On 3/5/2012, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG060212. In accordance with your request, Certificate of Coverage
Number NCG060212 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

This letter serves as follow up to the site visits and observations made on February 16, 2012 at the H & H Products
facilities located in Dunn, Harnett County, NC. Your time and assistance during the site visits is greatly appreciated.
Regarding the facility located at the intersection of Highway 301 North and Stewart Drive, it was relayed that
manufacturing/industrial activities have ceased and remaining materials such as drums, totes and storage tanks are being
removed from the site. As discussed with you during the site visit, a request for rescission of stormwater permit coverage
under Certificate of Coverage NCGO60212 for this facility may be submitted due to the lack of industrial activity. It was
also relayed that approval of the rescission request would be dependent upon removal of the aforementioned materials. A
copy of the Rescission Request Form was supplied to you, which at the appropriate time should be completed and
submitted to the Stormwater Permitting Unit (SPU) at the address on the form. Once received by the SPU, this regional
office will be notified for comments and a subsequent site visit will be scheduled to confirm that exposure of industrial
products and materials to stormwater runoff has been eliminated.
With respect to the facility located on Carlie C's Drive where your industrial activities have been relocated, observations of
site conditions resulted in the lack of any apparent stormwater discharge outfalls. Since stormwater permit coverage is
triggered by certain industrial activities and the presence of a point source discharge of stormwater, it has been
determined that permit coverage is not required for this facility at this time. Should site conditions change such that a point
source discharge of stormwater is later discovered or created artificially or naturally over time, you should complete and
submit the applicable Notice of Intent application form for appropriate permit coverage. Please be advised that the
discharge of stormwater from facilities engaged in certain industrial activities without permit coverage is a violation of NC
General Statute §143-215.1 and could result in the assessment of civil penalties of up to $25,000 per day, per violation.

I have spoken with Jerry Cashwell on numerous occasions. I am not sure what they
are looking for. Most of the items that JC has mentioned to me in the past sound:
like a OSHA issues at the active facility. I sent the landowner a letter
discussing the need for proper disposal. The issue was closed after the owner
cleaned up the burned building to include separation of metals, pallets and left
over product (surfactant). The owner presented me, during my compliance
inspection, disposal tickets that indicated that the waste that he removed from
the site was properly disposed of. The matter has been resolved with this section.
I offer the following concerning you questions.
1. The Solid Waste Section did not perform any sampling.
2. N/A
3. Clean up that I have jurisdiction over has been completed.

Representative Lewis wrote to us regarding the H and H products manufacturing
plant in Dunn which caught fire in March of 2004. It seems that the City of
Dunn Fire Inspector, Jerry Cashwell, has unresolved questions regarding the
cleanup. Please let me know if you can help me in responding to the following
questions:
1. Was testing conducted at the site and the adjacent body of water?
2. If so, did the testing indicate any environmental issue?
3. If so, what steps have been taken to resolve the issues and what plan
exists to finish clean up of the site?

Thank you for your patience and help in getting H&H Products Inc. headed in the right
direction regarding water runoff compliance.
In order for us to be in full compliance with EPA water -runoff regulations, there are three
main areas that have been identified for needing attention. First, we need to finish composing a
written "standard operating procedure" and program, encompassing the differing areas of
compliance specified by the EPA. Secondly, we need to implement semi-annual testing of water
runoff at the discharge point and visual monitoring and recording of water -runoff. Thirdly, we
must remove, or properly contain, our current outdoor storage of bulk soaps and detergents.
With regard to the written record of compliance, Jimmy Herring (plant manager) and 1,
have reviewed the requirements and have pulled together the necessary documents for this
written plan. We will implement the operating standards into job descriptions of specific
employees. This will be completed by the end of January.
The visual monitoring and recording procedure will be in place by the end of January, as
well. Semi-annual testing of discharge water will be in place for the year of 2007 also. We have
contacted Harnett County Water Department and Campbell University as potential certified
testing facilities. However, we have not made a formal agreement with either.
The containment of all outside storage of bulk materials will be eliminated, as soon as,
we are able to procure a new facility. It appears that we will see this happen in the year of 2007.
Since we are anticipating this move, we are continuing to drastically reduce the volumes of these
materials.

