This COC is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated October 15, 2007 (or as subsequently amended.)
The General Permit authorizes discharges of stormwater and specifies your obligations for discharge controls,
management, monitoring, reporting, and record keeping. Please review the new permit to familiarize yourself
with all of the changes. Parts III and IV contain the Standard Conditions, including Compliance and Liability,
Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions.
Your facility has six months from receipt of the COC to update its Stormwater Pollution Prevention Plan
(SPPP) to comply with changes in SPPP requirements. Other changes are effective immediately. Please note
that Tier 3 Actions (if applicable) are triggered by four benchmark exceedances beginning on the effective
date of the renewal permit and do not count prior exceedances. Please visit our website above to review the

Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit

On September 22, 2008, 1, Michael Lawyer.from the Fayetteville Regional Office of the Division
of Water Quality, conducted a site inspection at the Fex Straw Manufacturing facility located at 191
Magna Blvd in Robeson County, North Carolina. A copy of the Compliance Inspection Report is
enclosed for your review. Your time and assistance provided during the inspection is greatly
appreciated. Stonnwater from this facility drains to Jacks Branch, a Class WS-IV;Sw stream located in
the Lumber River Basin. The site visit and file review revealed that the subject facility is covered by
NPDES Stormwater General Permit-NCG050346.
Accordingly, the following observations were noted during the Division of Water Quality

Inspection Summary:
Inspection conducted with time and assistance provided by Ms. Brenda Tompkins, Office/Finance Manager. Reviewed the
facility's Stormwater Pollution Prevention Plan (SPPP), which is well detailed and easy to follow. A minor revision was
discussed with Ms. Tompkins concerning the new Qualitative (Visual) Monitoring schedule and requirement that it be
performed after a representative storm event. Monitoring records were available from previous years of permit coverage.
After the SPPP and records review, a tour of the facility was conducted both inside and outside. Facility has a'perimeter
ditch that conveys stormwater from the property at two outfalls both located adjacent to Magna Blvd, one at the entrance
to the facility and the other near the compost pile. At the time of inspection, facility appeared to be in full compliance with
the conditions of the NCG050000 general stormwater permit.

In response to your renewal application for continued coverage under stormwater General Permit NCG050000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permitis reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently. amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG050000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit. .
The more significant changes in the General Permit since the your last Certificate of Coverage include the following:
• Permit cover page - Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part. I Section A - This part explains that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part II Section A - Several minor expansions and clarifications of the required content of the Stormwater Pollution
Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements.
• Part It Section B - Qualitative monitoring must now be conducted during a representative storm event.
• Part II Section B - The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the
sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been
eliminated.)
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark
exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the
permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events
show no benchmark exceedences.
• Part II Section C - This part contains a new provision that four exceedences of any particular benchmark will trigger
increased DWO involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.

Hi, Belinda,
We've received an NOI from Fex Straw Manufacturing, Inc. for the GP for
Miscellaneous Manufacturing (NCGOS) for their facility in Lumberton-. The site
manufactures straw for horse bedding (? I'd never heard of that. before! Those
are either some posh horses, or I just never thought about how horses need
bedding :P). The site discharges stormwater to a UT to Jacks Branch, classifies
WS-IV Sw waters.
Attached is a copy of the NOI for the appropriate staff. Does the FRO have any
concerns with issuing a COC to this facility?

clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
c) If this application is being submitted by a consulting engineer (or engineering firm), include
documentation from the applicant showing that the engineer (Or firm) submitting the application has
been designated an authorized Representative of the applicant.
d) Final plans for the treatment system (if applicable). The plans must be signed and sealed by a North
Carolina registered Professional Engineer and stamped -"Final Design -Not released for construction".

Commission implementing that Article, or who falsifies, tampers with or knowingly renders inaccurate any recording or
monitoring device or method required to be operated or maintained under Article 21 or regulations of the Environmental
Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by a fine not to exceed
$10,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides a punishment by a fine
of not more than $10,000 or imprisonment not more than 5 years, or both, for a similar offense.)

Alternatives to Direct Discharge
Surface discharge followed by overland flow to a receiving water has been determined to
be the best alternative for the discharge of this steam condensate. There is no Regional
Sewer Collection System available in the area so that option is not available. Due to the
small volume of the discharge (80 GPD) the installation of a subsurface disposal system
with the associated permitting requirements is not practical or cost effective. There are
no crops on the site that require irrigation and the elevated temperature of the water
when discharged at the site is not appropriate for irrigation. The overland path that the
discharge must follow before entering a water body is long enough to allow the majority
of the water to infiltrate naturally and to cool to ambient temperature.
