For coverage under Stormwater General Permit NCG140000, the Division of Energy,
Mineral, and Land Resources (DEMLR) is forwarding herewith the reissued Certificate of
Coverage (COC). This permit is reissued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.) A new Certificate of Coverage (COC) is included with this
letter.
You must print a copy of the new NCG14O000 General Permit from our website here:

print package on the website includes revised Discharge Monitoring Report (DMR) forms,
Annual Discharge Monitoring Report forms, and Qualitative Monitoring Report Forms.
The General Permit authorizes discharges of stormwater and wastewater (if applicable),
and it specifies your obligations with respect to discharge controls, management,
monitoring, and record keeping. Please review the new permit to familiarize yourself with
all changes in the reissued permit. Significant changes to the General Permit are
outlined in the Technical Bulletin, which is also available on the website above. Your
facility has six months from receipt of the permit to update your Stormwater Pollution
Prevention Plan (SPPP) to reflect any new permit requirements.

How does the new General Permit affect Tier Status?
The first sample period of your permit begins August 1, 2017. Tier 3 actions in Part IV of
your permit are triggered by benchmark exceedances on four occasions beginning on the
effective date of this permit and do not count prior exceedances. Likewise, Tier 2 actions
are triggered by two consecutive benchmark exceedances beginning on the effective date
of this permit and do not count prior exceedances. However, if your facility is already in
Tier 2 (monitoring stormwater discharges monthly) or Tier 3, you must continue monthly
monitoring until relieved through conditions of the permit or by DEMLR staff approval.
When does electronic DMR reporting start?
We are setting up our database with final permit parameters and the outfalls that
permittees submitted on-line. All NCG14 Permittees will receive notification when our
eDMR system is ready for these permittees to register and begin reporting
monitoring data electronically. If you have any questions about the status, please
contact Bethany Georgoulias at (919) 807-6372 or Robert Patterson at (919) 807-6369. If
you did not submit outfall information already, we have included a form for you to return
to us. (Note: NO FORM IS ATTACHED if we already have your outfall information.)
Your coverage under the General Permit is transferable only through the specific action of
DEMLR. This permit does not affect the legal requirements to obtain other permits which
may be required by the N.C. Department of Environmental Quality (DEQ), nor does it
relieve the permittee from responsibility for compliance with any other applicable federal,
state, or local law, rule, standard, ordinance, order, judgment, or decree.

Safety Considerations:
All standard DAQ FRO safety gear is required. The main hazard for the inspector is vehicular traffic on
Hwy 13.
Facility Description:
The facility does not use fly ash and is rarely operated. Concrete is composed essentially of water,
cement, and fine/coarse aggregate (sand and rock). The plant stores, conveys, measures, and drops
these constituents into trucks for mixing and transport to the job. The aggregates are transferred to the
elevated storage bins by a front-end loader, conveyed by belt to the weigh hopper, weighed and
delivered to the facility mix truck. The cement is transferred from the elevated silo by pneumatics to
the weigh hopper, added to the truck, and mixed on the way to the site where it is poured.

Inspection Summary:
On 13 September 2016,1, Mark Brantley, of FRO DWR, arrived at the facility and met with Mr. Hank Gay,
Environmental Manager for S&W concrete. A records review indicated that the plant had not been in
operation since February 2014. Mr. Gay also stated that the plant could not be used in its current condition.
Some rehab work and upgrades to the equipment would be required before any concrete could be produced.
The ductwork, silo, and other parts of the equipment are still rusty. There was no evidence of significant
fugitive dust in the surrounding areas.
Regulatory Review:
A.3 2D .0515 "Particulates from Miscellaneous Industrial Processes," Particulate matter emissions
from the emission sources shall not exceed allowable emission rates.

