The original proposed impacts to jurisdictional waters were 299 linear feet of Perennial stream channel. Since that time, the proposed impacts have been reduced to less than 150 linear feet. A copy of the revised site plan is attached. Because the amended impacts to on-site jurisdictional stream channels are less than 150 linear feet in total, this project no longer requires written concurrence from the NC Division of Water Quality. Box 357 Pineville, NC, 28134 Dear Mr. Norris : November 18, 2002 Mecklenburg County DWQ Project No. 02-1638 On October 10, 2002, the NC Division of Water Quality received your application for a 401 Water Quality Certification to impact 299 linear feet of perennial streams in order to expand a parking lot at The Building Center - Southland Industrial Park in Mecklenburg County. In accordance with 15A NCAC 2H .0506, a thorough inspection of the site has been conducted by Mr. Alan Johnson of the DWQ Mooresville Regional Office. In your application, all of the impacted streams were listed as unimportant perennial; however, Mr. Johnson has determined that significant uses would be removed or degraded by this project and that the proposed work will require stream mitigation. A. Since the perennial stream impacts associated with this project exceed 150 linear feet, compensatory stream mitigation will be required for this project in accordance with 15A NCAC 2H .0506(h). You have the following options for satisfying the stream mitigation requirement associated with this project: 1. Payment into the North Carolina Wetland Restoration Program (WRP), if the WRP will accept the responsibility for conducting this mitigation work, or , 2. Preparing and implementing a stream mitigation plan with a minimum of a 1:1 restoration component. Your application included a conceptual mitigation plan including unspecified amounts of on-site stream and buffer preservation. Please note that your conceptual plan does not meet our stream mitigation requirements in accordance with 15A NCAC 2H .0506(h)(6). Your application will be considered incomplete until a detailed mitigation plan including a 1:1 stream restoration component is forwarded to this office. We strongly suggest that you locate a mitigation site within the same river sub-basin as your project. If you decide to propose use of the Wetland Restoration Program in lieu of developing your own stream mitigation plan, you will need to contact Mr. Ron Ferrell with the WRP at (919) 733-5208 to see if they will accept the project. You should note that mitigation requirements proposed to be mitigated through the Wetland Restoration Program must be rounded to the nearest linear foot increment according to 15 2r .0503(b). B. A stormwater management plan will be needed for the parking lot and lumberyard. Please provide plans for a wet pond or similar device which is designed to achieve 85% Total Suspended Solids (TSS) removal. Please note that we do not have fundamental objections to this project, and are prepared to issue the 401 Certification upon receipt of an acceptable stream mitigation plan. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H .0507(h)). Thank you for your attention. (Attachment A - Figures 1 and 2). This project is necessary to connect an existing facility to a proposed gravel lumber storage yard. This construction will include the expansion of an existing parking lot and truck loading area. Mr. Ed Norris, of The Building ' Center, has retained Carolina Wetland Services, Inc. (CWS) to provide wetland permitting services for this project (Attachment B). ' The results of the on-site field investigation conducted by CWS indicate that there is one jurisdictional stream channel, Stream A, located within the project limits (Attachment A - Figure 3). On behalf of The Building Center, CWS is submitting a Request for Jurisdictional Determination Form (Attachment C) and a Pre-Construction Notification application (Attachment D) with t attachments in accordance with Nationwide Permit General Condition No. 13, and pursuant to Nationwide Permit No. 39 and Water Quality Certification No. 3362. ' This project proposes placing approximately 294 linear feet of pipe and a 5-foot rip rap apron in Stream A. During on-site investigations, CWS did not sample fish, shellfish, or crayfish from the impacted section of Stream A (Attachment E - SCP2). Therefore, it appears that the proposed ' impacts to this portion of Stream A will not require compensatory mitigation in the form of a payment into the Wetland Restoration Fund. 7 I 7 1 f The Building Center - Southland Industrial Park October 9, 2002 Nationwide Permit No. 39 Project No. 2002-0238 Existing Conditions The Building Center - Southland Industrial Park Project is located at 10201 Industrial Drive in ' Pineville, North Carolina, approximately 3/4 mile southwest of the North Polk Street-Pineville Road (US 521) - I-485 interchange. The following sections ' describe the existing conditions of the site. ' Current Land Use The majority of the site has been developed for industrial use. A drainage flow west across the site and ' into a 35-foot S.W.I.M. buffer zone that is located in the northwestern corner of the property. Industrial developments and vacant lots dominate the area surrounding the project site. ' Jurisdictional Delineation and Verification CWS delineated on-site jurisdictional waters of the U.S.' on September 3, 2002, using the U.S. Army ' Corps of Engineers (LJSACE) - Routine On-site Determination Method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manual.2 Jurisdictional waters of the U.S. were ' classified according to recent North Carolina Division of Water Quality (NCDWQ)3 and USACE guidance. A Request for Jurisdictional Determination Form has been included as Attachment C. The results of the on-site field investigation indicate that there is one jurisdictional stream channel, ' Stream A, located within the project limits (Attachment A - Figure 3). Stream A is an unnamed tributary to Sugar Creek. Sugar Creek is located within the lower Catawba River basin ' (HU# 03050103)4 and is classified as "Class C" waters by the NCDWQ. ' 1 "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. U.S. Geological Survey. 