is classified as Class WS-V, Nutrient Sensitive Waters (NSW) in the Jordan Lake Watershed within the Cape Fear River Basin. The following observations were noted during the site inspection (See Attachment 1 for sampling location map): The stormwater retention pond was discharging (Outfall 18468) and had a pH value of 12.32 s.u. and specific conductance of (SpC) of 3,723 microsiemens/centimeter (uS/cm). The outfall was sampled for hardness and total dissolved solids (TDS) and returned values of 780 mg/I for hardness and 1,050 mg/1 for TDS. Outfall 108260 (sampling location TFC-2. see map) had a pH value of 12.10 s.u., SpC of 1.089 mS/em, hardness of 280 mg/l. and TDS of 398 mg/I. The stormwater discharge reaches surface waters approximately 1,100 feet southwest across Hwy. 147 at Outfall 69014 (sampling location TFC-3, see map). The pH here was 9.97 s.u., SpC was 528.8 uS/cm, hardness was 140 mg/l, and TDS was 338 mg/l. Nothing Compares ,_ State of North Carolina I Environmental Quality I Water Resources I Raleigh Regional Office 1628 Mail service Center I Raleigh, North Carolina 27699-162S 919 0 "''b^Risg0r x.3` t" ,P s ,Y ^'Sz.« h v +�uo','x.r+, *`t ^t il<` 'sc i"e� WWI R ,R a, R3v i„,ar:;i`,. t*'em, 7""f�g,:'.'.'W..,=�.;_.°n4 Anti tt`r �.'rvl .qa :� xf .".-w..,as�'*�.:.,i'. • The furthest downstream sampling location (TFC-4) returned a pH value of 8.96 s.u., SpC of 580 uS/cm, hardness of 160 mg/I, and TDS of 347 mg/l. • Two control streams, labeled TFC-UT1 and TFC-UT2, were sampled for field parameters only and returned pH values of 8.45 s.u. and 8.48 s.u. and SpC of 1,123 uS/cm and 903 uS/cm respectively. a A thick precipitate was coating substrate in the stream and the rocks at the outfall locations. • A City of Durham Stormwater and GIS Services Division file review revealed the following violations and penalties: -On December 6, 2016 the City of Durham issued a notice of violation (NOV) to Thomas Concrete for illicit discharge of concrete pond wastewater. -On July 11, 2017 the City of Durham issued a second NOV for illicit discharge noting that "no progress was observed in the required cleanup of concrete wastes in the drainage system downstream of the Thomas Concrete property." -On August 25, 2017 the City of Durham issued a penalty assessment of $1,750.00 to Thomas Concrete for the above violations, and on August 25, 2017 an additional penalty assessment of $3,500.00 was issued. • A RRO-DWR file review revealed the following violation: -On January 24, 2017 RRO-DWR issued a notice of violation — notice of intent to enforce for violation of state water quality standards for pH (15A NCAC 02B .0211(3)(g)). -Thomas Concrete was required to respond to the above referenced NOV, but failed to do so. The site visits, sample results and file review revealed the following violations: Item I. Stream Standards -pH Title 15A North Carolina Administrative Code 02B .0211 (3)(g) states that"pH: shall be normal for the waters in the area, which generally shall range between 6.0 and 9.0 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions;" o Results from sample location labeled TFC-3 confirm a pH stream standard violation with a pH of 9.97 S.U. Item IL Stream Standards -Hardness Title 15A North Carolina Administrative Code 02B .0218 (3)(0 states that "Total hardness: not greater than 100 mg/l as calcium carbonate;" o Results from sample locations labeled TFC-3 and TFC-4 confirm hardness stream standard violations with hardness values of 140 mg/l at TFC-3 and 160 mg/I at TFC-4. Requested Response: You are requested to immediately address each of the below items in writing within 30 days of receipt of this letter. 1. Describe the work that has been done to the settling ponds/stormwater ponds since December, 2016. 2. Specifically, detail what housekeeping measures are in place to prevent wastewater from the site from causing surface:water pH and hardness standard violations. 3. Explain how wastewater that exceeds pH of 9.0 and hardness of 100 mg/l will be prevented from discharging from the facility to nearby surface waters. 4. Describe who you have contacted with the Division of Energy, Mining, and Land Resources (DEMLR) regarding compliance with your Stormwater/Process Wastewater permit (NCG140218) and the discharge of water with pH levels exceeding 9.0 SAL and hardness exceeding 100 mg/I. Detail how you will come into full compliance with the requirements of DEMLR. 