from any of the following sources:
- domestic waste water sources (i.e., toilets, sinks, kitchen sinks, washing machines, etc.
- process wastewater from equipment operation, wash down, fluid removal, etc
NOTE: Washdown water from vehicle washing is considered "wastewater" and is regulated by NC
Wastewater Requirements (not Stormwater rules). It is not allowed to be discharged - by the
Stormwater permit or by this Stormwater SPPP.

On July 24, 2006, the Division of Water Quality assessed a civil penalty of $11,841.73, which includes
$1,341.73 in investigative costs, for water quality violations on your site. The Division of Water Quality has
considered the current status of the subject site and your request regarding the outstanding civil penalty.
Accordingly, the Division of Water Quality DWQ has agreed to reduce the civil penalty to $1,341,73.
The Division is agreeable to a six (6) month payment schedule begirming on October 15, 2008 and

• August 19, 2003 — RRO issued a Notice of Violation for discharging stormwater from a
Used Motor Vehicle site to waters of the State without a NPDES General Stormwater
Permit.
• January 16, 2004 — Mr. Hoyle M. King was issued a Certificate of Coverage No.
NCG 100160.
• June 8, 2005 — RRO conducted a site visit and observed various violations of the
conditions of the General Stormwater NPDES Permit NCG 100000.
• June 20, 2005 — RRO issued a NOV and Notice of Intent to Enforce for failure to
develop a Stormwater Pollution Prevention Plan and for failure to monitor and perform
sampling in addition to placingjunked cars in the UT to Lake Michael.
• July 28, 2005 — Mr. Hoyle King responded to the NOV stating that he had removed
approximately 50 cars from the stream area and that he reseeded the area.
• March 21 and 28, 2006 — RRO conducted a site visit and observed that junked cars still
remained in the unnamed tributary to Lake Michael. Soil and stream samples were
collected from the property. Four soil samples were evaluated for oil and grease
concentrations and all four results were above the 250 ppm action level.
• May 19, 2006 — DWQ issued a Notice of Violation and Notice of Intent to Enforce for
not submitting qualitative or quantitative monitoring data, for failing to prevent
automotive fluids from leaching into soil, and for placing junked cars in the unnamed
tributary to Lake Michael.
• July 24, 2006 — Mr. Hoyle King was assessed S 10,500.00 for violating eight (8)
conditions of Stormwater General Permit NCG100000 and one (1) violation of Title 15A
NCAC 2B .0211(2) such that the best usage of surface waters were removed.
• July 26, 2006 —Green card indicated delivery of the assessment document.
Remission Request (Brief Summary)
• This case was contested in OAH, however that case was withdrawn by Mr. Hoyle King
on October 18, 2006 to instead request remission. Mr. Hoyle King was given thirty days

Mr. Jeff Tubiolo, speaking for Mr. Hoyle King, states that Mr. King sought his
assistance in complying with the DWQ NOVs. They developed a plan to remove the cars
from the stream and place them in a newly cleared area. The letter sent to DWQ on July
28, 2005 should have said "plan to reseed" instead of "had reseeded." In August, Mr.
Tubiolo went down to Louisiana and Mississippi to help clear debris, as that is his
business, and was gone for 7 months. Starting again in August of 2006 Mr. Tubiolo was
able to help Mr. King by moving cars, crushing and hauling cars, draining fluids and
property storing them, and in general trying to get Mr. King into compliance.
Included in the request is a Storm Water Plan and samples analyzed according to permit
requirements.