Inspection Summary:
The inspection and file review revealed that NPDES Stormwater General Permit and associated Certificate Of Coverage
(COC) authorizes discharges of process wastewater and stormwater to receiving waters designated as Beaverdam Swamp,
a class C SW stream, in the Cape Fear River Basin.
The following observations were noted during the inspection:
1) Stormwater Pollution Prevention Plan (SPPP)
A SPPP has been developed, recorded and properly implemented.
2) Qualitative Monitoring
Qualitative monitoring has been conducted and recorded in accordance with permit requirements.
3) Analytical Monitoring
Analytical monitoring has been conducted and recorded in accordance with permit requirements.
Samples are reportedly taken from a point adjacent to a building (pole barn) onsite prior to the receiving stream. Please
continue to take representative samples as called for in the permit.
4) Other Observations
Facility Site
The facility site is extremely small but appears to be well managed. Please continue to manage the site to prevent
discharge of solids/sediment to the adjacent receiving stream.
Secondary Containment
Since the last inspection (September 14, 2009) secondary has been constructed as called for by the permit.

On September 14, 2009, Danny Strickland from the Fayetteville Regional Office of the Division
of Water Quality, conducted a site inspection for the S & W Ready Mix Concrete -Newton Grove facility
located at Hxvy 13, Sampson County, North Carolina. A copy of the inspection report is enclosed for
your review. Stormwater from the facility drains to Unnamed Tributary to Beaverdam Swamp, a Class
C;Sw water located in the Cape Fear River Basin. The site visit and file review revealed that the subject
facility is covered by NPDES Stormwater General Permit-NCG140028.
Accordingly, the following observations and/or permit conditions violations were noted during
the Division of Water Quality inspection:

placed on a concrete pad, underneath a shelter, but are without secondary containment. This was noted
in the past inspection and was addressed by Mr. Gay that secondary containment would be placed
around the admixtures in a letter to this office dated December 21, 2006.

This letter is in response to the compliance evaluation inspection conducted on November
8, 2006. It was noted during the inspection that the area where admixtures are stored is
without secondary containment. Secondary containment will be placed around the
admixtures by February 1, 2007.
Also, sampling for this facility will be performed in a manner that is consistent with the
NCG140000 General Permit. A small depression will be constructed in the gravel path
prior to the slope to allow for proper sampling methods as well as aiding in solids settling
by January 12, 2007.

directly from the tributary. Please be advised that Part111, Section D, Item 1 of the NCG140000 General
Permit states in part: "All samples shall be taken before the discharge joins or is diluted by any
other waste stream, body of water, or substance." This office requests that you or your staff submit a
written response detailing a Plan of Action (POA) concerning the aforementioned items to be received
on or before December 13, 2006. Please refer to the inspection summary located on page 2 of the
enclosed Water Compliance Inspection Report for additional comments.

Facility's process wastewater consists of truck washdown, drum cleanout and wetting of stockpiles. Site is
graded such that all wastewater and stormwater meanders through the site and discharges through a gravel
path that leads to a 20-25 feet slope down to an unnamed tributary to Beaverdam Swamp. This is contrary
to the Certificate of Coverage, which reads that stormwater and wastewater discharge through an MS4
owned and operated by the Town of Newton Grove. There is in fact no such storm drain on the site and the
Certificate of Coverage should be revised upon the next permit renewal. A small diesel tank is present at
this facility and has a fabricated metal box surrounding it providing secondary containment. The admixtures
for this facility are placed on a concrete pad, but are without secondary containment. It was advised that a
poured concrete berm be placed around the concrete pad to provide the necessary containment should a
spill or leak occur. Sampling for this facility is conducted directly out of the tributary, which is not allowed
per the permit conditions. It was advised that a small depression could be made in the gravel path prior to
the slope to allow for proper sampling methods as well as aiding in solids settling.

to receiving waters designated as a UT of Beaverdam Swamp via the Newton Grove MS4, a class C SW
stream, in the Cape Fear River Basin in accordance with the effluent limitations, monitoring
requirements, and other conditions set forth in Parts I, II, M. IV, V, and VI of General Permit No.
NCG140000 as attached.
This certificate of coverage shall become effective August 1, 2004.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

In response to your renewal application for continued coverage under general permit NCG140000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG140000
* A Stormwater Pollution Prevention Plan (SPPP) Certification Form. Completion of this form is required to
certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.
DO NOT SEND the SPPP with the signed form.
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin for the general permit which outlines changes in the permit, key requirements,
and addresses frequently asked questions
* A Certificate of Coverage
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree.

In accordance with your application for discharge permit received on November 18, 1994, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and
the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal
Area Management Act or any other Federal or Local governmental permit that may be required.
