Attn: David Volk, Plant Manager 13421 North Rocky Ford Road Laurinburg, NC 28352 Subject: Request for Regulatory Relief from Monthly Monitoring BlueScope Buildings / Laurinburg NPDES General Permit NCG030000, Certificate of Coverage NCG030352 Scotland County Dear Mr. Volk: On July 31, 2017, the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) received your letter dated July 24, 2017 requesting regulatory relief from monthly monitoring due to exceedances of the benchmark value for zinc at outfall 001. Please keep in mind that benchmark exceedances are NOT limit violations or violations of permit conditions; however, you are obligated to follow the tiered response actions outlined in your permit. Prior to receipt of your letter, a meeting was held on February 8, 2017 at the Fayetteville Regional Office with Markus Elliott, HSE Manager, and Gerald Gladders, Regional HSE Manager to discuss the zinc exceedances and potential relief from monthly monitoring. During this meeting, recommendations were made to collect and analyze a series of samples of stormwater coming directly off the roof of the building in order to isolate possible sources of zinc that were not directly related to facility operations or products. The letter summarizes that sample analysis demonstrates that the exceedances for zinc are due to the roof and not from the manufacturing process and that stormwater samples were collected from roof downspouts and outfall 1 during the same rain event for comparison. Included with the letter is a graph and table with the monitoring results of the additional sampling from the roof, which indicate that zinc concentrations were significantly higher at the roof downspouts than corresponding stormwater discharges at outfall 1. In response to your request for regulatory relief from monthly monitoring, a site inspection was conducted on August 22, 2017. The purpose of the inspection was to ensure compliance with the conditions of General Permit NCG030000 and review and discuss the results of the additional sampling conducted at the roof downspouts in more detail. At the time of inspection, the facility was found to be in compliance with the tiered response actions and other conditions of General Permit NCG030000. An inspection report related to the August 22, 2017 compliance inspection will be provided under separate letter. Based on compliance with the conditions of General Permit NCG030000 and the results of the additional sampling at the roof downspouts, we are granting regulatory relief in the form of a collapsed Tier 2 - Tier 3 response. Upon receipt of this letter, BlueScope Buildings North America, Inc. may resume the permit specified semi-annual analytical monitoring at the BlueScope Buildings / Laurinburg facility. This relief letter remains in effect through the subsequent reissuance of the NCG030000 permit. This decision applies only to the zinc benchmark. A benchmark exceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the permit. Based on review of the analytical monitoring records, monthly monitoring was triggered after two consecutive exceedances of the benchmark value for zinc from sampling conducted in the second half of 2016 and the next sampling event conducted in January 2017. Facility contacted the regional office in February 2017 about the exceedances and recommendations were made to collect stormwater samples coming directly off the roof of the building to test for zinc along with the routine sampling of stormwater discharges at the representative outfall (outfall 1) over the next several months. Results of this additional sampling were provided in the request for regulatory relief, which was received by the regional office on July 31, 2017, The results show significantly higher levels of zinc coming off the roof as compared to the discharge outfall. Based on the results of the additional sampling, a letter granting regulatory relief will be provided separately from the compliance inspection report. Facility's SPPP contains all permit -required components and is reviewed and updated annually. Records of qualitative (visual) monitoring of stormwater discharges at all outfalls were also available for review. After the records review, observations were made of secondary containment areas, storage areas and outfalls 1 and 2. Outfalls 3 and 4 were not observed during this inspection. At the time of inspection, facility appeared to be well operated and maintained. Samples were collected from the roof downspouts and Outfall #1 during the same rain event for comparison. The Zinc concentration from the downspouts ranged anywhere from 1.5 — 15 times the concentrations at the outfall sample. Based on the findings of these results, we are seeking a relief from Tier I, II and III requirements of Section B of the permit. The excecdance is mainly from the aging metal roof of the facility buildings and not from the products manufactured. Building I is the original building for this manufacturing plant and displays the most wear. Samples were collected on both sides of the building North side (IN) and South side (IS). When 2 samples were collected on the same side, those samples were averaged. A sample was collected at Outfal l I (OH). Some samples collected on the same date were analyzed by 2 saparate labs Thesc sample results are compared to the Zinc Benchmark of .067 mg/L. The graph shows this comparison. The samples from both sides of the building were averaged for comparison (Grey line on the graph). These samples indicate that the most likely source of the Zinc is from the roof. Other buildings were added after building one and are in different stages of wear. Further documentation review showed that an e-mail was sent from our office to staff with the Stormwater Permitting Unit concerning any objections to this request as well as an e-mail