Klimek, P.E., Director Division of Water Quality CERTIFIED MAIL RETURN RECEIPT REQUESTED Notice of Violation/Notice of Intent to Enforce Resulting from Compliance Evaluation Inspection on 02/14/2006 NPDES Stormwater General Permit No. NCG030000 Certificate of Coverage NCG030244 Kaba Ilco Corporation -Rocky Mount Nash County Ron Boone, of the North Carolina Division of Water Quality's Surface Water Protection Section, performed a stormwater compliance evaluation inspection (CEI) of your Rocky Mount plant on February 14th, 2006. The interview and tour that you provided to Mr. Boone are greatly appreciated. This inspection was conducted to determine Kaba Ilco's compliance with the above permit. Please use the permit references listed throughout this report for further details of each item cited. SITE SUMMARY Your plant is a key manufacturing facility. Wastewaters from the production process are treated in an on site wastewater treatment facility before being discharged into the Rocky Mount municipal sanitary sewer. Several chemicals are used on site, including but not limited to acids, bases, peroxides, and petroleum products. Stormwater generated at your site is collected via a system of in -ground drains and a stormwater collection ditch that surrounds most of the property. The drains and ditch convey the stormwater to one of two outfalls, which at this time have no numerical designations. Also, the receiving waters of the outfalls had not been fully identified. INSPECTION FINDINGS The list below shows conditions and practices observed during the tour portion of the inspection. • In general, the site seemed fairly clean and well maintained. However, Mr. Boone did make observations of concern as shown below: o There were several storage areas on the east side of the main plant building. Many different materials were stored here. Some of these drums were full, -some were empty, and others were only partially full. Some of these drums were stacked two -.high and others were found being stored near industrial equipment the chemicals were used to maintain.- Fairly large stains on the ground around these drums evidenced small spills occurring over time. Large bulk chemical storage tanks were double -walled but no secondary, containments were being used for the storage areas where the 55-gallon drums were observed. Additionally, no drip pans were being used for drums that were actively in use and being drawn from. hi the absence of secondary containment, spilled chemicals could enter drains located around the site as well as the stormwater ditch that surrounds the facility. It is noted that the primary concrete storage pad on the east side of the main plant building is considerably thick, in an effort to help protect groundwater on the site. However, this doesn't provide protection for surface waters surrounding and running off your site. The list below shows numerous conditions observed during the interview portion of the inspection. • You do not have a Stormwater Pollution Prevention Plan (SP3) as required in Part II, Section A, of your permit. As a result, you are missing several effective stormwater management tools, as listed below: o A site plan (Part II, Section A, Paragraph 1 and subparagraphs) o A stormwater management plan (Part II, Section A, Paragraph 2 and subparagraphs) o A spill prevention and response plan (SPRP, Part 1I, Section A, Paragraph 3) o A stormwater preventative maintenance and good housekeeping plan (Part II, Section A, Paragraph 4) o A stormwater employee training program (Part II, Section A, Paragraph 5) o A SP3 amendment program (Part 11, Section A, Paragraph 7) o A stormwater facility inspection program (Part II, Section A, Paragraph 8) • You have not conducted analytical monitoring as required in Part Q, Section B. • You have not conducted qualitative monitoring as required in Part II, Section C. • You did not develop your SP3 within 12 months of the effective date of the initial certificate of coverage, which was issued on 11/29/1993 (Part III, Section A, Paragraph 1). • You have not submitted discharge monitoring reports as required in Part III, Section E, Paragraph 1. In general, the above -mentioned conditions and/or practices demonstrate gross mismanagement of your stormwater program and/or a misunderstanding or complete disregard for the requirements of your permit. Please be aware that violations of the conditions of your permit could result in the assessment of civil penalties in an amount of rlp to $25,000 per day per violation. If you need assistance with understanding any aspect of your permit, please do not hesitate to contact Mr. Boone for assistance.