5. Please provide stormwater pond monitoring results from January 1, 2016 to the present date and describe the location of the sampling point(s). Environmental damage and violations of North Carolina Administrative Codes have been documented for the subject site as stated above. Your efforts to undertake activities to bring the subject site back into compliance is not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues. These violations and any future violations are subject to a civil penalty assessment of up to $25,000.00 per day for each violation. Your response to this letter will be considered with any civil penalty action recommendation. JAY ZIMMERMAN Uirecror Notice of Violation -Notice of Intent to Enforce Case No: NOV-2017-PC-0006 Illegal Discharge of Stormwater/Removal of Use Thomas Concrete NPDES Permit No. NCG140218 Durham County Dear Mr. Westfall: On November 29, 2016, Jonathan Baker and Charlotte Dawn with Durham County Stormwater and GIS services reported concerns regarding the discharge wastewater from a stormwater detention pond at Thomas Concrete (2722 Angier Ave, Durham). They also reported that a follow-up inspection in November 2016 revealed that the problem had not been corrected and that pH at the outfall was 13.2 s.u. and specific conductance was 1778 ms/cm. On December 19, 2016, Danny Smith and Ray Milosh with the Raleigh Regional Office (RRO) of the Division of Water Resources (DWR) and staff from Durham CountyStonmvater and GIS services conducted ajoint site visit. The following observations were noted during the site inspection: • The stormwater retention pond had evidence of recent work. The water level in the pond was below the overflow pipe. • Water was seen exiting from the outlet of the overflow pipe, indicating that the overflow pipe had a leak. • There was an inflatable bladder at the outlet of the overflow pipe that was not holding back the water. • The pH of the water exiting the pipe was 13.6 and the specific conductance (SpC) was 866 ms/em. A thick orange/tan precipitate was seen covering the streambed and rocks in the streambed. (see photograph I ). Division of Water Resources. Note precipitate on streambed and rocks. • The pH of the streamwater exiting a pipe under Hwy 147 approximately 800 feet downstream of the outfall was 9.6 s.u. and the SpC was 363 ms/cm. (see photograph 3). An orange/tan precipitate was covering some parts of the streambed and rocks. Photograph 3, depicted above, is an unnamed tributary to Third Fork Creek, Class WS-V Nutrient Sensitive Waters (NSW) in the Cape Fear River Basin. The site inspection and sample results revealed the following violations of North Carolina General Statutes, North Carolina Administrative Codes, and NPDES permit conditions (NC0049662) which state following: NCGS 143-2151(a) (6) "Activities for Which Permits Required. — No person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in that permit. (6) cause or permit any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters of the State in violation of the water quality standards applicable to the assigned classifications or in violation of any effluent standards or limitations established for any point source, unless allowed as a condition of any permit, special order or other appropriate instrument issued or entered into by the Commission under the provisions of this Article." 15 A NCAC 02B .0211 (14) pH: shall be normal for the waters in the area, which range between 6.0 and 9.0 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; Requested Response This office requests that you respond to this letter in writing within 30 days of receipt of this Notice. (Thomas Concrete) submits this letter of response to address violations of the storm water permit for Thomas Concrete's batch plant facility in Durham, Durham County, North Carolina. Rodak Engineering was retained by Thomas Concrete to address and correct the violations, thereby bringing the facility into compliance with the requirements of their General Storm Water Permit. The violations were noted during a site inspection conducted by the Division of Water Quality on July 30, 2008. For clarification purposes, the corrective action performed to address each of the violations noted is provided after the noted violation. The Storm Water Pollution Prevention Plan (SWPPP) was not available at the site for inspection. As per Plant Manager, the plan is currently being revised. The plan must remain at the plant site at all times for employee and staff reference. Implementation and development of the SWPPP during the time of the inspection was not certain. Rodak Engineering was unable to locate a copy of an SWPPP prepared for the site, so we prepared one in accordance with the requirements of the facility's general storm water permit, current storm water management measures, and current site conditions. We based the elements of the SWPPP on an inspection of the facility conducted on September 24, 2008, evaluation of current storm water Best Management Practices and their effectiveness in meeting design objectives, and interviews with site personnel on storage, handling, and good housekeeping practices. The SWPPP also includes recommendations for improved management practices or measures, if necessary, to maintain quality RODAK ENGINEERING, P.C. The SWPPP was mailed to the facility on October 16, 2008, for implementation. 