This, permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated December 6. 1983. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to request an individual permit by submitting an individual permit application. Unless such demand is made, this certificate of coverage shall be final and binding. Please take notice that this certificate of coverage is not transferable. except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. The site visit was in response to a compliant about an oil spill at the site. Stormwater General Permit NCGI O0160 was issued to Kings Used Cars, Mr. Hoyle King, in 2004, and was automatically renewed in 2007, and expires October 31, 2012. Specifically, the General Permit (NCG 100000) authorizes the discharge of stormwater under the National Pollutant Discharge Elimination System (NPDES) in accordance with Title 15A North Carolina Administrative Code 2H.0100. The following violations (please see the attached addendum for information about your permit) were noted during the Division of Water Quality inspection: 1) Stormwater Pollution Prevention Plan (SPPP) Section A (2) (5)(8)(9) The Raleigh Regional Office mailed a copy of the SPPP to Ray and .limmy King on June 22, 2011, after the site visit, as no copy was available on site the day of the inspection. a) The site was found in violation of Part 11, Section A (2) secondary containment requirements and records. The secondary containment was blocked by equipment and salvage, the day of the inspection, such that it could not be accessed or used by the permittee. No records were available. Oil spills greater than or equal to 25 gallons, and spills, regardless of the amount, that causes a sheen on surface waters are required to be reported to NC Emergency Management (after hours) or NC DENR Regional Office (during regular hours) within 24 hours of the spill. The spill must be cleaned up immediately to avoid runoff to the surface waters. A person who has control over petroleum that is discharged into the environment must immediately take measures to collect and remove the discharge. Photos are attached of the unreported oil spill observed on site the day of the inspection. Required Response As listed above, the NCG100000 stormwater permit requires inspection, sampling and record keeping. The oil soaked into the ground at the driveway entrance. It appears, that the permittee has failed to implement the SPPP, based on the items above marked with a no, that have yet to be completed as required. There was no available Stormwater Pollution Prevention Plan (SPPP) Documentation as required by your NPDES permit. No analytical or qualitative monitoring has ever been conducted at the site. According to the permit, you are required to sample and analyze your stormwater once per year and qualitatively monitor all discharges twice per year. Such monitoring is necessary to ensure the quality of the stormwater originating from your property. If analytical results are above cut-off concentrations, the stormwater will likely be detrimental to the environmental conditions of the surrounding area. 4. Such practices allows for the fluids to leach into the soil and possibly contaminate the groundwater. Those fluids that do nol seep into the soil have the potential to be washed into and perhaps contaminate the UT. North Carolina General Statute 143-215.88A provides that any person who intentionally or negligently discharges oil or other hazardous substances or fails to report a discharge as required by G.S. 143-215.85 or who fails to comply with requirements of G.S. 143- 215.84(a) may incur in addition to any other penalty provided by law, a penalty in an amount not to exceed five thousand dollars for every such violation. G.S. 143-215.6A provides for a civil penalty of up to $25,000 per day for discharges which require but have not been issued an NPDES Permit. All automotive fluids must be drained and properly stored. The storage details are included in the permit. 5. Periodically, Peterson Concord collects the used lead acid batteries. While no batteries were visible (due to a recent visit by Peterson Concord), the details as to how they are collected and stored on -site are required and should be submitted to the RRO. 6. While examining the conditions of the UT, numerous junked cars were discovered sitting in the streambed, some of which were directly placed on top of the stream. The cars are a potential threat to the health of the environment as they may contaminate the UT that feeds into Lake Michael. By hindering the integrity of the stream, the conditions of Lake Michael will worsen as a result. The cars and all other debris must be removed from the stream and the areas immediately surround the stream. If violations of stream standards exist, the Division may pursue further enforcement against King's Used Cars. Please respond to the above mentioned issues. We will need a schedule or plan as to how you will obtain all of the required materials within the SPPP plan including: a general location map, a narrative description of maintenance practices, a site map that details all industrial locations and stormwater discharge locations, a Best Management Practices (BMPs) summary, and a spill prevention and response plan. Please respond in writing within 30 days of receipt of this letter with a progress report, noting the specific changes / upgrades that you expect to make. King Operating Without a Stormwater Permit Orange County Dear Hoyle M. and Lillian W. King: It has come to the attention of the North Carolina Division of Water Quality that the King Property has not obtained a Stormwater Permit for the site at 5609 US Highway 70 in Mebane, North Carolina. The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act (1972) and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES Phase I permitting program for stormwater discharges was established in 1990. Phase I focused on site and operations planning to reduce pollutant sources. One of