Notes: The PRO recommends remission in the amount of $4000.00 of the total $11,841.73 in
civil penalties in this enforcement case. This includes the $3000.00 in penalties for failure to do
the required analytical monitoring, and half of the $2000.00 levied for one (1) violation of
NCAC 2B .0211 (2) for the placement ofjunked cars in an unnamed tributary of Lake Michael,
such that the best usage of the surface waters were removed. The PRO recommends remission
of the remaining $6500.00 (excluding the $1341.73 in enforcement costs) if the following
conditions are met within six (6) months of the acceptance of this settlement:
Development of a Stormwater Pollution Prevention Plan that meets the requirements of
the general permit.
2. Qualitative monitoring must be performed as required by the general permit.
3. Removal of all junked vehicles still remaining within the stream on the site. (This work
must meet any riparian buffer requirements applicable).
4. Meeting the requirements of a follow-up compliance evaluation inspection in the fall of
2007.

Dear Ms. Higgins:
I am speaking for Mr. Hoyle King and my concems for this matter. I am a professional
logger by trade. I have also worked for many years with equipment, old cars and the land
we live on. I have bought parts from Mr. King for over 25 years. He always treated me
fare, although 1 never really knew him well. Approximately a year and half ago lie came
to me and asked for my help dealing with some of the problems he had with running his
business. I told him I would help him. At this time he had one person that was good help
but also had many health problems. After I looked at the physical situation of the yard
and the mandates by the state, I knew there was a lot of hard work that had to be done.
I made a plan. I knew we could not just pull the cars off the stream. Reason being there
was no place on the property to move these vehicles to. If you look at the aerial view of
the map you will see vehicles and where you see no vehicles you see trees. This aerial
view was taken in 2001. It was difficult to walk in there, much less move cars. My plan
was to clear one area of trees and goods not worth salvage for retail. This is the first
cleared area. While cleaning this area I piled all gas tanks, tires and salvaged goods.
Unfortunately while clearing this first area in the mist of high temperatures, the one good
employee Mr. King had, died of a massive heart attack while working with me. As I said
earlier, he was the only good help Mr. King had along with being a great person at heart.
It was hard loosing him, but we kept going on with the plan to comply with the state
mandate. I finishing clearing this area then I moved over 50 vehicles off the stream.
I must say I helped Mr. King with the letter to you saying we had moved over 50 cars off
the stream and reseeded it. In fact is should have stated plan to reseed, (that was the
plan). There never was any intent to mislead. It took some time to do this, along with
taking care of loose ends in my business. Unfortunately in the month of August,
Hurricane Katrina came ashore in Louisiana and Mississippi. I was asked to go help.
That is what I done for 7 months. Myjob was debris clean up. We finished 2 months
ahead of scheduled time. When I cam back home, Mr. King asked me to come back and
help him, I told him I would but had to take care of my own loose ends first. I was able
to start back with him in August. Since that time I have moved more cars off the stream
and wetland. 1 have also crushed and hauled cars. 1 have drained all fluids and properly
stored them, I set these storage tanks up before I went to Mississippi. I am trying to get
Mr. King in 100% compliance.

know him as an easy going person doing what lie loves and making his living with it. He
has never intended to disregard any agency. He is not much on letters, although not long -
ago he showed me a letter from a big firm looking to buy salvage yards. He never said
anymore about it, much less checked in to it. I have to say I have not helped him or
written this for any profit. I have nothing to gain. I have donated a lot of time and
money to this situation trying to help Mr. King to the best of my ability. I have come
forth to let you know there has been much hard work. Mr. King is trying hard to
understand and do the right thing.
We have put together what we were able to do for, a Storm Water Plan. We were hoping
i the lab test would be complete by the time we sent this. Unfortunately after 3 weeks and
3 test kits we finally got the last one right. It will be 10 days before the results are back.
I don't understand myself alot of the words on the permit, but I'm trying and learning.
What I do understand is BMT (Best Management Practice). We have strived for that goal
every day in our personal life and work life. l hope I have shed some light on what has
happened in the last year and a half, since I started helping Mr. King.
I asked that you take these facts in consideration on the remission request. I have also
had the opportunity to speak with some of your officers over the last year, Jim Green,
Cha Cobourne and Danny Smith by phone. I have spoke with all of them more than
once. They may be able to bear witness as to how hard we have tried to get within

been done and are being done.

