Dear Mr. Myers:
Reference your application for a Department of the Army (DA) permit to improve a public
boat launch area, including the excavation of an access channel, and the construction of a
concrete boat ramp, breakwaters, and an access pier, on property located off State Road 1259,
adjacent to Knotts Island Bay, on Knotts Island, in Currituck County, North Carolina. _
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of General Permit No. 198000291. Therefore, you may commence construction
activity in strict accordance with applicable State authorization and the approved plan. Failure
to comply with the State authorization or conditions of the general permit could result in civil
and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and
the North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified.

Dear Colonel Alexander:
This is in response to the above referenced state field investigation report (Report), for the
proposed construction of a concrete boat ramp, two breakwaters, and an access pier, and
excavation of an access channel. The proposed work is anticipated to result in the excavation of
3,302 square feet of shallow water habitat, including 82 square feet of submerged aquatic
vegetation (SAV), and filling of another 869 square feet of unvegetated shallow water habitat.
According to the report, the proposed activities are located at the existing Brumley Road boating
access in Knotts Island Bay, Knotts Island, Currituck County, North Carolina. No mitigation is
proposed.
The U.S. Environmental Protection Agency (EPA), Region 4, Wetlands Regulatory
Section has reviewed this proposal and sees no evidence of an attempt to avoid or minimize
impacts to waters of the U.S. The project is expected to impact 82 square feet of submerged
aquatic vegetation, namely Vallisneria americana, Ruppia maritima, Potamogeton crispus, and
Myriophyllum spicatum. Areas such as the one proposed for impact are extremely important to
North Carolina in terms of water quality, water quantity, commercial and recreational fin- and
shellfish production, sediment stabilization, and aquatic habitat and food chain maintenance.
We are particularly concerned with the projected impacts to SAV, and recommend that
the applicant consider narrowing the area of excavation and modifying the location of the
proposed breakwater to avoid this resource. Thank you for the opportunity to comment on this

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Myers:
You have our approval, in accordance with the attached conditions, to dredge and place fill in 0.09 acre of vegetated wetlands
(submerged aquatic vegetation) and shallow water habitat and to shade 0.08 acre of Public Trust/Estuarine Waters in order to construct a
concrete ramp, two breakwaters, a pier, and to excavate an access channel at the Brumley Road boating access on Knott's Island in
Currituck County, as described in your application received by the Division of Water Quality on October 18, 2002. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded
from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC
Division of Coastal Management. In addition, you should get any other federal,.state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard
regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions
listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory, hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

breakwaters, a 5' x 75' access pier, and excavating the access channel connecting the boat ramp with
the existing deeper water.

Protect Setting
The North Carolina Wildlife Resources Commission is proposing to modify and improve
an existing boating access in Currituck County. The site is located off NC 615, at the east end
of Brumley Road (SR 1259) in Knotts Island, adjacent to Knotts Island Bay. To access the
site, drive two miles on NC 615 North after leaving the Knotts Island Ferry. Turn right (east)
onto Brumley Road and stop at the 50' wide paved cul-de-sac adjacent to Knotts Island Bay.
NCWRC's designated parking area is a 1/2 acre graveled lot located on the north side of
Brumley Road 400' west of the launch site.
Elevation of the 50' wide paved cul-de-sac/maneuvering area serving the existing sand
boat launch ranges 2'-3' above mean sea level. A shallow 3' wide swale is located just south
of the pavement and extends 90' from the NWL of the bay. Coastal Wetlands vegetated with
irregularly flooded salt reed grass (Spartina cynosuroides) and cattail (Typha spp.) occupy 200
square feet of area within the waterward end of the swale.
The only structural improvements found on the property are a 4' x 141' pier and a 12' x
12' platform. Wooden bulkheads in good condition protect the shorelines of the adjacent
residential properties located to the north and south. The two piers which serve the northern
and southern properties measure 75' long and 100' long respectively. South of the project site,
there are two breakwaters located 25' apart which provide stabilization for a 100' long channel
and basin.
The waters of Knotts Island Bay in the vicinity of the project are classified as SC by the
Environmental Management Commission. These waters are classified as Joint Fishing Waters
by the NC Marine Fisheries Commission and NC Wildlife Resources Commission and as
Estuarine and Public Trust Waters by the NC Coastal Resources Commission. Water depths in
the project area (1' - 145' out into Knotts Island Bay) measure .5' - 2.6' below NWL. Four
(4) species of submerged aquatic vegetation are located in and adjacent to the project site. In
the order of greatest abundance these species are as follows: (1) wild celery (Vallisneria
americana), (2) widgeon grass (Ruppia maritima), (3) redhead grass (Potamogeton crispus),
(4) Eurasian water milfoil (Myriophyllum spicatum). Presence of finfish, shellfish and
crusthcranus were not detected during site visits.
Review of available information suggests that there are no know archeological or
geological formations associated with the applicant's property.
The applicant proposes to:
. Remove the existing 4' x 141' pier and platform.

. Place a 22' wide section of reinforced concrete 39.5' out beyond the NWL.
• Achieve a practical boat launching depth by using an amphibious excavator to dredge
160 cubic yards of silt/sand from a 28' x 115' area. The maximum dredging depth of
5' below NWL is proposed 35' beyond the NWL. For a distance of 78' waterward of
maximum depth substrate would be sloped to tie into an existing depth of 2.6' below
NWL. Spoil material would be trucked to a 70' x 70' bermed disposal site located
within the NCWRC parking area 400' to the west and eventually relocated to another
highground site.
. Construct a l' x 145' vinyl breakwater on each side of the concrete ramp a minimum
distance of 15' from the adjacent riparian property lines.
. Construct a 5' x 75' pier without docking spaces between the two breakwaters. The
water depth at the end of the pier will be 4.0' NWL. The bay is 7,000' wide where the
pier is proposed.
. The excavation of 160 cubic yards of material from a 28' x 115' area will disturb 3,220
square feet of shallow water habitat.
. The excavation will result in the loss of 82 square feet of submerged aquatic vegetation.
• The placement of a 22' x 39.5' section of reinforced concrete will result in the loss of
869 square feet of shallow water habitat.
• The construction of a 5' x 75' long pier will result in the shading of 375 square feet of
Estuarine/Public Trust Waters.
• Short-term turbidity will occur as a result of dredging, the placement of concrete, and
the construction of the pier, platform and breakwaters.

Finding of No Significant Impact
Project: NCWRC Boating Access Area on
Knotts Island Bay at the end of SR 1259, Currituck
County
The North Carolina Wildlife Resources Commission (NCWRC) is planning to
improve a boating access area located at the end of SR 1259 on Knotts Island,
in Currituck County (please refer to the EA and the proposed construction
drawings for details). Based on the findings of the EA, the NCWRC believes that
there will be no significant adverse effects.
Benefits from the access area include increased public recreational
opportunity by providing a safe means to access water resources in the vicinity.
Currently, there is a small, paved launch at the end of SR 1259 on the proposed
project site. The existing slope is much shallower than design standards
prescribe, thus the level of service is minimal. There is currently a gravel
parking area near the site. The proposed modifications will help conflicts
arising from utilization of the unimproved launch. Use of the access area mayl
benefit the local economy as increased use and exposure to the public may
increase property values in the vicinity of the project area. Due to the type of
modifications proposed and the existing facilities, adverse impacts from
construction will be minimal. Such impacts will be minimized through effective
erosion and sedimentation control measures, proper routing of storm runoff,
and a dredging moratorium between 1 April and 31 September in any given
year.
An Environmental Impact Statement (EIS) is not necessary and will not be
prepared.