2. Qualitative monitoring data was not available at the site for review. Sample results must remain at the site at all times. Qualitative monitoring must be conducted as required by General Permit No. NCG140000 (COC No. NCG1401218). Rodak Engineering will conduct qualitative monitoring at the Storm Water Discharge Outfall identified during our site inspection that is representative of discharge associated with site activities. Since the first period for qualitative monitoring in calendar year 2008 has passed, our monitoring event will represent the initial semiannual event for calendar year 2008, and we will schedule and conduct subsequent events in accordance with the schedule in the permit in 2009. The monitoring will be conducted during a representative storm event when a discharge is observed from the storm water retention basin that collects site storm water and process wastewater runoff. 3. Analytical Monitoring data for storm water and process waters was not available at the site for review. Sample results must remain at the site at all times. Analytical monitoring must be conducted as required by General Permit No. NCG140000 (COC No. NCG1401218). Rodak Engineering evaluated the design of the storm water retention basins that collect all runoff associated with industrial activity at the site, and determined that the basins were sized to collect the volume of runoff associated with a 25-year, 24 hour storm event, and discharge only during an event where runoff volume exceeds that from a 25-year event. Therefore, in accordance with Section B of the permit, no quantitative (analytical) monitoring of the storm water discharge from the basins is required. We will still conduct qualitative monitoring of the discharge at the designated outfall location, and will include two analytical parameters (pH and suspended solids) in our monitoring protocol to measure and evaluate the effectiveness of the basins. 4. The facility has four settling pits. Three recycle settling pits in parallel, which contains process waters from the mixing drum clean -out and vehicle%quipment cleaning. One settling pit accepts yard run-off and overflows to a retention pond. As per manager, all solids are removed from the pits once a week All four settling pits were full during the time of inspection with little or no free board. Solids in all four pits must be properly disposed of in 30 days of receipt of this letter. Rodak Engineering inquired about the frequency of the settling pit solids removal and when the last removal was performed during our inspection of the facility with Ray Stehlik, Plant Manager. Mr. Stehlik informed us that the solids are removed from the pits and transported off -site for recycling on a monthly schedule, and that the solids observed during your site inspection were removed on August 4, 2008. The weigh tickets from the August removal event are attached to this letter. 5. The facility has a retention pond on -site, which accepts yard run-off and overflow for yard run-off pit. A description of the retention basin, including operation and maintenance requirements, is included in the SWPPP. RODAK ENGINEERING, P.C. The discharge location will be at the point where storm water exits the property. The discharge point will not be the retention pond. The discharge point will be where the flow exits the pond to be channeled to a creek or where the flow is discharged to the environment via overflow pipe from the retention pond. The discharge point must be assessable for Analytical and Qualitative sampling. Rodak Engineering inspected the retention basins during our facility inspection and identified the discharge location as the southwest retention basin discharge weir overflow structure. We spent considerable time in the wooded area off -site to try and locate a pipe discharge location connected to the overflow structure, but were unable to do so. Therefore, the location selected for qualitative monitoring was determined to be the outlet weir of the overflow structure. This location is accessible, and can be viewed easily from the bank of the basin for the purposes of qualitative monitoring. 7. Admixture tanks were in secondary containment. An evaluation of the adequacy of the admixture tanks' secondary containment was conducted and evaluated as part of the SWPPP development, and determined to be adequate to meet the design containment volume (capacity of the largest tank plus sufficient freeboard volume after a 25 year, 24- hour storm event). Plant personnel were reminded during our site inspection to place all admixture tanks within the secondary containment structure. 