A: Storage and loading area is as far back from stream as possible on west side of
Slaughter Road.
C: We are keeping a 30-foot buffer off the stream. We are also putting vegetative debris
cut over one year ago at the edge of the 30-foot buffer.

B: We have tank for gas, diesel, oil and anti -freeze. We have storage compartments for
batteries and a compartment for spill prevention, where we drain all fluids before loading
these tanks. This process has been in place since summer of 2005.

Your immediate attention to this matter is required. On July 24, 2006, the Director of the
Division of Water Quality (DWQ) assessed a civil penalty against you in the amount' of
$11,841.73, including $1,341.73 in investigative costs, for violations of General NPDES Permit
NCG100000 and stream standard violations. DWQ has the certified mail green card that shows
that you received the civil penalty assessment on July 26, 2006.
The civil penalty assessment document clearly stated that you had three options available within
thirty (30) days of your receipt, according to North Carolina General Statute 143-215.6A. You
could have paid the penalty, requested remission of the penalty, or filed a contested case petition
with the Office of Administrative Hearings. As of September 5, 2006, you have failed to act on
one of these options
Therefore, by State law, the full amount of the penalty is immediately due and payable.
This letter serves as final notice and that DWQ will refer your case to the North Carolina
Attorney General's Office unless payment is received within 20 (twenty) days of your
receipt of this notice. If necessary, the Attorney General's Office will rile a case against you
in Superior Court to collect the penal

Dear Ms. Higgins:
I am speaking for Mr. Hoyle King and my concerns for this matter. I am a professional
logger by trade. I have also worked for many years with equipment, old cars and the land
we live on. I have bought parts from Mr. King for over 25 years. He always treated me
fare, although I never really knew him well. Approximately a year and half ago he came
to me and asked for my help dealing with some of the problems he had with running his
business. I told him I would help him. At this time he had one person that was good help
but also had many health problems. After I looked at the physical situation of the yard
and the mandates by the state, I knew there was a lot of hard work that had to be done.
I made a plan. I knew we could not just pull the cars off the stream. Reason being there
was no place on the property to move these vehicles to. If you look at the aerial view of
the map you will see vehicles and where you see no vehicles you see trees. This aerial
view was taken in 2001. It was difficult to walk in there, much less move cars. My plan
was to clear one area of trees and goods not worth salvage for retail. This is the first
cleared area. While cleaning this area I piled all gas tanks, tires and salvaged goods.
Unfortunately while clearing this first area in the mist of high temperatures, the one good
employee Mr. King had,,died of a massive heart attack while working with me. As I said
earlier, he was the only good help Mr. King had along with being a great person at heart.
It was hard loosing him, but we kept going on with the plan to comply with the state
mandate. I finishing clearing this area then I moved over 50 vehicles off the stream.
I must say I helped Mr. King with the letter to you saying we had moved over 50 cars off
the stream and reseeded it. In fact is should have stated plan to reseed, (that was the
plan). There never was any intent to mislead. It took some time to do this, along with
taking care of loose ends in my business. Unfortunately in the month of August,
Hurricane Katrina came ashore in Louisiana and Mississippi. I was asked to go help.
That is what I done for 7 months. My job was debris cleanup. We finished 2 months
ahead of scheduled time. When I cam back home, Mr. King asked me to come back and
help him, I told him I would but had to take care of my own loose ends first. I was able
to start back with him in August. Since that time I have moved more cars off the stream
and wetland. I have also crushed and hauled cars. I have drained all fluids and properly
stored them, I set these storage tanks up before 1 went to Mississippi. I am trying to get
Mr. King in 100% compliance.
Mr. King is 85 years old with a six -grade education and has been in business for over 60
years. Mandates and ordinances have come upon him recently and rapidly. I've come to
know him as an easy going person doing what he loves and making his living with it. HC
has never intended to disregard any agency. He is not much on letters, although not long
ago he showed me a letter from a big firm looking to buy salvage yards. I-[e never said
anymore about it, much less checked in to it. I have to say I have not helped him or
written this for any profit. I have nothing to gain. I have donated a lot of time and
money to this situation trying to help Mr. King to the best of my ability. I have come
forth to let you know there has been much hard work. Mr. King is trying hard to
understand and do the right thing.
We have put together what we were able to do for a Storm Water Plan. We were hoping
the lab test would be complete by the time we sent this. Unfortunately after 3 weeks and
3 test kits we finally got the last one right. It will be 10 days before the results are back.
I don't understand myself a lot of the words on the permit, but I'm trying and learning.
What I do understand is BMT (Best Management Practice). We have strived for that goal
every day in our personal life and work life. I hope I have shed some light on what has
happened in the last year and a half, since I started helping Mr. King.
I Asked that you take these facts in consideration on the remission request. I have also
had the opportunity to speak with some of your officers over the last year, Jim Green,
Cha Cobourne and Danny Smith by phone. I have spoke with all of them more than
once. They may be able to bear witness as to how hard we have tried to get within

