Yeah, BIMS shows that they have six annual invoices past due for NCG050230.
I've copied others in our group because I'm not sure what our posture is now on folks so far in arrears.
The last time I looked at a similar situation, the delinquent permittee was more than happy to bring his account up to
date. So, my expectation is that if we billed them (and I note that the invoice numbers are listed in BIMS), then they
need to pay.
A complicating issue, perhaps, arises from the letter in our files from FPE and Dennis Koc Engineering Manager, noting
that the previous permittee, Moll Industries filed for bankruptcy protection in April 2010. It appears that Dennis Koc
was an employee of Moll and that he subsequently continued with the facility under the new owner, FPE. FPE acquired
the assets of Moll in September 2010 from the bankruptcy court and on the basis of continuing the same kind of
manufacturing, FPE and Koc requested in July 2011 that we transfer the permit coverage to FPE which we did in
December 2012.)
BIMS shows the first overdue fee for the permit in the period May 2009 to April 2010: presumably Moll was still in
business for most of that period.
But, I don't know that we are justified in seeking past amounts from FPE that were attributable to Moll prior to
bankruptcy (2010), or prior to FPE acquiring the assets of Moll. Using September 2010 as the critical date (when PPE
acquired the assets of Moll, and presumably the active manufacturing operation), I would consider that PPE owes us:
• $100 for the permit period May 2010 to April 2011;
presumably continued manufacturing.)
• $100 for the permit period May 2011 to April 2012;
(FPE acquired the assets of Moll in this period, and
(FPE requested a permit transfer in this period, sorts late,
perhaps.)
• $100 for the permit period May 2012 to April 2013; (We actually provided the COC in this period - - an arguable
point, perhaps. But perhaps a stronger arguing point is that FPE has never paid a fee, and so might be
considered to be discharging without a permit beginning in one of those first two permit periods starting with
the September 2010 acquisition of Moll's assets and continuing up until today.)
• $100 for the permit period May 2013 to April 2014,
• $100 for the permit period May 2014 to April 2015.
• Total: $500.
• Consider also: they can avoid the next scheduled billing on NCG050230 for May 2015 to April 2016 if they get
their NCGNE to us in the next few weeks.
Bradley, Laura, Bethany - - have we got any sort of standard approach in this circumstance? Please advise so Sue can
advise.

Hi Laura and Ken:
I got a call from Steve Sohnly (included in this email) concerning NCG050230. Facility changed hands in 2008. Name
change was done because it's in the current owners name but the last permit fee was paid in 2009.
Mr. Sohnly is interested in applying for a certificate of no exposure. I haven't been to the site so I don't know that they
would qualify, but I am wondering if they would have to bring this site up to date with fees, updated SP3 plan,
etc. before they can apply. They are not required to do analytical sampling but the qualitative has not been done for
several years.
This site was last inspected in 2008. 1 believe it fell through the cracks because the only affiliate on file was Dennis Koc
who left the company several years ago.
Mr. Sohnly is going to set up a technical assistance inspection with me in the next couple weeks. He's in Ohio, this site is
in Asheboro/Randolph County.
Any thoughts or insights on how we can best help would be greatly appreciated.

In response to your renewal application for continued coverage under the subject permit, the Division
of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have -
developed and implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
■ Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resouiices, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS §143.215.1 (c)(l) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least I80 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit' at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. A valid reason for
requesting rescission is required, incomplete forms will be returned and you will still be subject to possible
escalated action. Mailing instructions for submitting rescission request are listed on the bottom of the form. You
will be notified when the rescission process has been completed.

Moll Industries Inc. ceased to exist as a business entity after filing for a bankruptcy protection in April
2010. All of its assets were purchased by a liquidation company in September 2010 from the bankruptcy
court. Florida Production Engineering Inc. purchased majority of the assets that were owned by Moll
Industries from this liquidation company in September 2010. Because of this, section VI cannot be filled
out by Moll or the liquidation company. FPE NC, LLC requests that the permit for the surface water
protection be transferred to FPE NC, LLC. FPE NC, LLC will continue to conduct same industrial activities
conducted by the previous owner of the facilities. If you have any questions regarding this application
for ownership change, please contact me at your earliest availability.
