On August 5, 2011, I, Dave Parnell of the Raleigh Regional Office of the Division of Water
Quality, intended to perform compliance evaluation inspections (CEI) at the referenced
facility. A site visit indicated that there appears to be no production activity at this facility
and has been the case for some time. The parking lot is empty, the doors are locked and
there is a "for lease" sign in front of the building.
The NPDES wastewater permit expires on July 31, 2012, The Stormwater General Permit
expires on May 13, 2013. If there continues to be no production activity at the facility, there
would be no reason for the Wastewater and Stormwater permits to be in effect. It is
permissible for your permits to be rescinded, so that you will not incur further permit fees.

On 1/31/2011, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG050020. In accordance with your request, Certificate of Coverage
Number NCG050020 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

On August 18, 2009, I, Dave Parnell of the Raleigh Regional Office of the Division of
Water Quality, performed compliance evaluation inspections (CEI) at the referenced
facility. Your assistance, as well as that of Max Nicholson, Production Manager and John
Sacco, Facility Maintenance Supervisor, was helpful and appreciated. These inspections
were conducted to determine your compliance with the NPDES stormwater and wastewater
general permits referenced above. The following observations were noted during the
Division of Water Quality inspection:
SITE DESCRIPTION
This facility is a plastics processing facility primarily involved in the manufacture of plastic
sheeting and trash bags. There is one stormwater discharge outfall (SDO) at the facility. The
SDO is located at the outlet of a concrete pipe, which is fed by a system of in -ground drains.
The SDO, known as SW001, discharges to an unnamed tributary to Swift Creek, a class WS-
N, nutrient sensitive water (NSW), in the Tar -Pamlico river basin. Limited vehicle
maintenance is conducted at this facility; therefore, no analytical monitoring is required for
this purpose. Wastewater is produced from a cooling water system used to cool
manufacturing equipment. Water is treated within the cooling system with proprietary
chemicals but is not chemically treated with chlorine/chlorine compounds prior to
discharging. The wastewater is discharged via a single outfall to the same unnamed tributary
of Swift Creek.

INSPECTION SUMMARY
1. The Stormwater General Permit was available during the inspection. The permit expires on
May 13, 2013. Please note that an application for renewal is required 6 months prior to
expiration of the permit.
2. The Stormwater Pollution Prevention Plan (SP3) was available, reviewed and found to be
complete. The inclusion of Employee Training documentation is required to be
included within the Plan. The SP3 is well prepared and Mr. Lunn is familiar with its
contents.
3. The Best Management Practices (BMP) plan was present within the SP3. Qualitative
Monitoring had been done and was documented as required by NPDES Stormwater permit
NCG050020. The SDO and secondary containment areas were inspected during the
inspection and were in compliance.
4. The NPDES wastewater permit was also available during the inspection. It expires on July
31, 2012. An application for renewal is also required for this permit 6 months prior to
expiration.
5. The fact that water within the cooling system is treated with proprietary chemicals, but not
chemically treated with chorine/chlorine compounds prior to discharge; is noted above in the
SITE DESCRIPTION. Please provide the MSDS sheet for the material used in treating
the cooling water.
6. There is one cooling system wastewater discharge which discharges through a 4" pipe on the
north side of the facility. This wastewater discharge pipe is known as Outfall 002. Please
note that NPDES permit NCG500227 regulates the discharge of non -contact cooling water,
cooling tower and boiler blowdown, condensate (exempt stormwater), cooling waters
associated with hydroelectric operations and similar wastewaters. Please ensure that you
identify and monitor all discharges from your facility that fall into any of the above
listed categories. Please refer to Part I, Section C of your permit for further details.
7. Records demonstrating analytical monitoring of Outfal1002 were not available during the
inspection. A second request was sent to you by e-mail on August 27, 2009. This indicates
that the monitoring has not been conducted as required by Part 1 Section Al of your permit.
The failure to monitor or to provide records of analytical monitoring is a violation of Part II,
Section D, Paragraphs 5, 6 and 7; as well as Section E, Paragraphl. Please refer to you
permit and adhere to the requirements for analytical monitoring.
8. DWQ records indicate that the facility has not gone through the proper channels to have the
name changed as required by the permit. In Part III, Section B, Paragraph 2 of the permit it
is stated that the permittee is required to notify the Division when the facility is sold or
closed. Please refer to the permit and adhere to requirements for a facility that has
changed hands.
During the CEI, you pointed out that Bevy Plastics Corporation has taken over ownership since the last
DWQ inspection. Although you are always required to adhere to the requirements of both of the
NPDES permits, I am offering a limited time for you to bring your facility into compliance. Please
provide a written response to this letter, within 30 days of the receipt of this letter, detailing your
facility's compliance efforts with respect to the bold items in #1, #5, #6, and #7. If you have any