Concerning my justification for remission request, here are some of the things that have
been done and are being done.
PART 11 - 92
A: Storage and loading area is as far back from stream as possible on west side of
Slaughter Road.
C: We are keeping a 30-foot buffer off the stream. We are also putting vegetative debris
cut over one year ago at the edge of the 30-foot buffer.

A: Map
B: We have tank for gas, diesel, oil and anti -freeze. We have storage compartments for
batteries and a compartment for spill prevention, where we drain all fluids before loading
these tanks. This process has been in place since summer of 2005.
D: No spills or significant spill over in the past 3 years to my knowledge.

Acting pursuant to delegation provided by the Secretary of the Department of Environment and
Natural Resources, I, Tom Reeder, of the Division of Water Quality (hereby known as DWQ),
make the following:
FINDINGS OF FACT:
A. Mr. Hoyle M. King owns and operates an auto salvage yard known as King's
Used Cars located at 5609 US Highway 70 in Mebane, North Carolina within
Orange County.
B. Mr. Hoyle M. King is authorized to discharge stormwaterto receiving waters
designated as an unnamed tributary of Lake Michael, a class WS-ll, HQW, NSW
water in the Neuse River Basin.
C. On July 02, 2003, DWQ staff conducted a site inspection at King's Used Cars and
observed stained areas with oil and other vehicle fluids on site.
D. On August 19, 2003, DWQ issued a Notice of Violation for discharging
stormwater from a Used Motor Vehicle site to waters of the State without a
NPDES General Stormwater Permit.
E. Mr. Hoyle M. King was issued a Certificate of Coverage No. NCG 100160 on
January 16, 2004. The current Certi ficate of Coverage will expire on August 31,
2007.
F. On June 8, 2005, DWQ staff conducted a site inspection and observed that a copy
of the general permit NCG100000 was not on site and that the Stormwater
Pollution Prevention Plan had not been created. Additionally, DWQ observed
that fluids were not drained and stored from automobiles before they were

crushed.
G. Part III Section A.l of the Stonnwater General Pennit Number NCG100000
states: "The Stormwater Pollution Prevention Plan shall be developed and
implemented within 12 months of the effective date of the initial certificate of
coverage issued pursuant to this general permit and updated thereafter on an
annual basis."
H. On June 8, 2005, DWQ confirmed that for King's Used Cars, no analytical
monitoring, qualitative monitoring, or monitoring inspections records were
performed. From January 16, 2004 to June 8, 2005 no inspection records,
analytical monitoring or qualitative monitoring results were available for review.

