On November 9, 2011, I, Dave Parnell of the Raleigh Regional Office of the Division of
Water Quality, performed a compliance evaluation inspection (CEI) at the referenced
plastic ornamental holiday figurine production facility. Your assistance was helpful and
appreciated. This inspection was conducted to determine your compliance with NPDES
stormwater general permit referenced above. The following observations were noted
during the Division of Water Quality inspection:
SITE DESCRIPTION
Plastic ornamental holiday figurines are being produced at this facility. There are .
currently two (2) stormwater discharge outfalls (SDO) being evaluated at the facility.
These SDO were agreed upon during the last CEI, which was conducted December 21,
2011. You and I agree that the designated outfalls encompassed the stormwater flowing
from the production area of the facility. Therefore; no further modification of the outfall
locations are required at this time.
INSPECTION SUiiMMARY
The Stormwater General Permit was available during the inspection. The permit was issued
by the Division on June 1, 2008 and expires on March 28, 2013. Please note that an
application for renewal is required 6 months prior to expiration of the permit.
2. The Stormwater Pollution Prevention Plan (SPPP) was available and reviewed during the
CEL All components of the SPPP were present. This was an improvement from the
December 21. 2010 inspection.

3. Both SDO were visited during the inspection. Secondary containment was visited and
inspected as well.
4. Qualitative monitoring is currently being conducted at both SDO. "rhe monitoring reports
were, reviewed and were acceptable. No analytical monitoring is required at this time by the
permit.
It is apparent your stormwater program has been implemented. This facility is considered to
be in compliance with the permit. Please continue your diligence to the adherence of your

Stormwater Pollution Prevention Plan
Updated 1-11-2011
1. Site Plan.
(a) General Foam Plastics is located at 501 Daniel Street, Tarboro, NC 27886 per
the attached map.
(b) Outside storage of materials includes plastic pellets, cooling tower water, one
open top trash container, diesel fuel and CE thinner.
Plastic pellets arrive in tanker trucks and railcars. The pellets are
pneumatically conveyed into storage silos. All dust that is created is
contained in the filter chambers of the conveying system.
Cooling tower water is supplied by the town of Tarboro water system. The
water in the tower is part of an internal closed loop system. The water is
checked daily, with chemicals being added as needed to maintain proper ph
and to retard algae growth.
There is one open top trash container on site. It is monitored daily to make
sure that all debris is inside the container. No liquids are disposed of in this
container.
Diesel fuel is received by tanker truck. Our storage tank is above ground with
a retaining wall.
CE thinner is received by tanker truck. The above ground storage tank has a
retaining wall.
(c) A site map is attached. On the map, two outfalls are identified. Outfall I
includes an enclosed manufacturing area and an impervious parking lot of
91,000 square feet. Potential pollutants in this area are plastic pellets and
traces of oil. Outfall 2 includes a warehouse and an impervious parking lot of
59,000 square feet. There are no potential pollutants associated with this area.
(d) There have been no significant spills or leaks of pollutants in the
previous 3 years.
(e) "I certify under penalty of law, that this document and all attachments
were prepared under my direction or supervision in accordance with a
system designed to assure that qualified personnel properly gather and
evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for
gathering the information, the information submitted is, to the best of my
knowledge and belief, true, accurate, and complete. I am aware that there are
significant penalties for submitting false information, including the possibility
of fines and imprisonment for knowing violations."

2. Stormwater Management Plan.
(a) Feasibility Study. All manufacturing and storage is conducted inside
wherever possible. Plastic pellets, CE thinner and diesel fuel are received
and stored outside. However, provisions have been made to prevent these
materials from entering the stormwater runoff.
(b) Secondary Containment Schedule. Retaining walls are in place for all
materials that are stored outside. We have no secondary containment
devices that are controlled by valves.
(c) BMP Summary. Our sources of significant pollutants are limited, but we do
have practices in place to minimize any possible exposure. Our oil and paint
are stored inside. All materials that are stored outside are in enclosed
containers such as tanks or silos with retaining walls.
Spill Prevention and Response Plan.
(a) Potential Risks and Positions of Responsibility.
(1) Plastic pellets around the rail siding and the silos, the Blending
Supervisor (Frankie Craft) and the Molding Manager (Herb
Whitehurst) are responsible.
(2) Paint and solvent, the Assembly Manager (Carol Langley) is
responsible.
(3) Diesel fuel and oil, the Maintenance Manager (Ralph Hyde) is
responsible.
(4) Open top trash container, the Maintenance Manager (Ralph Hyde) is
responsible.
(5) Receiving of material by truck, the Assembly Manager (Carol
Langley) is responsible.
(6) Shipping of material by truck, the Shipping Manager (Thomas Ore) is
responsible.
(7) All listed and unlisted potential risks shall be the responsibility of all
department managers.
4. Preventive Maintenance and Good Housekeeping Plan.
(a) All managers conduct a weekly safety inspection of their areas of responsibility.
Theses inspections are documented and kept on file by the Safety Director.
(Larry Mattem).
(b) All maintenance and material handling areas are cleaned on a daily basis.
5. Employee Training.
(a) Our employee training is scheduled during the first calendar quarter annually.
(b) The training is the responsibility of the Safety Director. (Larry Mattem)
(c) The coordination, development, implementation and revision of the Plan is the
responsibility of Herb Whitehurst.
6. Facility Inspection Program.
(a) The stormwater system for this facility is inspected on a semiannual schedule,
once in the spring (April — June) and once in the fall ( September — November).
(b) The documentation of these inspections shall include: the date and time of
inspection, individual making the inspection and a narrative description of the
facility's stormwater control systems.
Implementation.
(a) The permittee shall document all monitoring, measurements, inspections and
maintenance activities and training provided to employees, including the log of
sampling data and of activities taken to implement Best Management Practices
associated with the industrial activities, including vehicle maintenance activities.
Such documentation shall be kept on -site for a period of five years and made
available to the Director or his authorized representative immediately upon
request.
Qualitative Monitoring Requirements
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless of
representative outfall status and shall be performed as specified in Table 1 of the permit.
Qualitative monitoring is for the purpose of evaluating the effectiveness of the Stormwater
Pollution Prevention Plan and assessing new sources of stormwater pollution. No analytical tests
are required. Qualitative monitoring of stormwater outfalls does not need to be performed
during a representative storm