from staff with this office to your company stating that no objections had been given and to consider the request approved. In order to be consistent with the current review and approval process of Representative Outfall Status requests, we are hereby providing you with this letter such that in accordance with 40 CFR §122.21(g)(7), you are authorized to sample outfall 1 as a representative outfall. This approval is retroactive to the date of the e-mail approval in 2003. Please be reminded that the permit requires Qualitative Monitoring to be performed at all stormwater discharge outfalls, regardless of representative outfall status. The attached three figures present the site's basic property layout, paved areas, and outfall drainage areas, respectively. Butler is requesting that Outfall #1 be considered the representative outfall for the facility. The basis of this request is as follows: 1. Outfall #1 drains a significant fraction of the property (estimated as 61 acres of the total 93 acres at the site) including the manufacturing building and the vast majority of paved area. 2. Outfalls #2, #3, and #4 drain primarily grassy areas along the outside edge of the property. There is very little industrial equipment stored or industrial activity carried out in any of these drainage areas. 3. Experience has shown that even when there is a representative rainfall event there is often no flow at Outfall #4. This may be the case because the land is relatively flat so that much of the rainfall is believed to simply soak into the 2003 Bradley Bennett April 3, 2003 Page 2 ground. Also it appears that some of the area that was believed to drain to Outfall #4 may actually drain into Outfall #3. 4. Similarly, experience has shown that even more so than Outfall #4, Outfall #2 rarely has any flow even after significant rainfall events. It is believed that much (if not all) of the drainage area previously thought to be associated with Outfall #2 actually drains into Outfall #1. The flow is measured by multiplying the pumping rate (GPM) time the tine (1440 minutes/day) divided by 1,000,000. The results are probably on the "high -side" of the actural flow because of an eroded efficiency (pump and motor). In addition, last year's average flow was less than 30% of the permitted flow. 5. According to the DMR reports reviewed for the period September 1991 through August 1992, the plants effluent was in compliance with the permits, monthly average limits (there were no exceedances for any parameter of the permit during the period reviewed). - 2. Mr. Gray Gilbert (Former "ORC" of the plant) left the service of the company suddenly, leaving the facility (class )) with no "ORC". The plant manager was informed that it would be necessary to utilize the services of an outside "ORC" and "back-up" operator until plant personnel can become certified. Further, the plant manager was notified that the operator certification commission needed to be notified immediately of the new "ORC" and -'back-up operator designates. Please inform this office by November 16, 1992 of what actions have been taken to address this deficiency. 3. All records, logs, and logs of calibration were in order. 4. It is perceived that this exceedence was due to a reporting error of a misplaced decimal. (The reporting figure was exactly 10 '(ten) times higher than normal. (.03 instead of .003 MGD). 2. Noland, Regional Supervisor Dear Mr. Noland, After you sent us a Notice of Violation - Effluent Limitations in February I called you and explained our problem which is as follows: The nature of our violation was that the Total Suspended Solids in our effluent was out of limits (30.3 mg/l vs 30.0 mg.l limit). We have a 15,000 gpd system which is processing about 4000 gpd. If we run our aeration system full time, we can keep TSS well within limits, but the excess aera- tion drives our pH down below the lower limit. Instead of running our aerator full time, we have it controlled by a timer with which we can vary the aeration time. It happens that when we have the time set to keep pH from going below 6, our TSS will often be right at the limit (30) so we have a constant "balancing act" to keep both pH and TSS in limits. We feel we can solve this problem by either aerating full time and metering caustic soda or some like material into the effluent to control pH, or by simply adding fresh water to the effluent. We are not going to do either of these until we are sure such action is permissible under the law. When I spoke to you, you mentioned that it might be possible for someone from the State familiar with this type of problem to visit our facility. I did receive a call from someone whose name I do not recall who spoke in general terms of visiting us, but as of now, no one has come. As you noted, our wastewater treatment plant effluent was out of compliance limits for Total Suspended Solids for the months of July and August 1987. Since that time, at your inspector Mr. Cox's suggestions, we have had the settlement tanks pumped out by a local septic tank service company. You will note that since August, our TSS has been within compliance limits. Your Compliance Sampling results also indicated non-compliance with the permit limits for minimum pH. we were aware of this problem prior to Mr. Cox's visit but at the time we did not know the cause. Consequently we were adding caustic to the effluent in an effort to raise the pH. We were later informed by a 'consultant that the reason for our pH problem was that we were over aerating. We have installed a timer on the aeration system and limited the amount of aeration. This has brought our pH problem under control. At least for the present, we are monitoring pH daily. We will continue to do all in our power to insure that our wastewater treatment system remains in compliance with our permit.
