Facilities that incorporate a solvent management plan into the Stormwater Pollution Prevention Plan may so certify, and the requirement for TTO monitoring
may be waived. The solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General
Permit. For those facilities electing to employ the TTO monitoring waiver. the, discharger shall sign the following certification statement;
'Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics
(TTO), I certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the stormwater or areas which are exposed to rainfall or
stormwater runoff has occurred since filing the last discharge monitoring repart. I further certify that this facility is implementing the all the provisions of the

Please verify whether Qualitative Monitoring must be performed during a "representative storm
event" or "measureable storm event" (requirements vary, depending on the permit).
Qualitative monitoring requirements vary. Most permits require qualitative monitoring to be
performed during a "representative storm event' or during a `measureable storm event" However,
some permits do not have this requirement. Please refer to these definitions, if applicable.
A "representative storm event" is a storm event that measures greater than 0.1 inches of rainfall
and that is preceded by at least 72 hours (3 days) in which no storm event measuring greater than
0.1 inches has occurred. A single storm event may contain up to 10 consecutive hours of no
precipitation.
A "measurable storm event' is a storm event that results in an actual discharge from the
permitted site outfall. The previous measurable storm event must have been at least 72 hours
prior. The 72-hour storm interval does not apply if the permittee is able to document that a shorter
interval is representative for local storm events during the sampling period, and the permittee
obtains approval from the local DWQ Regional Office.

the Year 3 Period 1 Semi -Annual Discharge Monitoring Report and Qualitative Monitoring
Report for the facility located at 2912 Neuse Boulevard in New Bern, North Carolina.
Its Sims understanding that although outfall 001 is technically sealed preventing a
concentrated discharge of stormwater runoff to the adjoining drainage ditch, the NCDENR
has requested a representative sample be collected from the overflow that intermittently
permeates though the riprap at the northwestern corner of the property. This request was
verbally communicated during a site inspection by the NCDENR (Mr. Vernon Riggs) and
subsequent Compliance Inspection Report dated August 29, 2014.
In response, Sims has collected a representative sample. The analytical data and
qualitative results are provided herein. Please note this sample was collected as water
permeated through the riprap allowing contact with the underlying sediment along the
drainage ditch. Additionally, in response to the.best management practice suggestions
conveyed during the NCDENR site inspection and Compliance Inspection Report, Sims has
1.) Placed hay bales along the northern property boundary to impede surface water flow
and control sediment runoff and 2.) Redesigned the low lying native soil areas on the
property via grading and finishing with concrete at the surface. Furthermore, a drainage
ditch with #hand #2 stone has been completed along the northern property border. The
drainage'ditch'.has been designed to accept, transport and discharge stormwater into an
onsite retention pond (pond currently under construction). All efforts to date have/are
being completed'to effectively manage stormwater onsite and considered best
management practices (BMPs) for the facility.
As implied above, Sims intends to continue its proactive approach in the mitigation of
metals in the surface water during construction of onsite BMPs; however, maintains that
Cutfall 001 remains sealed due to Sims inability to collect a representative sample (Semi

Annual Discharge Monitoring Report August 8, 2014) and that the sample collection point as
directed by the NCDENR (August 29, 2014) does not lend itself to an accurate portrayal of
the properties surface water. Subsequently Sims is continuing on the path of managing
stormwater onsite and will update the NCDENR accordingly.

SMM Southeast LLC (d.b.a., Sims Metal Management - New Bern Facility) herein provides
the Year 2 Period 2 Semi -Annual Discharge Monitoring Report and Qualitative Monitoring
Report for the facility located at 2912 Neuse Boulevard in New Bern, North Carolina.
Its Sims understanding that although outfall 001 is technically sealed preventing a
concentrated discharge of stormwater runoff to the adjoining drainage ditch, the NCDENR
has requested a representative sample be collected from the overflow that intermittently
permeates though the riprap at the northwestern corner of the property. This request was
verbally communicated during a site inspection by the NCDENR (Mr. Vernon Riggs) and
subsequent Compliance Inspection Report dated August 29, 2014.
In response, Sims has collected a representative sample. The analytical data and
qualitative results are provided herein. Please note this sample was collected as water
permeated through the riprap allowing contact with the underlying sediment along the
drainage ditch. Additionally, in response to the NCDENR site inspection and Compliance
Inspection Report best management practice suggestions, Sims has placed hay bales along
the northern property boundary to impede surface water Flow and control sediment
runoff. Furthermore, the conceptual design of a stormwater pond(s) and associated
drainage ditch network has been completed for the property with construction execution
planned for February 2015.

Qualitative monitoring requirements vary. Most permits require qualitative monitoring to be
performed during a "representative storm event" or during a "measureable storm event." However,
some permits do not have this requirement. Please refer to these definitions, if applicable.
A "representative storm event" is a storm event that measures greater than 0.1 inches of rainfall
and that is preceded by at least 72 hours (3 days) in which no storm event measuring greater than
0.1 inches has occurred. A single storm event may contain up to 10 consecutive hours of no
precipitation.
A "measurable storm event" is a storm event that results in an actual discharge from the
permitted site outfall. The previous measurable storm event must have been at least 72 hours
prior. The 72-hour storm interval does not apply if the permittee is able to document that a shorter
interval is representative for local storm events during the sampling period, and the permittee
obtains approval from the local DWQ Regional Office.
