Dear Mr. Osborne:
On February 15, 2007, the Division of Water Quality received you request to rescind your coverage under
stormwater discharge Certificate of Coverage Number NCG080167. In accordance with your request,
NPDES General Permit NCG080167 is rescinded, effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

This letter addresses a correction to the Stormwater inspection report that I sent to
you (dated October 31, 2007): a pennit application for NCG080000 does not need to be
sent for the landfill site that is already covered by the presently active NCG120064
Stormwater pennit. However, please do send a request to the Stormwater and General
Permits Unit in Raleigh for the rescission of Stormwater permit NCGOS0167 that was
issued to Browning Ferris for the Allen Street location in Peachland, as it is presently the
property of Double "D" Auto Repair, and the permit is not transferable to a different
physical location.
I am sorry for any inconvenience that my October 31, 2007 letter caused for you

This letter addresses observations and concerns that this office has as a result of
my stormwater inspection on September 24, 2007. Included are suggested corrective
actions.
1. Please submit to the Stornwater and General Permits Unit in Raleigh all
NCG080000 application for the Allied Waste site location at 375 Allied Road,
Peachland, NC. A permit for Allied Waste appears to be required based upon the
following reasons: a) the average use of greater than 55 gallons of new motor oil
per month, b) the potential for motor oil to be in the sheet flow from. the truck
parking lot into a ditch and then flow to one or two detention ponds, c) an
unsheltered truck wash and equipment, d) the storage of uncovered dumpsters,
and e) the SIC codes that are listed on the application (please refer to "activities
that are also included"). Please note that a NCG080000 application is enclosed
with this letter, and that the application fee has recently increased to $100.
2. Please send a request to the Stomirwater and General Permits Unit in Raleigh for
the rescission of Stom7water permit NCGO80167 that was issued to Browning
Ferris for the Allen Street location in Peachland, as it is presently the property of
Double "D" Auto Repair, and the permit is not transferable to a different physical
location.
3. Please review the conditions of the new NCGO80000 permit. As discussed on
September 24th with Richard Hatcher at the 375 Allied Road site, to comply with
the new permit, please submit the Discharge Monitoring Reports with annual
analytical data for the detention pond discharge(s) to Central Files. If there is no
discharge that occurs from the detention pond(s), please write "No Discharge" on
the Discharge Monitoring Report(s) and submit the Report(s) to Central Files (as
required by the pennit).

4. Please keep all semi-annual visual monitoring reports for the discharge from the
detention pond in the stonnwater files at the facility site. If applicable, please
record "No Discharge" on the visual monitoring reports.
5. Please review the items that I left with Richard Hatcher on September 24, 2007.
They contain important information that will assist you to achieve compliance
with the Stormwater pennit. They included an application for the NCG080000
Series, a NCGOS0000 Series Pennit, and the NCDENR Stormwater website.

North Carolina General Statute 143-215.6 b (i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record, report,
plan or other document filed or required to be maintained under Article 21 or regulations of the Environmental
Management Commission implementing that Article, or who falsifies, tampers with or knowingly renders inaccurate any
recording or monitoring device or method required to be operated or maintained under Article 21 or regulations of the
Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a
line not to exceed $10,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides

In response to your renewal application for continued coverage under general permit NCG080000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

A copy of a Technical Bulletin for the general permit
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the pennittec from responsibility
for compliance with any other applicable federal, stale, or local law, rule,'standard, ordinance, order, judgment, or
decree.

and the U. S. Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies -or sampling requirements contained in this
permit are unacceptable to you, you have the right to request ari individual permit by
submitting an individual permit application. Unless such demand is made, this certificate of
coverage shall be final and binding. Please take notice that this certificate of coverage is not
transferable except after notice to the Division of Environmental Management. The Division of
Environmental Management may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