8. All oils, gear oils and garage oils and fluids are to he secondarily contained such that no oils and fluids could possibly spill into floor drains or mix with process waters and storm water run-off. Rodak Engineering inspected the petroleum storage area in the maintenance shop during our site visit, as well as the diesel AST stored within the admixture tank containment structure. All petroleum storage conducted at the facility is within adequate passive secondary containment, or active containment measures (i.e. spill collection and clean up materials) are provided for spill response. Additionally, there are no floor drains in the maintenance shop, and the floor slopes inward from the overhead door openings, preventing spills of petroleum from mixing with process waters and storm water run-off. A description of the passive and active containment measures is provided in the SWPPP. 9. During the time of inspection, the recycle line was leaking. The leak should be repaired. Rodak Engineering inspected the recycle line during our site visit and interviewed Mr. Stehlik regarding the repair. (Thomas Concrete) submits this letter of response to address violations of the stormwater permit for Thomas Concrete's batch plant facility in Durham, Durham County, North Carolina. Rodak Engineering has been retained by Thomas Concrete to address and correct the violations, thereby bringing the facility into compliance with the requirements of their General Stormwater Permit. The violations were noted during a site inspection conducted by the Division of Water Quality on July 30, 2008. For clarification purposes, the intended course of action to address each of the violations noted is provided after the noted violation. 1. The Stormwater Pollution Prevention Plan (SWPPP) was not available at the site for inspection. As per Plant Manager, the plan is currently being revised. The plan must remain at the plant site at all times for employee and staff reference. Implementation and development of the SWPPP during the time of the inspection was not certain. We will base the SWPPP on an inspection of the facility, evaluation of current stormwater Best Management Practices and their effectiveness in meeting design objectives, and interviews with site personnel on storage, handling, and good housekeeping practices. We will also include recommendations for improved management practices or measures, if necessary, to maintain quality of stormwater and process runoff from the property. 2. Qualitative monitoring data was not available at the site for review. Sample results must remain at the site at all times. Qualitative monitoring must be conducted as required by General Permit No. NCG140000 (COC No. NCG1401218). Rodak Engineering will conduct qualitative monitoring at the Stormwater Discharge Outfall(s) designated during our site inspection to be representative of discharge associated with site activities. 0 Since the first sampling period for qualitative monitoring in calendar year 2008 has passed, our monitoring event will represent the initial semi-annual event for calendar year 2008, and we will schedule and conduct subsequent events in accordance with the schedule in the permit in 2009. 3. Analytical Monitoring data for stormwater and process waters was not available at the site for review. Sample results must remain at the site at all times. Analytical monitoring must be conducted as required by General Permit No. NCG140000 (COC No. NCG1401218). Rodak Engineering will conduct analytical monitoring at the Stormwater Discharge Outfall(s) designated during our site inspection to be representative of discharge associated with site stormwater runoff and process activities. Since the analytical monitoring is an annual requirement, our monitoring event will fulfill the initial monitoring requirements for the permit, and we will schedule and conduct subsequent events in accordance with the requirements of the General Permit for the remaining effective term of the permit. 4. The facility has four settling pits. Three recycle settling pits in parallel, which contains process waters from the mixing drum clean -out and vehicle/equipment cleaning. One settling pit accepts yard run-off and overflows to a retention pond. As per manager, all solids are removed from the pits once a week. All four settling pits were full during the time of inspection with little or no free board. Solids in all four pits must be properly disposed of in 30 days of receipt of this letter. Rodak Engineering will ensure that facility personnel clean out all four pits within the required allotment, and document when this is accomplished for submittal to the DWQ. 5. The facility has a retention pond on -site, which accepts yard run-off and overflow for yard run-off pit. A description of the retention basin, including operation and maintenance requirements, will be included in the SWPPP. -- RODAK ENGINEERING, P.C. The discharge location will be at the point where stormwater exits the