On December 21, 2010, I, Dave Parnell of the Raleigh Regional Office of the Division of
Water Quality, performed a compliance evaluation inspection (CEI) at your plastic
ornamental holiday figurine production facility. The assistance of Mr. Rob Whitehurst
was helpful and appreciated. This inspection was conducted to determine your compliance
with NPDES stormwater general permit referenced above. The following observations
were noted during the Division of Water Quality inspection:
SITE DESCRIPTION
Plastic ornamental holiday figurines are being produced at this facility. There are
currently four stormwater discharge outfalls (SDO) being evaluated at the facility. As we
discussed, due to the complex drainage patterns of the flat coastal plain site, the number of
SDO can be reduced to two. One would be the channel at the point where it leaves the
site, behind the main building (SDO #1), and the other will be the reinforced concrete pipe
(SDO 42), behind the same building. During the next representative storm event, SDO #2
should be evaluated to determine if there is, in fact, a discharge here. Please note that I
agree with Mr. Whitehurst, that the drainage channel surrounding the site, and meandering
in and out of the site, creates a difficult situation for determining the SDO, and further
modification of the outfall locations may be required in the future.

In accordance with your application for a discharge permit received on September 17, 2007, we
are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.
Please note that the attached permit expires on April 30, 2008. Your COC will be automatically
renewed to cover the full 5 year term of the soon to be reissued permit. In the interim you must abide by

Subject: Notice of Violation — Discharge Without Valid Permit

Dear Mr. Warren:
1. Ron Boone, of the NC Division of Water Quality (DWQ), Raleigh Regional Office (RRO), conducted a
site visit to General Foam Plastics Corporation's processing facility located on Daniel Street in Tarboro,
North Carolina on 22 August 2007. Your assistance and cooperation during the visit was helpful and
appreciated.
2. During the visit, it was established that General Foam Plastics does not currently have a NPDES general
stormwater discharge permit as required by NC general statute 143-215.1. As an owner/operator of an
establishment primarily engaged in activities classified as the manufacture of plastics products not
elsewhere classified [standard industrial classification (SIC) 3089], the stormwater runoff from your
facility is regulated under the NPDES general stormwater permit NCG050000.
3. As such, you must apply for a NCG050000 certificate of coverage (COC) from NC DWQ. To do so,
download the NCG050000 notice of intent (NOI — application) from the website
http://h2o.enr.state.nc.us/su/Forms Documents. htm#stormwaterGP and fill it out completely, following
all instructions contained on the NOI very carefully. Once the NOI is completely filled out and you
have gathered all needed related materials as specified on the NOI, mail the complete package, including
payment, to the address specified on the NOL DWQ will then contact you for any additional
information needed or issue the COC.
4. Alternatively, your facility may be eligible for a No Exposure Certification (NEC). Submission of the
No Exposure Certification constitutes notice that your facility does not require permit authorization as
described above, for its stormwater discharges associated with industrial activity in the State of North
Carolina because it qualifies for a no exposure exclusion. A condition of no exposure at an industrial
facility means all industrial materials and activities are protected by a storm resistant shelter (with some
exceptions) to prevent exposure to rain, snow, snowmelt, and/or runoff.

5. Please be aware that discharges of stormwater runoff from your facility without being properly
monitored in accordance with NCG050000 or a NEC, are a violation of NC general statute 143-215.1,
and that such violations may result in the assessment of civil penalties in an amount not to exceed
$25,000 per day per violation. Please reply within 10 days of your receipt of this letter to notify us of
