Dear Mr. Adkins:
Reference is made to your request for rescission of the subject NPDES General
Permit. Staff of the Mooresville Regional Office have confirmed that the rescission of th
NPDES General Permit is subject to the removal of approximately 20 trash hauling = —
containers from the facility site. It is the staffs opinion that this facility must retain this _
permit until such time as the trash hauling containers are removed from the site.
Therefore, your request to rescind NPDES General Permit No. NCGO80037 is
denied.

On September 28, 1995, this Office received a request of permit rescission for the subject
permit. At that time Mr. Todd St. John with this Office contacted Mr. Sean Adkins of Waste
Management and discovered that several trash hauling containers (approximately 20) still remained
at this subject site. Mr. St. John advised Mr. Adkins that this Office would not certify the permit
inactivation until all equipment was removed from the site. Mr. St. John has had several
conversations with Mr. Adkins since that time and has received no indication that the containers
have been removed. Therefore, this Office is returning this permit rescission request because there
is no indication that Waste Management intends to remove these containers in the near future; the
subject permit should not be rescinded at this time.

This is to acknowledge receipt of your request that NPDES General Permit No.
NCGO80037 be rescinded. Your request indicated that this facility has relocated and is
currently covered under NPDES General Permit No. NCG080406, and that the subject
permit is no longer needed.
By copy of this letter, I am requesting confirmation from our Mooresville Regional .
Office that this permit is no longer needed. After verification by the regional office that the
permit is no longer needed, NPDES General Permit No. NCG080037 will be rescinded.
If there is a need for any additional information or clarification, please do not hesitate

Gastonia NC 28054 to 2712 Lowell Rd., Gastonia NC 28054. The current facility is
covered under the General Permit No. NCG080000, COC NCG080406. Waste
Managements previous facility was also covered under the General Permit, COC
NCG080037. The company no longer conducts _any.cperations at this location, and -o
requests that coverage under the general permit for this facility be rescinded. Mr. Bill Mills ,D
indicated that since coverage is being rescinded, stormwater monitoring will not be _o
required this year for the previous facility. Please contact me immediately if this is

In accordance with your application for discharge permit received on October 1, 1992, we are
forwarding herewith the subject certificate of coverage to discharge under, the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required

and IV of General Permit No. NCG080000 as attached.
This certificate of coverage shall become effective May 21, 1993.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