On November 20, 2006, Mike Lawyer and Chad Turlington from the Fayetteville Regional
Office of the Division of Water Quality along with Karen Higgins and Shelton Sullivan from the NPS-
Assistance & Compliance Oversight Unit conducted a site inspection for the H & H Products, Inc.
facility located;at,the intersection of US Highway 301 North and Stewart Road in Dunn, Hartnett County,
North Carolina. A copy of the inspection report is enclosed for your review. Your time and assistance
provided during the inspection is greatly appreciated. Stormwater from the facility drains to an
unnamed tributary to Stony Run (Hannas Pond), a Class C; Sw water located in the Cape Feai• River
Basin. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater
General Perm it-NCG060212.
Accordingly, the following observations and/or permit conditions violations (please see the
attached addendum for information about your permit) were noted during the Division of Water Quality
inspection:

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act and then delegated to the Division of Water Quality for implementation in
North Carolina. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There are
currently 19 active general stormwater permits in North Carolina. One condition that is applicable to
both the general permits and individual stormwater permits is the requirement to develop and implement
site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent
pollutant discharge.
Copies of the general permits and accompanying documents can be accessed from the following

monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES
General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said;
please see the above -mentioned web site in order to obtain a copy of the permit such that you may fully
comply with all the conditions therein. Failures to properly comply with conditions of the permit,
like those bulleted below, constitutes violations and are subject to a civil penalty assessment of up
to $25,000.00 per day, per violation.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit
coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NO[) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered
by the General Permit. That is, the permittee is authorized to discharge stormwater, process
wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit
expires or is modified or revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most
of the permits have following condition requirements (you must read your entire permit to ensure
full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility
along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring
results shall also be maintained on -site. The Permittee shall retain records of all
monitoring information, including all calibration and maintenance records and all original
strip chart recordings for continuous monitoring instrumentation, and copies of all reports
required by this general permit for a period of least 5 years for the date of the sample
measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the
general permit. In order to receive automatic authorization to discharge beyond the
expiration date, the permittee shall submit forms and fees as are required by the agency
authorized to issue permits no later than 180-days prior to expiration date. Any permittee
that has not requested renewal at least 180 days prior to expiration, or any permittee that
does not have a permit after the expiration and has not requested renewal at least 180
days prior to expiration, will be subject to enforcement. Failure to renew your permit is
a violation.
Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is
not transferable to any person expect after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the Certificate of
Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of
Water Quality views changes of name or ownership as a modification that requires the
Director's approval and reissuance of the permit. Name and ownership changes required
you to complete a Name/ownership Change Form from the Division and mail it back to
the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

This facility processes and distributes detergents and other cleaning products used in various industries.
Permit coverage began in October 1995. The inspection was conducted with the company's president, Mr.
Jerry Hartman. A comprehensive stormwater pollution prevention plan was not available at the time of
inspection. A significant amount of time was spent going through the general permit,and the components of
an adequate plan. Some documentation was available including a site plan, materials list and response
procedures for indoor spills, which could easily be revised and made part of the overall plan. Also, Mr.
Hartman relayed that some permit -required activities are being conducted, but without proper
documentation. Mr. Hartman conveyed that qualitative and analytical monitoring had not been conducted
since permit coverage began. The number and location of stormwater outfalls was discussed and it was
determined that the facility currently has one outfall. The outfall is comprised of a pipe that travels under the
loading dock at the back of the facility and conveys stormwater via a short concrete channel into the
roadside ditch along Stewart Road. It was noted that while the grounds of the facility, including material
storage areas, have improved since a -previous visit conducted about eighteen months ago due to a
complaint, there are still some issues that should be addressed. Primarily, there is a lack of secondary
containment around all bulk storage of liquid materials. Mr. Hartman discussed plans of moving his
operations to another facility, which th"rough some modifications could provide indoor storage of all materials
and is equipped with an oil/water separator connected to municipal sanitary sewer service. It was agreed
that this could be a positive move for this facility's industrial activity provided there was adequate
pretreatment of disposed materials and any spills. Although this facility is currently in violation with the
conditions of the general permit, it would appear that some steps have been and are being taken in the right
direction.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate or coverage. This is a violation of NCGS § 143.215.1 (c)( l) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.