Covalence Plastics, Battleboro Facility is please to provide the following information to address issues raised
during your office's compliance evaluation inspection (CEI) conducted at our facility on February 21, 2006. The
following responses are presented in the same order as the requested items in your letter:
Cooling System Wastewater Discharge (Permit No. NCG500227, NOV-2006-PC-0065)
Covalence Plastics contracted with Earth Tech, Inc. to perform an evaluation of the cooling water
discharge regulated under the General Permit. During a site visit to the facility on April 28, 2006, Earth
Tech verified that there are three (3) separate cooling water outfalls. These outfalls have bem designated
CWO1, CW02, and CW03 on the updated Site Plan contained in the facility's Stornwater Pollution
Prevention Plan (S WPPP). The outfalls have additionally been labeled at their physical locations. The
cooling water outfalls are for non -contact cooling water only and the discharge is not continuous. The
cooling water is only discharged during a power outage, pump malfunction, or maintenance activity that
requires drainage of the cooling systems. The capacity of each of the three cooling systems is
approximately 1,000 gallons. All other process wastewaters, such as contact cooling water and air
compressor blowdown are discharged to the City of Rocky Mount POTW trader an industrial discharge
permit.
The three non -contact cooling water discharges will be monitored semi-annually for [low, temperature,
and pH in accordance with Section A(1) of General Permit NCG500000. As noted above, the discharge
is intermittent and monitoring will be coordinated with planned maintenance activities.
The information required for approval of the use of Sky Biocide 5-191, including the Material Safety
Data Sheet, has been submitted to the Division of Water Quality, Aquatic Toxicology Unit, in
accordance with the requirements of the General Permit.

During the April 28, 2006 site inspection, Earth Tech verified that there is one stormwater outfall from
the facility, a 40-inch inner diameter concrete pipe. This outfall has been designated Outfall S WOOI on
the site crap and at the physical location, The facility has had a Stormwater Pollution Prevention Plan
since May 2004. A copy of the updated S WPPP (May 2006) is enclosed foryour review. The S WPPP
contains the required elements identified in the Stormwater General Permit.
Qualitative monitoring has been performed at the facility on a semi-annual basis since 2004. Copies of
the Stormwater Discharge Outfall (SDO) Qualitative Monitoring Reports for 2004, 2005, and 2006 are
enclosed for your review.
We trust that the above additional information is sufficient to address the questions and comments contained in

Mr. Ronald Boone, of the North Carolina Division of Water Quality, Surface Water Protection Section,
conducted compliance evaluation inspections (CEI) for the permits referenced above at Covalence
Specialty Materials Corporation's Battleboro, NC plant on 21 February 2006. Thank you for your
assistance and cooperation in providing him a tour of the site, as well as an interview to review your
cooling system wastewater and stormwater management programs.
Your permits/certificates of coverage, were issued 31 July 2004 (NCG500227) and 30 April 2003
(NCG050020) by authority of North Carolina General Statute (NCGS) 143-215.1. These permits are
intended to help prevent pollution of state waters that receive stormwater and/or wastewater discharges
from your facility. Compliance with each individual permit, as observed during Mr. Boone's
inspections at your plant, is discussed below. Please use the permit references listed throughout this
report for further explanation of each item cited.
SITE SUMMARY
• Your plant is a plastics processing facility primarily involved in the manufacture of plastic sheeting
and trash bags.
• Wastewater is produced from a cooling water system used to cool manufacturing equipment. Water
is treated within the cooling system with proprietary chemicals but is not chemically treated with
chlorine/chlorine compounds prior to discharge. The wastewater is discharged via a single outfall
on the northern side of the property.
• Stormwater generated at your site is collected via a system of in -ground drains. The stormwater is
then discharged via seven outfalls located on the western and northern sides of the property.
• Both the stormwater and wastewater are discharged to an unnamed tributary to Swift Creek, a class
WS-IV, nutrient sensitive water (NSW), in the Tar -Pamlico river basin. ow

