Chambers Development of North Carolina, Inc. (Chambers) recently received two
(2) Notices of Violation from the North Carolina Department of Environment and Natural
Resources (NCDENR). These violations were for Non -Payment on permit number
NCG120028 and for Failure to Submit. Renewal Application for permit number
NCG120064.. Copies are attached for your. reference.
On June 13r�, 2002, 1 spoke with Ms. Aisha Lau of the central office Stormwater
and General Permits regarding the above issues. From our conversation, it appears that
there are currently two permits issued for the Anson Waste Management Facility located
off highway 74 in Polkton, NC. Permit number NCG120028 was issued in 1993 to
Chambers Waste Systems and permit number NCG120064 was issued on January 26t",
2001 to Chambers Development of NC, Inc. In 1993 there were no activities taking place
at the site.
It appears that there has been some confusion regarding the paperwork that has
been received at my office over the last few months. In December 2001 Chambers
received a Permit Coverage Renewal Application Form for permit number NCG120028.
"this form was subsequently completed and returned to NCDENR on January 1 1 d', 2001.
At that time, Chambers did not receive a renewal application form for permit number
NCG120064. However, in February/March, 2002 Chambers did receive an invoice for
the yearly NPDES coverage fee. This invoice was for permit number NCG 120064 and
was subsequently paid on March 20t", 2002. Again, at that time Chambers did not
receive an invoice for permit number NCG 120028. Unfortunately, even though
Chambers kept receiving and responding to the required permit forms, the forms received
were never checked to. verify the permit number, nor were two separate forms received.
For this reason, Chambers believed that we were in compliance with all applicable
requirements, and did not realize that the permit numbers on each form did not
correspond to each other.

Per Ms. Lau's recommendation, I am enclosing a Permit Coverage Rescission
Request Form for permit number NCG120028 and a Permit Coverage Renewal
Application Form for permit number NCG120064.
Based on the above circumstances, Chambers respectfully requests consideration
froj&NCDENR to rescind the NOV's issued to Chambers for the non -action outlined
within them. As you can see from the enclosed information, Chambers was undefthe
belief that it had complied with all the requirements of the NPDES program for this site.

been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1 a) and (1 b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4). and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

This letter is to inform you that, as of file date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 141.215.1 (c)(1) which
states "AII applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any per miLice that has not requested renewal at least 180 days prior to expiration or penniIIcc that does not have a
permit otter the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedIII cs as provided in NCGS § 143-215.6 and 33 USC 1251 ct. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.

Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or

It has come to our attention that an error was made in the subject Certificate of Coverage
(COC). Accordingly, we are forwarding herewith a modified COC to correct the error.
The original COC incorrectly identified the Catawba River Basin as the basin in which the
receiving stream is located. The Yadkin -Pee Dee River Basin is the correct basin.
Please find enclosed a modified COC which should replace your existing COC. The old
certificate should be discarded. All other terms and conditions contained in General Permit
NCG120000 remain unchanged and in full effect.