K. On June 8, 2005, DWQ staff observed junked cars placed directly in the unnamed
tributary to Lake Michael.
L. Title 15A North Carolina Administrative Code 2B .0211 (2) requires that "The
waters shall be suitable for aquatic life propagation and maintenance of biological
integrity, wildlife, secondary recreation, and agriculture; sources of water
pollution which preclude any of these uses on either a short -tern or long-term
basis shall be considered to be violating a water quality standard;"
M. On June 10, 2005, DWQ issued a Notice of Violation to King's Used Cars. The
NOV noted violations for the Oil Pollution and Hazardous Substances Control
Act.
N. On June 20, 2005, DWQ issued a Notice of Violation (NOV) and Notice of Intent
to Enforce to Mr. Hoyle King. The NOV noted violations for NPDES Permit
NCG100000 for failure to develop a Stormwater Pollution Prevention Plan and
for failure to monitor and perform sampling in addition to placingjunked cars in
the UTto Lake Michael. DWQ requested that Mr. Hoyle King respond in writing
to these violations.

O. On July 28, 2005, Mr. Hoyle King responded to the NOV stating that he had
removed approximately 50 cars from the stream area and that he reseeded the
area. He stated that he gathered all tires and gas tanks and that he was organizing
shelters for parts and setting up a loading area with storage tanks and spill
prevention kits. He included a diagram of his property.
P. On March 21, 2006 and March 28, 2006, DWQ staff observed thatjunked cars
still remained in the unnamed tributary to Lake Michael. Soil and stream samples
were collected from the property. Four soil samples were evaluated for oil and
grease concentrations and all four results were above the 250 ppm action level.
Q. On May 19, 2006, DWQ issued a Notice of Violation and Notice of Intent to
Enforce to Mr. Hoyle King. The NOV noted violations for NPDES Permit
NCG100000 for not submitting qualitative or quantitative monitoring data, for
failure of preventing automotive fluids from leaching into soil, and for placing
junked cars in the unnamed tributary to Lake Michael. DWQ requested that Mr.
Hoyle King respond in writing to these violations.
R. The costs to the State of the enforcement procedures in this matter totaled
1,341.73.
Based upon the above Findings of Fact, I make the following:
IL CONCLUSIONS OF LAW:
A. Mr. Hoyle M. King is a "person" within the meaning of North Carolina General
Statute (hereby known as NCGS) 143-215.6A pursuant to NCGS 143-212(4).
B. Under NCGS 143-215.1, a permit is required to cause or permit discharges
regulated under NCGS 143-214.7.
C. The General Stormwater NPDES General permit NCG100000 was issued to Mr.
Hoyle M. King in accordance with NCGS 143-215.1 and 15A NCAC 2H .0126.
D. The unnamed tributary of Lake Michael constitutes waters of the State within the
meaning of NCGS 143-215. 1 (a)(1) pursuant to NCGS 143-212(6).
E. Mr. Hoyle M. King failed to develop a Stormwater Pollution Prevention Plan
within 12 months of the effective date of the initial certificate of coverage, a
violation of Part III, Section A.l of General Permit No. NCGI00000.

H. Mr. Hoyle M. King failed to monitor the Total Recoverable Lead, a violation of
the monitoring requirement set forth in General Permit No. NCG100000 Part II,
Section B.
1. Mr. Hoyle M. King failed to monitor the Total Suspended Solids, a violation of
the monitoring requirement set forth in General Permit No. NCG100000 Part 11,
Section B.
Mr. Hoyle M. King failed to monitor the Ethylene Glycol, a violation of the
monitoring requirement set forth in General Permit No. NCG100000 Part 11,