the industries that Phase 1 regulates through NPDES permits is Used Motor Vehicle Parts, SIC Code 5015, and Automotive Wrecking for Scrap, SIC Code 5093. A General Permit (No. NCG100000) became effective September 1, 1992. The discharge of stormwater from a Used Motor Vehicle site to waters of the State without a permit is a violation ofNCGS 143-215.1(a)(1). This office is considering recommending to the Director of the Division of Water Quality that civil penalties be assessed against your company for these violations. NCGS 143-215.6 provides that violations of 143-215.1 may incur civil penalties up to $25,000 per violation per day. Any response submitted to this office within 10 days of receipt of this letter will be considered when making the recommendation. On July 22, 2003 Mr. Joe Albiston conducted a site visit to the King Property. Stained areas with oil and other vehicle fluids throughout the site constitute a direct violation of North Carolina General Statute 143-215.83, which states in part that it is unlawful to discharge oil or other hazardous substances onto or upon any waters or lands of the state. General Statute 143-215.84 requires the person having control over the oil or hazardous substance discharged shall immediately undertake to collect and remove the discharge and to restore the area affected by the discharge as nearly as possible to the condition existing prior to the discharge. Thank you for meeting with us - your presence was appreciated as it facilitated the inspection process. The following observations were made: There was no copy of NPDES Permit NCGIO0160 on -site. A copy of general permit NCG100000 was provided to you and the DWQ inspectors reviewed the pertinent information with you. You were advised to contact DWQ staff if you had any questions regarding the permit. 2. There was no available Stormwater Pollution Prevention Plan (SPPP) Documentation as required by your NPDES permit. The SPPP was supposed to be developed and implemented within 12 months of the effective date of your permit. The details of the SPPP are included in the permit given to you and include (but not limited to): a site plan, a stormwater management plan, a spill prevention and response plan, a maintenance program, employee training, etc. Please refer to the permit for details. 3. No analytical or qualitative monitoring has ever been conducted at the site. According to the permit, you are required to sample and analyze your stormwater once per year and qualitatively monitor all discharges twice per year. Such monitoring is necessary to ensure the quality of the stormwater originating from your property. If analytical results are above cut-off concentrations, the stormwater will likely be detrimental to the .environmental conditions of the surrounding area. 4. Such practices allows for the fluids to leach into the soil and possibly contaminate the groundwater. Those fluids that do nol seep into the soil have the potential to be washed into and perhaps contaminate the UT. North Carolina General Statute 143-215.88A provides that any person who intentionally or negligently discharges oil or other hazardous substances or fails to report a discharge as required by G.S. 143-215.85 or who fails to comply with requirements of G.S. 143- 215.84(a) may incur in addition to any other penalty provided by law, a penalty in an amount not to exceed five thousand dollars for every such violation. G.S. 143-215.6A provides for a civil penalty of up to S25,000 per day for discharges which require but have not been issued an NPDES Permit. All automotive fluids must be drained and properly stored. The storage details are included in the permit. 5. Periodically, Peterson Concord collects the used lead acid batteries. While no batteries were visible (due to a recent visit by Peterson Concord), the details as to how they are collected and stored on -site are required and should be submitted to the RRO. 6. While examining the conditions of the UT, numerous junked cars were discovered sitting in the streambed, some of which were directly placed on top of the stream. The cars are a potential threat to the health of the environment as they may contaminate the UT that feeds into Lake Michael. By hindering the integrity of the stream, the conditions of Lake Michael will worsen as a result. The cars and all other debris must be removed from the stream and the areas immediately surround the stream. If violations of stream standards exist, the Division may pursue further enforcement against King's Used Cars. Please respond to the above mentioned issues. We will need a schedule or plan as to how you will obtain all of the required materials within the SPPP plan including: a general location map, a narrative description of maintenance practices, a site map that details all industrial locations and stormwater discharge locations, a Best Management Practices (BMPs) summary, and a spill prevention and response plan. Please respond in writing within 30 days of receipt of this letter with a progress report, noting the specific changes / upgrades that you expect to make. While the Carolina Auto Recyclers Association website, httn:H/ vww.carolinaautorecyclers.com, has some helpful guidance for stormwater compliance, we strongly urge that you hire a consultant to help develop the SPPP and to also provide the analytical monitoring services required to fulfill the conditions of your permit. Klimek, P.E, Director Division of Water Quality On June 9, 2005 Christopher Wu, Jimmie Greer, and Chad Coburn of the Raleigh Regional Office conducted a compliance evaluation inspection of King's Used Cars with the assistance of Will Autry and Michael Harvey of the Orange County Planning Department. Thank you for meeting with us - your presence was appreciated as it facilitated the inspection process. The following observations were made: There was no copy of NPDES Permit NCGIO0160 on -site. A copy of general permit NCG100000 was provided to you and the DWQ inspectors reviewed the pertinent information with you. You were advised to contact DWQ staff if you had any questions regarding the permit. 