After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3374, which may be viewed on our website at http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use General Permit Number 12 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. The waterline must comply with the conditions of GC 3374 except for the specific portions of the line addressed within your PCN application date October 10, 2002. 2. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Many of the residents of Pender County are presently ?. drawing their water from contaminated wells or aquifers. The funding for this project is provided through a USDA rural development grant. In order to secure funding, construction has been scheduled for the first week in November 2002. Of the 60 miles of water line to be installed, only in four instances do we fail to meet condition `4' of Water Quality Certification 3374. Therefore, this project requires a 401 water quality certification from the NC-DWQ. In order to reduce the amount of paperwork and, as per the request of Bob Zarzecki, I have included only impact maps where we fail to meet all State conditions in the application package to the NC-DWQ. Raleigh, NC 27604 RE: Nationwide Permit 12, 401 Water Quality Certification Pender County Water Line - Phase III Pender County, North Carolina S&EC Project #: 02-7128 Dear Ms. Moore and Mr. Dorney: On behalf of Pender County, we hereby request authorization from the US Army Corps of Engineers (USACE) to use Nationwide Permit 12 for the subject project to cover temporary impacts to stream channels and 0.77 acres of wetlands. The wetland impacts consist of headwater forest wetlands adjacent to stream channels and a number of jurisdictional ditches along the edge of agricultural fields or located within existing subdivisions. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. Because we cannot satisfy condition "4" of water quality certification #3374, this project requires written concurrence from the NC-DWQ. In the remaining cases it may be possible to install the water line without impacting the adjacent modified channel. However, because the roadside ditch is located approximately 10-15 from the edge of pavement, impacts to the ditch may not be avoidable. Therefore, we have decided to error on the side of caution and have depicted these as temporary channel impacts. Construction of the proposed water line will temporarily impact 438 linear feet and 108 linear feet, impacts C4.1 and C29.2, respectively. The remaining impacts associated with construction of the proposed water line consist of perpendicular crossings with a construction corridor of less than 40 feet and therefore satisfy the state and general conditions associated with NWP 12. In order to reduce paperwork, and as per the request of Mr. Bob Zarzecki, of the NC-DWQ, the application package submitted to the NC-DWQ contains only the impacts that fail to meet the state conditions of NWT 12. In order to minimize impacts, the applicant requested a preliminary wetland delineation and threatened and endangered species survey during the summer of 2000. Based on the preliminary findings the proposed water line corridor was designed to reduce wetland and stream channel impacts. In June and July 2002, S&EC conducted a detailed delineation along the proposed water line corridor for the presence of wetlands and/or stream channels. A number of jurisdictional ditches, stream channels and wetlands were observed along the alignment and are noted on the attached impact maps. Data forms, completed adjacent to Harrison's creek, are included with the attachments. This project consists of the installation of approximately 60 miles of 6" - 12" PVC water lines that will serve the rural residents of Pender County. The purpose of this project is to provide clean drinking water to rural residents, many of which are currently drawing water from contaminated wells. The proposed corridor begins at the Cape Fear River on NC Highway 17 and continues in a southerly direction until reaching US Highway 17. The corridor continues east and west along US Highway 17 and will serve residents on either side of the highway. Please refer to the overall maps for the approximate location of the proposed water line. The water line will be installed within the shoulder of the road right-of-way approximately 5 feet from the edge of pavement. Based on conversations with the project engineer, the construction corridor will not extend more than 15 feet from the edge of pavement when installing a 12" line, primarily along Highway 17, and will be approximately 5-8 feet when installing a 4-6" line. In order to further minimize impacts, spoil will be placed in the road until the water line is installed. Except along NC 210 and where noted on the plans, the proposed water line will be routed underneath existing culverts, and therefore we do not believe should be considered an impact. However, in the event that this cannot be accomplished and wetlands are adjacent to the proposed route, we have included these as impacts in the PCN form. In areas where the sewer line must be routed around the end of a culvert, the line will not be placed more than 15 feet from the edge of the culvert. Directional drilling will be utilized to cross beneath the Cape Fear River, Harrison's Creek, or Merrick's Creek and therefore, no impacts are October 11, 2002 S&EC Project #: 02-7128 Page 3of3 anticipated to the stream channel itself or adjacent wetlands. Please refer to the attached map for the project's location on a USGS topographic quadrangle. Please see the attached impact map or PCN form for a summary of impacts. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when the installation of a utility line involves the conversion of a forested wetland to a herbaceous wetland within the permanently maintained easement. The applicant requested a detailed delineation of wetlands present on the along the proposed corridor prior to construction in order to avoid wetland impacts. Because the construction corridor is located within an existing road right-of-way, additional clearing will be minimal. The proposed water line will be installed beneath existing culverts whenever possible and directional drilling will be utilized at all major stream channels or tidal wetlands. The stream channels and/or ditches will be restored to original contours following completion of the project and the banks will be reseeded following current guidelines. Because the applicant will minimize impacts to stream channels by utilizing perpendicular crossings within an existing right- of-way, S&EC does not believe compensatory mitigation should be required by the USACE or by the NC-DWQ for this project. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Describe the overall project in detail, including the type of equipment to be used: The proposed project consists of the installation of 6"-12" water line to be installed 5' from the edge of pavement within the existing right-of-Kay along Highway 17 and 210 and in adjacent neighborhoods. Typical heave equipment associated with water line installation will be used to complete the project. 11. Explain the purpose of the proposed work: The purpose of the proposed project is to provide potable water to rural residents in the community. Presently a number of neighborhoods are drawing their water from contaminated wells or aquifers. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. 1999 received a FONSI and assurance from F&WS that the proposed project would not impact endangered pecies along the growth corridor (primarily Highway 17 and 210). A copy is this letter will be forwarded by the Coup or engineer. 2000 S&EC conducted additional T&E surveys and a preliminary wetland delineation along the proposed route 2002 S&EC conducted a detailed delineation along the proposed route and within the existing neighborhoods that will be serviced by the proposed water line. V. Future Project Plans Are any future permit requests anticipated for this project? Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a preliminary investigation during the summer of 2000. Based on initial findings the proposed corridor was routed to reduce wetland and channel impacts. Additional wetland surveys were conducted by S&EC in July of 2002. Impacts to major channels and/or tidal wetlands were avoided thru the use of directional drilling.