K. Mr. Hoyle M. King failed to monitor Total Toxic Organics, a violation of the

N. Mr. Hoyle M. King failed to monitor the Total Flow, a violation of the monitoring
requirement set forth in General Permit No. NCG100000 Part 11, Section B.
O. From January 16, 2004 to June 8, 2005, Mr. Hoyle M. King failed to perform and
to keep records of qualitative monitoring of the Stonnwater Discharge Outfalls
(SDOs), a semi-annual monitoring requirement set forth in Part 11, Section C of
General Permit No. NCG 100000.
Mr. Hoyle M. King violated NCAC 15A 213.0211 (2) by placingjunked cars in an
unnamed tributary to Lake Michael, such that the best usage of the surface waters
were removed.
Q. Mr. Hoyle M. King may be assessed civil penalties in this matter pursuant to
NCGS 143-215.6A(a)(2), which provides that a civil penalty of not more than

twenty-five thousand dollars ($25,000) per violation per day may be assessed
against a person who is required but fails to apply for or to secure a pennit
required by NCGS 143-215.1, or who violates or fails to act in accordance with
the terms, conditions, or requirements of such permit or any other permit or
certification issued pursuant to authority conferred by this Part.
R. Mr. Hoyle M. King may be assessed civil penalties in this matter pursuant to
NCGS 143-215.6A(a)(1), which provides that a civil penalty of up to twenty-five
thousand dollars ($25,000.00) per violation may be assessed against a person who
violates any classification, standard, limitation, or management practice
established pursuant to NCGS 143-215, 143-215.1, 143-215.3.
S. The State's enforcement costs in this matter may be assessed against Mr. Hoyle M.
King pursuant to NCGS 143-215.3(a)(9) and NCGS 14313-282.1(b)(8).
T. Tom Reeder of the Division of Water Quality, pursuant to delegation provided by
the Secretary of the Department of Environment and Natural Resources, has the
authority to assess civil penalties.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

Pursuant to NCGS 143-215.6A(c), in determining the amount of the penalty I have taken into
account the Findings of Fact and Conclusions of Law and the factors set forth at NCGS 14313-
282. 1 (b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the public
health, or to private property resulting from the violation;
(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) "The amount of money saved by noncompliance;
(6) Whether the violation was committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs
over which the Environmental Management Commission has regulatory authority;
and
(8) The cost to the State of the enforcement procedures.

For each parameter, the arithmetic mean of all analyticat sampling results collected during the
coverage of the pen -nit shall be calculated for each individual outfall. The computed arithmetic
mean is then compared to the cut-off concentrations listed below in Table 2. If the arithmetic
mean is less.than the specified cut-off concentration for a given parameter, then the facility is not
required to continue annual analytical monitoring for that parameter (at that outfall) during the
remaining coverage of the permit unless a significant change in facility operations or
configuration occurs. If a cut-off concentration results in discontinued analytical monitoring at
an individual discharge outfall, the pennittee is required to maintain facility operations that
ensure the continuation of stormwater runoff quality.
The pennittee must perform analytical sampling during the first and last year of the permit
coverageegardless of cut-off concentration conditions. Analytical results from sampling during
the final year of the permit coverage must be submitted with the permit renewal application. All
analytical monitoring shall be performed during a representative storm event.

1 Measurement Frequency: Once per year during a representative storm event. A year is defined as the 12 month
period beginning on the month and day of issuance of the Certificate of Coverage.
2 If the stormwater runoff is controlled by a stormwater detention pond, a grab sample of the discharge from the
pond shall be collected within the first 30 minutes of discharge. If the detention pond discharges only in response
to a storm event exceeding a ten year design storm, then no analytical monitoring is required and only qualitative
monitoring shall be performed.
3 Sample Location: Samples shall be collected at each star mwater discharge outfall (SDO) unless representative
outfall status has been granted.
4 For each sampled representative storm event the total precipitation, storm duration, and total flow must be
monitored. Total flow shall be either: (a) measured continuously, (b) calculated based on the amount of area
draining to the outfall, the amount of built -upon (impervious) area, and the total amount of rainfall, or (c)
estimated by the measurement of Flow at 20 minute intervals during the rainfall event.

