Banks, then north to the western most point of Middle Marshes and along the northwest shore of
Middle Marshes (to include all of Middle Marshes), then west to Rush Point on Harker's Island,
and along the southern shore of Harker's Island back to Core Sound.
(C) The Bear Island Section of the Western Bogue Sound and Bear Island Area (White Oak River
Basin) including all waters within an area defined by a line from the western most point on Bear
Island to the northeast mouth of Goose Creek on the mainland, east to the southwest mouth of
Queen Creek, then south to green marker No. 49, then northeast to the northern most point on
Huggins Island, then southeast along the shoreline of Huggins Island to the southeastern most point
of Huggins Island, then south to the northeastern most point on Dudley Island, then southwest
along the shoreline of Dudley Island to the eastern tip of Bear Island.
(D) The Masonboro Sound Area (Cape Fear River Basin) including all waters between the Barrier
Islands and the mainland from Carolina Beach Inlet to Masonboro Inlet.
(9) Black and South Rivers ORW Area (Cape Fear River Basin) [Index Nos. 18-68-(0.5), 18-68-(3.5),
18-68-(11.5), 18-68-12-(0.5), 18-68-12-(11.5), and 18-68-2]: the following management strategies, in
addition to the discharge requirements specified in Subparagraph (c)(1) of this Rule, shall be applied to
protect the designated ORW areas:
(A) Stormwater controls described in Subparagraph (c)(1) of this Rule shall apply within one mile and
draining to the designated ORW areas;
(B) New or expanded NPDES permitted wastewater discharges located one mile upstream of the
stream segments designated ORW (upstream on the designated mainstem and upstream into direct
tributaries to the designated mainstem) shall comply with the following discharge restrictions:
(i) Oxygen Consuming Wastes: Effluent limitations shall be as follows: BOD = 5 mg/l and
NH3-N = 2 mg/l;
(ii) Total Suspended Solids: Discharges of total suspended solids (TSS) shall be limited to
effluent concentrations of 20 mg/l;
(iii) Emergency Requirements: Failsafe treatment designs shall be employed, including stand-
by power capability for entire treatment works, dual train design for all treatment
?z components, or equivalent failsafe treatment designs;
(iv) Nutrients: Where nutrient overenrichment is projected to be a concern, effluent
'7' limitations shall be set for phosphorus or nitrogen, or both.
(v) Toxic substances: In cases where complex discharges (those containing or potentially
>> containing toxicants) may be currently present in the discharge, a safety factor shall be
applied to any chemical or whole effluent toxicity allocation. The limit for a specific
Q/ chemical constituent shall be allocated at one-half of the normal standard at design
conditions. Whole effluent toxicity shall be allocated to protect for chronic toxicity at
W1 an effluent concentration equal to twice that which is acceptable under flow design
criteria (pursuant to 15A NCAC 2B .0206).
r ?` ?0 Lake Waccamaw ORW Area (Lumber River Basin) [Index No. 15-2]: all undesignated waterbodies that are
\,? ( tributary to Lake Waccamaw shall comply with Paragraph (c) of this Rule in order to protect the designated
waters as per Rule .0203 of this Section.

15A NCAC 0211.0226 EXEMPTIONS FROM SURFACE WATER QUALITY STANDARDS
Variances from applicable standards, revisions to water quality standards or site-specific water quality standards may be
granted by the Commission on a case-by-case basis pursuant to G.S. 143-215.3(e), 143-214.3 or 143-214.1. A listing of
existing variances shall be maintained and made available to the public by the Division. Exemptions established pursuant to
this Rule shall be reviewed as part of the Triennial Review of Water Quality Standards conducted pursuant to 40 CFR
131.10(g).

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located on Florida Avenue, adjacent to the Carolina Beach Yacht
Basin, in Carolina Beach, in New Hanover County. It was received complete on 10/11/02, and appears to be
adequate for processing at this time. The projected deadline for making a decision is 12/25/02. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted- at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card to a
telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-
of-way where a private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review, the
agencies may contact you directly.

the 401 rules say "is water dependent and requires access to water as a
central element of its basic function, although projects funded by government
agencies [read DOT!!} may be exempted from this requirement". if this is a
privately funded project, then they would need a variance. if it is
publically funded, then it could be okay.

Dear Mr. Orli:
This Office has reviewed your CAMA Major Application received by the Division of
Water Quality on November 12, 2002, with additional information received on February 3, 2003.
Your efforts to minimize the proposed impacts to coastal marsh have been noted, and this office
has determined that you have revised your site plan to minimize the impacts to coastal marsh to
the maximum extent practicable. However, this office must recommend denial of your permit
because your proposed project is not water dependent according to Administrative Code Section:
T15A 7H.0208(a)(1). Administrative Code Section: 15A NCAC 2H.0506(d)(1)(B) prevents the
Division of Water Quality from issuing a 401 Water Quality Certification for the fill of coastal
wetlands unless the project is water dependent and requires access to water as a central element of
its basic function. Please review the attached description of water dependent uses and revise your
application and plans accordingly.
You have expressed your desire to request a variance from the rules if a 401 Water
Quality Certification could not be issued for your project as proposed. If you wish to explore the
possibility of a variance, please contact John Dorney with the Wetlands Unit in writing within
three weeks of the date of this letter at 2321 Crabtree Blvd., Raleigh, NC 27604-226, his phone
number is (919) 733-9721.
If we do not hear from you within three weeks, we will assume that you no longer want
to pursue this project and we will consider the project as withdrawn.