2. There was no available Stormwater Pollution Prevention Plan (SPPP) Documentation as required by your NPDES permit. The SPPP was supposed to be developed and implemented within 12 months of the effective date of your permit. Tile details of the SPPP are included in the permit given to you and include (but not limited to): a site plan, a stormwater management plan, a spill prevention and response plan, a maintenance program, etc. Please refer to the permit for details. No analytical or qualitative monitoring has ever been conducted at the site. According to the permit, you are required to analytically monitor your stormwater once per year and qualitatively analyze all discharges twice per year. Such monitoring is necessary to ensure the quality of the stormwater originating from your property. If analytical results are above cut-off concentrations, the stormwater will likely be detrimental to the environmental conditions of the surrounding area. 4. There are no clearly identified points of stormwater discharge. It is required by permit that these points be identified so that they may be evaluated for integrity. Stormwater is allowed to run freely throughout the property and has the potential to contaminate the UT as well as the groundwater. 5. Automotive fluids (including oil, transmission fluid, brake fluid, and freon) were not drained from the cars and properly stored prior to crushing. Such practices allows for the fluids to leach into the soil and potentially contaminate the groundwater. Those fluids that do not seep into the soil can be washed into the UT. North Carolina General Statute 143-215.88A provides that any person who intentionally or negligently discharges oil or other hazardous substances or fails to report a discharge as required by G.S. 143-215.85 or who fails to comply with requirements of G.S. 143-215.84(a) may incur in addition to any other penalty provided by law, a penalty in an amount not to exceed five thousand dollars for every such violation. G.S. 143-215.6A provides for a civil penalty of up to $25,000 per day for discharges which require but have not been issued an NPDES Permit. All automotive fluids must be drained and properly stored. The storage details are included in the permit. 6. Lead acid batteries are not stored on -site. Periodically, Peterson Concord collects the used batteries. While examining the conditions of the UT, numerous junked cars were discovered sitting in the streambed, some of which were directly placed on top of the stream. The cars are an obvious threat to the health of the environment as they contaminate the UT that feeds into Lake Michael. By hindering the integrity of the stream, the conditions of Lake Michael will worsen as a result. The cars and all other debris must be removed from the stream and the areas immediately surround the stream. Please provide a copy of all the required materials within the SPPP plan including: a general location map, a narrative description of maintenance practices, a site map that details all industrial locations and stormwater discharge locations, a Best Management Practices (BMPs) summary, and a spill prevention and response plan. Please respond in writing within 30 days of receipt of this letter with a progress report, noting the specific changes / upgrades that you expect to make. While the Carolina Auto Recyclers Association website, http://www.carolinaautorecyclers.com, has some helpful guidance for stornwater compliance, we strongly urge that you hire a consultant to help develop the SPPP and to also provide the analytical monitoring services required to fulfill the conditions of your permit. Stormwater Control Rules POSTED: 7:06 a.m. EDT August 12, 2003 CHARLOTTE, N.C. -- North Carolina county commissioners and other groups plan to challenge rules that for the first time would require smaller communities to control stormwater pollution. The state Environmental Management Commission adopted rules in July that would force 123 municipalities and 33 counties to start new stormwater programs. The rules follow a 1999 federal law. The rules would require containment structures, such as settling ponds, when construction disturbs an acre or more and exceeds certain building densities. They also call for 30-foot buffer zones around waterways. On the coast, the rules also ban new discharges to shellfish waters. Rain sweeps everything on the ground's surface into waterways. Runoff, which includes stormwater, is the nation's leading source of water pollution. North Carolina's largest cities started stormwater programs a decade ago. The rules can't take effect in August 2004 until they pass a legislative review panel and the General Assembly. Groups opposed to the changes hope to alter them at these hurdles. The first stop is before the Rules Review Commission on Aug. 21. The commission's role is to decide whether the environmental panel followed procedures and had the authority to enact the regulations. It must also agree that the rules are both necessary and unambiguous. The North Carolina Association of County Commissioners says the state was wrong to include counties under its stormwater rules. The commissioners' association will ask the review board to overturn the rules and declare that the EMC lacks authority to impose them on counties. Bradley Bennett, the state Division of Water Quality's stormwater supervisor, said the rules properly cover counties because they have land -use authority to regulate stormwater. Including counties also allows for the uniform control of stormwater that the federal law intended, he said. The North Carolina Home Builders Association will argue that the commission went beyond federal requirements. Some of those requirements aren't achievable, the builders say, and the rules don't acknowledge differences in local conditions.
