This letter is in reference to permit NCG 100184. This concerns the violation noted on Dec 6°i 2012 by
Mike lawyer.
Analytical monitoring had not been done in accordance because the company had been foreclosed own
and I didn't realize, Autry Mills LLC had not done the proper testing.
Please update our permit, Autry Mills Is no longer the owner. Runion's Recycling Inc has resumed
ownership.
The plan is now updated and our monitoring will be done properly.
Basically through foreclosure proceedings the monitoring was not done by former owner.

On December 6, 2012, Mike Lawyer, Environmental Specialist from the Fayetteville Regional Office of the
Division of Water Quality, conducted a site inspection at the Runion's Recycling Inc. facility located at 75
Runion Lane, Roseboro, Sampson County, North Carolina. A copy of the Compliance Inspection Report is
enclosed for your review. Your time and assistance during the inspection is greatly appreciated. Permit coverage
authorizes the discharge of stormwater from the facility to receiving waters designated as Big Swamp, a Class
C;Sw waterbody in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is
covered by NPDES Stormwater General Perm it-NCG100000, Certificate of Coverage-NCG100184.
As a result of the site inspection, the following permit condition violation is noted:
1) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
Other Observations:
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made
during the inspection.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your
written response should include a reasonable explanation as to why the aforementioned violation has occurred as
well as a Plan of Action to prevent this violation from re -occurring.

Inspection Summary:
Inspection was conducted in response to a referral by Mr. Bobby Nelms with the Division of Waste
Management -Hazardous Waste Section who observed a bypass of an oil/water separator on November 15, 2012, Met
with Mr. Andy Runion, owner, to make observations of the oil/water separator including any possible impacts to surface
waters and to ensure compliance with the facility's stormwater permit. According to Mr. Runion, the drain pad in front of
their car crusher had not been draining properly so he thought the pipe leading to the oil/water separator was clogged. In
an effort to unclog the drain pipe, a plug was removed above the filter and a rod inserted. A blockage was loosened and
collected stormwater mixed with residual petroleum products from the car crushing activities was released to the ground
surface and traveled into the stormwater ditch. Mr. Runion stated that the material was contained in the ditch. At the time
of inspection, there did not appear to be any petroleum pooling or staining beyond about twenty feet into the ditch and no
evidence that any of the petroleum product had reached surface waters. Mr. Runion was advised to properly operate and
maintain the oil/water separator to prevent such an event from re -occurring. A review of the facility's Stormwater Pollution
Prevention Plan (SWPPP) and available monitoring records was conducted. Although the SWPPP appeared to contain all
the major components required by the permit, additional detail should be added along with documentation of an annual
review/update. Since the previous compliance inspection in June 2007, qualitative (visual) monitoring has been conducted
and recorded semi-annually, however analytical monitoring was only conducted in the second half of 2007, first half of
2010 and second half of 2012. All parameters were below or within the Benchmark Values listed in the permit with the
exceptions of TSS in 2007 and pH in 2010 and 2012. Potential causes of low pH values should be determined and all
monitoring requirements, including frequency, should be followed in accordance with the current permit.

This letter is in response to the on site inspection
conducted by Chad Turlington on June 12, 2007. It was
discussed with Chad that our facility was never assigned a
point of discharge to conduct qualitative or analytical
monitoring. This facility was told it was on a "Carolina"
plan and did not have a discha.rge. Upon Mr. Turlington's
inspection a discharge has been decided upon and the
qualitative and analytical monitoring will not be a problem
from here on out. This facility is in the process of
opening ditch lines and should be completed within six
months. We are also in the process of relocating our
processing area to be completed within one year. Our
secondary containment should be completed after this takes
place. (About 1 and '-� years).

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act and then delegated to the Division of Water Quality for implementation in
North Carolina. The NPDES permitting program for stornwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There are
currently 19 active general stormwater permits in North Carolina. One condition that is applicable to
both the general permits and individual stormwater permits is the requirement to develop and implement
site -specific comprehensive stonnwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent
pollutant discharge.
Copies of the general permits and accompanying documents can be accessed from the following

monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES
General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your pennit. That said;
please see the above -mentioned web site in order to obtain a copy of the permit such that you may fully
comply with all the conditions therein. Failures to properly comply with conditions of the permit,
like those bulleted below, constitutes violations and are subject to a civil penalty assessment of up
to $25,000.00 per day, per violation.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit
coverage under a general NPDES stormwater permit or an individual NPDES stormwater pennit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stomtwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered
by the General Permit. That is, the penmittee is authorized to discharge stormwater, process
wastewater, and/or mine dewatering pursuant to the type of General Pennit until the perniit
expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general pennits. Permit conditions vary accordingly; however, most
of the permits have following condition requirements (you must read your entire permit to ensure
full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility
along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring
results shall also be maintained on -site. The Permittee shall retain records of all
monitoring information, including all calibration and maintenance records and all original
strip chart recordings for continuous monitoring instrumentation, and copies of all reports
required by this general permit for a period of least 5 years for the date of the sample
measurement, report or application.
o Expiration — The pennittee is not authorized to discharge after the expiration date of the
general permit. In order to receive automatic authorization to discharge beyond the
expiration date, the pennittee shall submit forms and fees as are required by the agency
authorized to issue permits no later than 180-days prior to expiration date. Any pennittee
that has not requested renewal at least 180 days prior to expiration, or any pennittee that
does not have a permit after the expiration and has not requested renewal at least 180
days prior to expiration, will be subject to enforcement. Failure to renew your permit is
a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is
not transferable to any person expect after notice to and approval by the Director. Tile
Director may require modification or revocation and reissuance of the Certificate of
Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the pennitted facility is sold or closed. The Division of
Water Quality views changes of name or ownership as a modification that requires the
Director's approval and reissuance of the permit. Name and ownership changes required
you to complete a Name/ownership Change Form from the Division and mail it back to
the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

In accordance with your application for a discharge permit received on February 28, 2006, we
are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.

plan or other document filed or required to be maintained under Article 21 or regulations of (he Environmental
Management Commission implementing that Article, or who falsifies, tampers with or knowingly renders inaccurate any
recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the
Environmental Management Commission implementing that Article, shalt be guilty of a misdemeanor punishable by a