9. PROTECT DESCRIPTION
The project site is located on Florida Avenue, adjacent to the east side of the Carolina Beach Yacht Basin, in
Carolina Beach. This is a residential area, classified as Developed in the Carolina Beach Land Use Plan. The
property (260' X 120') is shown on the survey as four (4) lots (4,4A, 5, and 5A). These undeveloped lots are
bordered on both sides by condominium developments whose shorelines are stabilized by bulkheads. Lots 4A
and 5A are located oil the north side of the property and consist entirely of open water and intertidal salt
marsh. Coastal wetland species include; Smooth Cordgrass (Spartina alterniflora), Black Needle Rush QJuncus
roemarianus), Spike Grass (Distichlas s icada), Sea Lavender (Lumonium, spp.), Saltwort (Salicornia, spp.),
and Salt Meadow Grass (S artina patens). Lots 4 and 5 each measure 100 feet in depth from Florida Avenue
and 60 feet wide. The majority of Lot 5 is unvegetated due to vehicular use by the adjacent condominium
residents. The applicant has shown an approved "404 type" wetlands delineation line approximately 15 feet
north of Lots 4 and 5, however, several species of coastal wetland high marsh vegetation mix into the
vegetation on the lots to within 15 - 20 feet of Florida Avenue. These coastal wetlands species are Spike
Grass (Distichlas spicada), Sea Lavender (Lumonium, spp.) and Salt Meadow Grass (Spartina patens). These
coastal wetlands are most active in the first 30 feet landward of the proposed bulkhead, as indicated by the
predominance of coastal wetland species, crab holes, and soil wetness. Low elevations and poor storm
drainage in Carolina Beach, along Canal Drive and Florida Avenue, regularly create street flooding
associated with lunar and/or storm tides. In addition to their occasional tidal flooding, these undeveloped
areas become drainage outlet corridors during such events and associated ponding on adjacent low lots
encourages the colonization of coastal wetland plant species.
The Carolina Beach Yacht Basin is classified as SB by the NC Division of Water Quality, and it is CLOSED
to the harvest of shellfish. The basin is not a designated primary, nursery area (PNA) by the NC Division of
Marine Fisheries.
The applicant proposes to construct a new bulkhead and fill the lot. The new bulkhead would be 123 feet
long, constructed approximately along the "404 type" wetland line shown on the project drawing, and connect
to the ends of the wing walls of the two existing bulkheads on the adjacent lots. The size of the proposed
filled and graded area is approximately 3450 square feet (115' X 120').
10. ANTICIPATED IMPACTS
As proposed, the project would result in the filling and incorporation of approximately 10,200 square feet of
coastal wetlands, including approximately 480 square feet of federally regulated "404 type wetlands..
Another 2400 square feet of high ground would be disturbed and graded.

Dear Mr. Shaw:
You have our approval, in accordance with the attached conditions, to impact 0.05 acres of
wetlands or waters for the purpose of shoreline stabilization at Lot# 74, Pinnacle Shores subdivision on
Lake Norman as you described in your application dated October 30, 2002. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number
3373, which may be viewed on our website at http://h2o.enr.state.nc.us/ncwetlands. This certification
allows you to use General Permit Number 198200030 when the Corps of Engineers issues it. This
approval is also valid for the Catawba River buffer rules (15A NCAC 2B .0243). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application
except as modified below. If you change your project, you must notify us and you may be required to
send us a new application. If the property is sold, the new owner must be given a copy of this
Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the
corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this
approval to be valid, you must follow the conditions listed in the attached certification and any
additional conditions listed below.
1. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream
buffers;
2. No trees shall be removed from Zone 1 of the Catawba Buffer unless they are directly within
the construction access corridor. If trees are removed, at least two species of native forested
vegetation shall be re-established within the construction access or other temporary impact area
occurring in the protected buffer zone within the next growing season following construction
of the project;
3. This project is for the installation of riprap to prevent further erosion of the property due to
wave action. The use of mechanical equipment on the beach must be minimized;

4. Equipment and materials may be offloaded to the beach at the bulkhead site, but steps must be
taken to keep all equipment out of the reservoir;
5. Any disturbance within 50 feet of the shoreline must be done in compliance with the Catawba
River buffer rules;
6. Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached form and
return it to the 401/Wetlands Unit of the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

-The bank height is the average height of the eroded shoreline( measured from the original lake bed to the top of the
eroded bank) in the area to be stabilized.
-Bioengineering techniques within an IMZ require applicant to provide photo evidence of successful vegetation
establishment at 1 year point. Bioengineering is a stabilization approach that utilizes natural and living material.
Bioengineering techniques include use of rip rap with live stakes, rock filled gabions, live staked crib walls, biologs,
and numerous other activities.
-Applicant can use bioengineering, rip rap, seawalls or any combination of stabilization techniques where use of
hardening structures are allowed.
-Stabilization in an IMZ requires reasonable mitigation requirements as determined through consultation with state
wildlife agencies.
-Stabilization in areas classified as Natural due to the presence of significant cultural resources, should not have
artifacts impacted by utilizing any shoreline stabilization technique.
