Dear Mr. Cutler:
You have our approval, in accordance with the attached conditions and those fisted below, to impact approximately 800
square feet of the protected riparian buffers to construct the proposed dock/boardwalk as described within your
application dated October 22, 2002. This letter shall act as your approved Authorization Certificate for impacts to the
protected riparian buffers as required under the Neuse River Buffer Protection Rules (15A NCAC 2B .0233). In addition,
you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your
project including (but not limited to) CAMA regulations and any outstanding violations from the Washington Regional
Office of the Division of Water Quality (DWQ) or the Division of Coastal Management (DCM).
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and is thereby responsible for complying with all conditions. For this approval to be valid,
you must follow the conditions listed in the Neuse Buffer Rule.
If you do not accept any of the conditions of this certif ication, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

As per my discussions with Tom Steffens, enclosed is a Pre-Construction Notification
application to be used to issue a Certificate of Authorization. (Buffer Rule Approval)
The letter from Jim Mulligan (copy enclosed) was dated October 3, 2002 but we did not
receive it until October 21, 2002. (I had called Tom early last week an told him the letter
had not been received. He was going to send another copy. Do not know if this letter is a
copy or the original.)
There was no intent to install the decking without a permit. Suffice to say, there was
some misunderstandings between the Town, the developer of the Oriental Harbor and
DCM. I can assure you, this will not happen in the future

A recent site visit by Tom Steffens from the Division of Water Quality has determined that the recent
construction of a dock/boardwalk adjacent to the towns' dingy dock has been built without obtaining the
necessary permits.
The Division of Water Quality has determined that the construction of the boardwalk in the riparian buffer is an
allowable project with a Certificate of Authorization from the Division of Water Quality. Failure to obtain this
Certificate before beginning construction is a violation of the Neuse River Buffer Rules (15A NCAC 2B .0233).
The Division of Water Quality requires the Town of Oriental to address this issue by submitting a Pre-
Construction Notification package to the Division within 15 days of receipt of this letter. Please notify the
Washington Regional Office of the Division of Water Quality that you have complied with this request via
written response within the allotted time. The Pre-Construction Notification (PCN) package can be downloaded

the address in Raleigh and not to the Regional Office.

at the time of this application: Prior to the wood decking being installed, the area was a
combination of spolly lawn grass sand and dirt. The area had a fair amount of walking
traffic.

10. Describe the overall project in detail, including the type of equipment to be used: 6" wood
pilings were driven, then 2 x 10 were attached. 2 x 8 marine grade pressure treated wood
decking was nailed to the 2 x 10's. A wood safety rail was installed also
11. Explain the purpose of the proposed work: The decking of the area at the dingy docks ties
into the boardwalk (same material & design) being constructed by the Oriental Harbor
Project. The decking w?as approved by the Town Board. The boardwalk is for public access
as is the dingy dock. It made sense to connect the two at the water front.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at

construction dates to allow processing time for these permits. However, an applicant may

Threatened Species, accessibility problems, or other issues outside of the applicant's control).
The dingy dock decking was shown on the application by Oriental Harbor. Our understanding
was that the decking was allowed There was no intent to construct without a permit.