property. The discharge point will not be the retention pond. The discharge point will be where the flow exits the pond to be channeled to a creek or where the flow is discharged to the environment via overflow pipe from the retention pond. The discharge point must be assessable for Analytical and Qualitative sampling. Rodak Engineering will inspect the retention basins during our facility evaluation and identify the discharge locations. We will evaluate the adequacy of the discharge locations based on accessibility for sampling, structural stability, evidence of erosion, accumulation of debris, and make recommendations for improvements to the locations to improve flow, enhance water quality and allow access for sampling. 7. Admixture tanks were in secondary containment. An evaluation of the adequacy of the admixture tanks' secondary containment will be conducted and reviewed in the current version of the SWPPP, and modified as necessary. & All oils, gear oils and garage oils and fluids are to be secondarily contained such that no oils and fluids could possibly spill into floor drains or mix with process waters and stormwater run-Off- Rodak Engineering will inspect the process fluids storage area, and make recommendations for adequate secondary containment. We will include a description of the secondary containment in the SWPPP. 9. During the time of inspection, the recycle line was leaking. The leak should be repaired. Rodak Engineering will inspect the recycle line during our site inspection, and ensure that the line has been repaired. Rodak Engineering understands that Thomas Concrete has been granted a 30-day deadline for correcting the noted violations and achieving compliance with the provisions of their stormwater permit. In consideration of the scope of work necessary to adequately assess and update the facility's SWPPP and conduct qualitative and analytical monitoring of the stormwater runoff, we request an additional 15-day extension to the deadline, and will complete the scope of work to update the SWPPP by September 30, 2008. The qualitative and analytical monitoring will be performed when a representative storm event is recorded, and will be completed by December 31, 2008 in accordance with the requirements of the permit. Plant for Stormwater Status, 1 1/17/04 Durham, NC NCG140218 Durham County Prior to a visit to RRO by F&R consultant Bill Rice to discuss the West St. plant, this visit was made to Durham Angier Rd to see whether compliance with NCG 14 had been accomplished at this plant since the enforcement procedure for West St in January 2004. Our records show no analytical data for this site over many years, so this visit was also a check on whether any sampling had been done in 2004. Unfortunately, nothing has been done. There is no SP3 manual, so permission was requested from Manager Brooks Dickerson to simply walk around the site. The site is about 90% impervious, except in the central portion when conveyances have eroded down to what looks like bedrock.. SW and process waters drain across the lot through three such channels to a recycle system. This facility seems "messy" because of all the water flowing across the lot through which the trucks drive for every activity. From the puddle created in front of a cell at the lowest point, the water escapes around one side to a small pond. This pond is dug out at a still lower elevation. A submersible Pump in the pond lifts water into one of three cells having a higher elevation than the "catch-all" cell noted above. Apparently drum dumps are made into the other two cells. From the cell receiving water from the pond, it is pumped via a suspended 4" black hose back across the lot to the loading station. This is a very awkward handling of water, but dictated by the location of things. There is an overflow standpipe in the pond, so investigation will be needed to know where that goes. It is not a true recycle system if this outlet is functional. Solids removed from these cells is piled along the site perimeter not far from the catch-all cell. Update 11/17/04 Mr. Rice has a contract to establish a program for each Thomas site. We walked this location (and the Morrisville facility) during which he noted areas for BMPs. I requested that he calculate the volume for a 25 yr/ 24 hr storm and estimate the impact on the site. We discussed what the maps should include. Standing water from a culvert under the railroad tracks meets a 5" berm of concrete waste materials at the edee of the loading - station. A better BMP is needed there. I alerted Bill to the fact that if there is a discharge point to which the flow from the garage area goes, O&G sampling will be required if the garage uses >55 gallons of motor oil per month average. A SP3 manual exists for the West St. facility, so he will use that as a starting point for the other sites.
