Rescission of NPDES Permit

It is the understanding of the Division that the subject facilities are located on Fort Bragg Military
Reservation and will accordingly be covered by the new Fort Bragg industrial stormwater permit. In
accordance with this information, NPDES General Per -nuts NCGO80566 and NCGO80497 are rescinded,
effectively immediately,
Please be advised that these permit rescissions are based wholly upon the activities which would require
general permit coverage at the site have or will be covered by the new stormwater permit for Fort Bragg.
Division staffhas not visited the site to obtain independent verification. Operating a treatment facility,
discharging wastewater or discharging stormwater to waters of the State without a valid NPDES Permit
will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be
certain for persons that have voluntarily relinquished pernut coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the sites still require permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES Permit.

Your facility is currently covered for stormwatcr discharge under Gencral Pci alit NCG080000. 'this permit expires
on August 31, 2002. "I'hc Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by ]Zile summer of 2002. Once the permit is reissued, your facility would be eligible for
continual covcragc under the reissued pernlil.
In order to assure your continued covcragc Under file general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance thal your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be corupleled and returned by March 4, 2(X)2 in order lu assure continual
coverage under tire general permit
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwatcr front your facility
without coverage under a valid stormwatcr NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil I hies of up h $10,000 per day.
Please note that recent Icdo-al legislalion has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I calegories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "nn axposure", i.e. the facilty industrial
materials and operations are not exposed to stormwatcr, you can apply for the no exposure exclusion. For additional
