Dear Mr. Pfleger:
On November 8, 2007, the Division of Water Quality received you request to rescind your coverage
under stormwater discharge Certificate of Coverage Number NCG080129. In accordance with your
request, NPDES General Permit NCGO80129 is rescinded, effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Dear Mr. Pfleger,
This letter addresses observations and concerns that this office has as a result of
my storm water inspection on August 31, 2007. Included are suggested corrective
actions.
1. Please submit a NCGO80000 application for the Waste Industries site that is
located at 4621 Marracco Drive in Hope Mills to the Stormwater and General
Pennits Unit in Raleigh. Please note that a NCG080000 application is enclosed
with this letter. Please review the SIC codes that are listed on the application
along with the "activities that are also included". Please note that the application
fee has recently increased to $100.
2. At this time, the NCG080129 Stonmwater permit for the 301 South Service Road
location is being processed for rescission in Raleigh by the Stormwater and
General Permits Unit. The NCGO80129 pennit was originally for the site that
was previously owned by Waste Industries; and, it is now the property of Cain's
Truck Service.
3. Please review the conditions of the new NCG080000 permit. As discussed in the
September 71h phone call with you, to comply with the new permit, please submit
the Discharge Monitoring Reports with annual analytical data for the detention
pond discharge to Central Files. If there is no discharge that occurs from the
detention pond, please write "No Discharge" on the Discharge Monitoring Report
and submit the Report to Central Files (as required by the permit).
4. Please keep all semi-annual visual monitoring reports for the discharge from the
detention pond in the stormwater files at the facility site. If applicable, please
record "No Discharge" on the visual monitoring reports.
5. The NCG010000 permit is for Construction and Land Disturbing Activities;
please note that the permit is cancelled when construction is completed.

plan or other document filed or required to be maintained under Article 21 or regulations of the Environmental ..,.

On January 25, 1989, Waste Industries, Inc. submitted an M(P) Planned Industrial
Site Plan Review to this agency for approval of a development located on the
northwest side of SR 2285 (Service Lane, U.S. Hwy. 301 South). They received
conditional approval on February 8, 1989. A revised site plan was then submitted
to this agency, and conditional approval was granted on March 27, 1991. Another
revision showing a small addition was conditionally approved on August 13, 1993.
(See attached condition sheets.) At the time of the reviews, the official zoning
maps reflected that the subject property's entire rear property line was adjacent
to an RR Rural Residential District.
On May 5, 1994, Waste Industries received notice that their petition for a Zoning
Certificate of Occupancy was denied due to their failure to comply with Condition
p7b which required a site obscuring buffer as defined in Section 10.2 of the
Cumberland County Zoning Ordinance to be established and maintained along the
entire western (rear yard) property line.
Waste Industries, Inc. notified this agency of their desire to appeal this
condition on May 9, 1994 (see attached letter). After we requested the required
information (see letter dated May 24, 1994), Waste Industries, Inc. Bent us the
proper appeal information along with their formal request for appeal in the
attached letter dated May 27, 1994.
In accordance with Section 12.45 of the Cumberland County Zoning Ordinance, the
Planning staff recommends denial of the requested appeal based on the following,
1. The status of the zoning of the property adjacent to the
subject property's rear line has not changed. As of the date
of this memorandum, it is still zoned RR Rural Residential
DistrictT
2. Condition i7b is in line with' Section 7.27 (Buffer
Requirements) of the Cumberland County Zoning Ordinance, which
states " . . . where an office, commercial or industrial
district abuts a residential district to the side or rear
property line, there shall be installed and maintained along
such side and rear property line a buffer."T and

3. Based on the information provided to this agency, the
requirement of a buffer should not burden the development of
this property nor should it hinder the most efficient use of
the property, and it would insure an environment of stable
characteristics with the surrounding land uses and coincide
with the intent of the Cumberland County Zoning Ordinance.
Again, the Planning staff recommends denial of this request for appeal from the
requirement of placing a buffer along the rear property line.

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