INSPECTION FINDINGS
Cooling System Wastewater Discharge (Permit No. NCG500227, NOV-2006-PC-0065)
In general, the site was clean and well maintained.
According to your plant Maintenance Manager, Mr. John Sacco, you have only one cooling system
wastewater discharge, the outfall for which is located on the northern side of the property.
However, this outfall was not identified at its physical location or in any type of management plan.
Part I, Section A(I), requires the permittee to assign specific outfall numbers. Therefore, the
outfall(s) should, at a minimum, be labeled at its physical location, if not also in a written
wastewater management plan; neither was the case. Furthermore, please note that this permit
regulates the discharge of non -contact cooling water, cooling tower and boiler blowdown,
condensate, exempt stormwater, cooling waters associated with hydroelectric operations, and
similar wastewaters. Although Mr. Sacco established that you do not have a boiler blowdown
discharge, the other waste streams listed above were not specifically discussed. However, records
we have on file indicate past issues with air compressor condensate discharges. Please ensure that
you identify and monitor all discharges from your facility that fall into any of the above listed
categories. Although more than one discharge can be regulated under a single permit, separate
discharges require separate analytical monitoring according to the type of wastes being discharged.
Ultimately, it would behoove you to combine all such discharges where you can, or eliminate them
altogether. Part I, Section C discusses the different types of discharges in greater detail. Please
refer to this section for further detail.
Records reflecting the analytical monitoring of the outfall as required in Part I, Section A(I), were
not available for inspection, indicating that the monitoring had not been accomplished. Had the
required monitoring actually been accomplished however, the absence of such records still places
you in violation of Part II, Section D, Paragraphs 5, 6, and 7 as well as Section E, Paragraph 1.
You're currently using proprietary biocide chemicals manufactured by Sky Enterprises to treat the
water in your cooling system. However, we have no paperwork on file in our office indicating that
you have obtained authorization to do so as required in Part I, Section A(I). If you have already
obtained this authorization, please forward the required paperwork to us. Otherwise, please initiate
this process as soon as possible by following the guidelines in Part I, Section A(I).
Stormwater Discharge (Permit No. NCG050020, NOV-2006-PC-0066)
You do not have a Stormwater Pollution Prevention Plan (SP3) as required in Part II, Section A, of
your permit. As a result, you are missing several effective stormwater management tools, as listed
below:
o A site plan (Part 11, Section A, Paragraph 1 and subparagraphs)
o A stormwater management plan (Part II, Section A, Paragraph 2 and subparagraphs)
o A spill prevention and response plan (SPRP, Part H, Section A, Paragraph 3)
o A stormwater preventative maintenance and good housekeeping plan (Part II, Section A,
Paragraph 4)
o A stormwater employee training program (Part H, Section A, Paragraph 5)
o A SP3 amendment program (Part H, Section A, Paragraph 7)
o A stormwater facility inspection program (Part II, Section A, Paragraph 8)
• Not all records of the qualitative monitoring required in Part 11, Section B, were available for
inspection. This indicates that not all required monitoring has been accomplished. Please ensure
that all future qualitative monitoring is accomplished, recorded and stored in the SP3 manual.
The above -mentioned conditions and/or practices demonstrate mismanagement of your wastewater and
stormwater programs and/or a misunderstanding of the requirements of your permits. Please be aware
that violations of the conditions of your permits could result in the assessment of civil penalties in an
amount of up to $25,000 per day per violation.

On February 1, 1994, Mr. Steve Mitchell of the Raleigh Regional
Office, along with Mr. Walter Serad and Mr. Harry Thompson of your
Staff, conducted a compliance evaluation inspection. The site
visit was conducted in regard to the two water quality permits
applicable to this facility and the December 6, 1993 complaint
investigation by the Division of Solid Waste Management. As a
result, the following comments and/or recommendations are offered:
1. The ditch that receives the discharge of non -contact
cooling water, cooling tower and boiler blowdown wastewater
appeared free of any oil contaminants. This area had been
affected by the discharge of oil from a malfunctionirfg
compressor that released oil into a floor drain and into the
discharge pipe.
2. The floor drains in both of the compressor rooms have been
capped off to prevent any future discharge.
3. Clean up of the ditch was accomplished by Noble Oil and
the analyses provided showed no adverse impact downstream.
4. The storm sewers serving the facility have had "screens"
placed in them to minimize any accidental release of pellets.
5. The stormwater outfall pipe has also been screened to

This Office feels that the aesthetic value of Swift Creek would be
adversely affected by the release of the plastic pellets and that
the actions of the facility have lessened the chance of occurrence.
