The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the revised permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. No vegetated wetlands will be excavated or filled. Creedon 4801 Meadow Court Drive New Bern, NC, 28562 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Creedon: You have our approval, in accordance with the attached conditions, to place fill in 0.025 acre of non-vegetated wetlands and to shade or usurp 0.36 acre of non-vegetated wetlands in order to stabilize the shoreline and construct a pier with a T-head and six finger piers on Brices Creek in Craven County, as described in your application received by the Division of Water Quality on November 1, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http,//h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; If ypu do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The proposed structure would provide slips for 10 vessels. I NBYC Properties, LLC Craven County Project Setting The applicant owns a 0.75-acre tract of land adjacent to Brices Creek near New Bern in Craven County, North Carolina. The property is on the east bank of the creek and has an elevation of approximately 7 feet above sea level. The property is located approximately 2.5 miles west of the confluence of Brices Creek and the Trent River. A frame house and a single-wide mobile home provided residences for the previous property owners. At this time, the house has been converted to a clubhouse and the mobile home has been removed from the property. The 5-foot high shoreline drops quickly to the water and there are no wetlands on the property. The opposite side of the creek is vegetated with coastal wetland species including Spartina cynosuroides, Juncus roemerianus, Spartina patens and Distichlis spicata The project area is bordered on the north and south by developed residential properties. There are single-family residences on both lots. The lots are vegetated with mixed pines and oaks with some shrubby understory. There are maintained lawns close to the residences; however there are wooded buffers between the houses and the NBYC property. The wooded areas are vegetated with pines, Smilax, poison ivy, wax myrtles, and shrubby hardwood species. Brices Creek forms the western border of the property. Water depths in the area of the proposed pier range from -19 feet NWL at the waterward end of the structure to -2 to -8 feet on the landward side of the proposed T-head. Brices Creek is 280 feet wide at the project property. The property is located on the inside of a turn in the creek, and the deep water channel is located on this side of the waterbody. The opposite shoreline contains expansive coastal wetlands, and shallow water extends several feet into the waterbody. NC State Road 1004 defines the eastern border of the property. This road is the only access to several residential neighborhoods upstream of the project property. Brices Creek is classified SA SW NSW by the Environmental Management Commission and is closed to shell fishing at this location. The property is located in the Neuse River Basin, and is subject to the Environmental Management Commission's (EMC) Neuse River Basin Nutrient Sensitive Waters Management Strategy. Project Description The applicant proposes to construct a 40' long by 6' pier with a 6' by 184'T-head that would be positioned parallel to shore. Six 20' by 3' finger piers would project perpendicular to the T-head and would define the slips. As proposed, the pier would provide slips for 10 vessels. The entire structure would project 66 feet waterward of the normal water level. The applicant proposes to stabilize the shoreline by installing masonry riprap five feet waterward of the normal water level. The riprap would extend landward, up the bank, for an additional four feet. Filter fabric would be installed under the riprap, and clean backfill would be placed as needed. Parking for pier users will be provided in the grassy area adjacent to the clubhouse and on the existing gravel drive. No formal NBYC Properties, LLC Craven County Page 2 parking area is proposed. The riprap is the only development proposed within the EMC's 50'Neuse River Basin Buffer. Anticipated Impacts The project as proposed would impact 17,845 ft2. The pier and associated slips would usurp 15,900 ff? of public trust area, of which, 2,064 ftz of creep bottom would be shaded by the walkway and finger piers. Placement of the riprap material would result in the filling of 860 ft' of high ground and 1,075 fl of creek bottom. Construction of the pier and finger piers in the deep water portion of the creek may adversely impact traditional navigation in the area.