SECTION C: QUALITATIVE MONITORING REQUIREMENTS
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless of
representative outfall Status and shall be performed as specified below in Table 3. Qualitative
monitoring is for the purpose of evaluating the effectiveness of the Stonnwater Pollution
Prevention Plan (SPPP) and assessing new sources of stormwater pollution. No analytical tests
are required. Qualitative monitoring of stormwater outfalls does not need to be performed during
a representative storm event.
The first qualitative monitoring event during the coverage of the permit must coincide with the
initial analytical monitoring event (regardless of the season). All other qualitative monitoring will
be performed twice per year, once in the spring (April - June) and once in the fall (September -
November).

Division of Water Quality (DWQ) assessed a civil penalty against you in the amount of
$11,841.73, including $1,341.73 in investigative costs, for violations of General NPDES Permit
NCG100000 and stream standard violations. DWQ has the certified mail green card that shows
that you received the civil penalty assessment on July 26, 2006.
The civil penalty assessment document clearly stated that you had three options available within
thirty (30) days of your receipt, according to North Carolina General Statute 143-215.6A. You
could have paid the penalty, requested remission of the penalty, or filed a contested case petition
with the Office of Administrative Hearings. As of September 5, 2006, you have failed to act on
one of these options
Therefore, by State law, the full amount of the penalty is immediately due and payable.
This letter serves as final notice and that DWQ will refer your case to the North Carolina
Attorney General's Office unless payment is received within 20 (twenty) days of your
receipt of this notice. If necessary, the Attorney General's Office will file a case against you
in Superior Court to collect the penal

I am in receipt of your letter. It is my intention to comply with all standards that I must
meet. I would however like to state I am 84 years old and have been in business nearly
60 years. I don't quiet understand all the requirements of today, but am seeking solutions
to the problems.
The reason the work on my property slowed down was the two gentlemen I had hired on
the cleanup, one passed away and the other has been working the hurricane cleanup in
Mississippi. He has now just returned and has agreed to comeback to work for me to
help in the compliance of the standards I must now meet.
I am planning on making major improvements and complying with all standards.

On June 8, 2005 a compliance inspection of King's Used Cars was conducted with the assistance of Mr. Hoyle
King, owner of the facility. During the inspection it was discovered that Mr. King was not operating his junkyard
in accordance with his stormwater permit, NCG 100160.
Mr. King was missing all pertinent information regarding his permit including: a copy of his NPDES permit, all
facets of the stormwater pollution prevention plan (SPPP), and qualitative and quantitative monitoring. In
addition, Mr. King was not draining any automotive fluids prior to crushing. He was allowing oil, transmission
and brake fluid to spill to the ground where it could either leach into the soil and potentially impact the
groundwater or wash to an unnamed tributary (UT) to Seven Mile Creek that originates on his property.
Furthermore, Mr. King had placed numerous junked cars directly onto the UT.
The Division issued a Notice of Violation (NOV) to Mr. King on June 10, 2005, citing violations of NCGS 143-
215.83, NCGS 143-215.84, and NCGS 143-215.85. A Notice of Intent (NOf) was also issued to Mr. King on
June 20, 2005 for violations of Part II, Sections A and B, Part III, Sections A, C, D, and E of his NPDES permit,
NCGS 143-215.1 (a2), and again, NCGS 143-215.83, .84, and .85.
On July 28, 2005 Mr. King responded to the NOI and stated that he was working to meet compliance with all
items listed in the letter. He also stated that he began collecting car fluids and that he would remove all of the
junked cars from the stream.
On March 21 and March 28, 2006 DWQ staff visited King's Used Cars to grab soil and stream samples and to
inspect the progress of Mr. King's proposed plan. Mr. King did not remain on -site during the inspection so there
was no way to validate the existence of any records, but it should be mentioned that the Division has yet to
receive the required monitoring data. During the inspection DWQ staff noticed that several junked cars and other
debris still remained in the stream. The results of the soil and stream samples also indicate that Mr. King was not
properly collecting vehicle fluids and that the UT to Seven Mile Creek had been adversely impacted by the junk
yard. Four oil and grease samples were taken of the soil, all of which exceeded the action level of 250 ppm
(results: 16,100 ppm, 395 ppm, 452 ppm, 320 ppm). The results of the stream sample yielded a high level of iron
(2.7 mg/L vs. 1 mg/L action level). An additional NO[ dated May 19, 2006 was sent to Mr. King as a result of the
inspections and laboratory results.
For these reasons, I recommend that DWQ proceeds with enforcement against Mr. King for his violations of
NCGS 143-215.1 (a2), NCGS 143-215.83, NCGS 143-215.84, NCGS 143.215.85, and Part II, Section B of