1974. 2 ' The Building Center - Southland Industrial Park October 9, 2002 Nationwide Permit No. 39 Project No 2002-0238 Stream Classifications ' Stream A is located adjacent to the northern property boundary of 10201 Industrial Drive. A piped segment of approximately 215 linear feet separates two on-site open portions of Stream A. The ' downstream segment of Stream A is approximately 175 linear feet in length and was evaluated to be Important Perennial. This segment of stream channel has a 3-foot average ordinary high water width, ' channel substrate consisting of coarse sand and small gravel, and a strong bankful bench (Attachment E - SCP1). Crayfish, tadpoles, and macrobenthic invertebrates were sampled on the ' day of the field investigation. The majority of this portion of Stream A has a 35-foot S.W.I.M. buffer zone and rated 33 out of 71 possible points on the NCDWQ Stream Classification Form. A ' photograph of the Perennial segment of Stream A is included as Attachment G - Photograph A. ' The portion of Stream A located upstream of the piped segment is approximately 380 linear feet in length. This channel was evaluated to be Unimportant Perennial and has a 2-foot average ordinary high water width with channel substrate consisting of coarse sand and small gravel (Attachment E - ' SCP2). The bed of this channel had been recently cleaned out by hand and the banks largely denuded of vegetation. Despite the on-going drought conditions, this channel exhibited moderate ' flow. This portion of Stream A rated a 25.75 out of a possible 71 points on the NCDWQ Stream Classification Form. ' There were no jurisdictional wetland areas identified within the project area. A Routine On-site Data ' Form representative of an on-site upland area is included as Attachment F. I Purpose and Need for the Project This project will involve the expansion of an existing parking lot and loading area, as well as a ' driveway connection between the existing facility and the proposed gravel lumberyard. The purpose of this project is to provide access to an adjacent lot and lumberyard for the storage of building ' supplies. 3 The Building Center - Southland Industrial Park October 9, 2002 Nationwide Permit No. 39 Project No. 2002-0238 Avoidance and Minimization The site plan for this project has been developed to avoid jurisdictional features to the maximum extent possible while still achieving the project's goal. This project is designed to avoid impacting approximately 256 linear feet of Important Perennial stream channel. The downstream section of Stream A will be avoided and its 35-foot S.W.I.M. buffer maintained. In addition, a 6-foot earthen berm will be constructed to further protect downstream resources. The original site plan called for the piping of approximately 380 linear feet of Stream A. This plan was modified to reduce impacts to less than 300 linear feet to qualify for a Nationwide Pen-nit. Proposed Impacts to jurisdictional Waters The proposed project will result in unavoidable impacts to jurisdictional waters of the U.S. Approximately 299 linear feet of the upstream portion of Unimportant Perennial Stream A will be impacted by the placement of approximately 294 linear feet of 24" pipe and a 5-foot rip rap apron. This project is necessary to connect an existing facility to an adjacent proposed lumberyard. This portion of Stream A exhibited poor water quality and despite several field investigations of the site, no fish, shellfish, or crayfish were ever sampled from this portion of the channel. Activities that will result in impacts to jurisdictional waters of the U.S. will be required to follow the General Conditions of Nationwide Permit No. 39 (Federal Register, Vol. 67, No. 10; January 15, 2002). Proposed Compensatory Mitigation Due to the nature of these impacts, this project is proposing the preservation of undisturbed on-site portions of Stream A and the maintenance of riparian buffers along undisturbed stream segments to mitigate for the 299 linear feet of Unimportant Perennial stream impacts. No payment into the Wetland Restoration Fund is being proposed for these impacts based on the results of this preliminary field investigation. Approximately 299 linear ' feet of the upstream portion of Unimportant Perennial Stream A will be impacted by piping for the extension of an existing parking lot and loading area to a lumberyard on an adjacent lot. This portion of Stream A exhibited poor water quality and despite several field ' investigations of the site, no fish, shellfish or crayfish were sampled from this portion of the channel. Due to the nature of these impacts, this project is proposing _preservation of undisturbed stream channel and the maintenance of riparian buffers along undisturbed stream segments to mitigate for the 299 linear feet of Unimportant Perennial stream impacts. 2. WA SUBJECT: Review of an application by The Building Center - Southland Industrial Park, Pineville, DWQ # 021638, NWP # 39, Unnamed Tributary Sugar Creek, Mecklenburg County Carolina Wetland Services is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to install additional piping above an existing pipe stream segment to expand parking and storage for a lumberyard operation. Waters below the existing pipe are considered important perennial stream. Total impacts are indicated to be 299 linear feet of stream. Historical records indicate that the Carolina heelsplitter (Lasmigona decorata), a federally listed endangered species may have previously occurred in the general area. Based on our review of the application, we recommend that the Division of Water Quality and the Corps of Engineers consider whether relocating the channel, including the previously piped section, could improve water quality and aquatic habitats if the stream can be relocated and restored in a manner that would provide shade and habitat (vegetated buffers). If this is not practicable, we recommend that a stormwater pond be provided that ensures water quality benefits and reduces potential chemical oxygen demand on downstream waters. The pond should utilize native vegetation for shade and thermal impact reductions. If requested, this office can provide additional pond planting recommendations.