SUMMARY

NPDES permit, NCGS 143-215.1 (a2), NCGS 143-215.83, NCGS 143-215.84, and NCGS 143-215.85.
In response to the NOI, Mr. King sent in a letter detailing his plans to remove all of the cars from the
creek and professing his intent to abide by his issued permit.
On March 21 and March 28, 2006 DWQ staff visited King's Used Cars to grab soil and stream samples

fluids. Four oil and grease samples were taken of the soil, all of which exceeded the action level of 250
ppm (results: 16,100 ppm, 395 ppm, 452 ppm, 320 ppm).
For these reasons, I recommend that DWQ proceeds with enforcement against Mr. King for his violations
of NCGS 143-215.1 (a2), NCGS 143-215.83, NCGS 143-215.84, NCGS 143.215.85, and Part I1, Section
B of NPDES permit number NCG100160.
The Division is concerned that if the Mr. King continues to disregard his permit, the UT to Seven Mile
Creek will face further potential adverse impacts.
ASSESSMENT FACTORS
1) The degree and extent of harm to the natural resources of the State, to the public health, or
to private property resulting from the violation;
Cars and other debris were placed on and in the unnamed tributary (UT) to Seven Mile Creek.
Such illegal disposal led to an elevated level of iron in the water (2.7 mg/L vs. 1.0 mg/L
action level). Also, oil and other automotive fluids were not properly drained from vehicles

prior to crushing. This allowed the fluids to not only potentially enter the groundwater via
leaching through the soil, but it also increased the possibility for such fluids to be washed to
the UT.
2) The duration and gravity of the violation;
Mr. King has been operating hisjunkyard in this manner since its inception in 1948. He has also
been issued 4 NOVs/NOts since 2003 and has never fully complied with Division requests.
3) The effect on ground or surface water quantity or quality or on air quality;
Stream samples yielded a 2.7 mg/L iron concentration (1.0 mg/L action level).
Soil samples yielded oil and grease concentrations of 16,100 ppm, 395 ppm, 452 ppm, and 320
ppm (250 ppm action level).
4) The cost of rectifying the damage;
Mr. King will have to pay for site remediation. Such clean-up will include digging up the soil till
oil and grease levels are below action level (250 ppm), and removing all debris and cars from the
UT.
5) The amount of money saved by noncompliance;
Mr. King financially benefited from the violations by his significant neglect of his permit. In
addition, Mr. King saved money by not properly cleaning up the site and conducting the
appropriate site remediation.
6) Whether the violation was committed willfully or intentionally;
Mr. King has been issued numerous NOVs/NOIs requesting him to fully clean his site. He
persistently ignores the Division's requests.
7) The prior record of the violator in complying or failing to comply with programs over
which the Environmental Management Commission has regulatory authority; and
Mr. King has been issued 4 NOVs/NOls since 2003, all of which have been related to stormwater
violations and oil spills:

Mr. King has only responded to one issued NOV (dated June 20, 2005). In that letter he stated
that he was going to remove all cars and debris from the UT and would also begin collecting
fluids from his vehicles. He also stated that he would begin to abide by his issued permit.
While Mr. King has removed numerous cars, there are still several remaining in the creek (as of
March 2006). Also, soil samples taken from the property indicate that he is not properly
disposing of fluids as he claims.
