I'm not at work, so I can't check this particular one (we don't renew it if there are outstanding fees), but I can tell you that our most recent action on NCG02 was to reissue it unchanged on Feb 2, 2015 until June 1, 2015, when we'll make changes to that general permit. None of those permittees was mailed anything new -- they just needed to go to our website and download the new cover page to the General permit with new effective dates. Info. about that is on our homepage. However, for a copy of the last renewed COC and cover letter from 2010, go here: http: //portal, ncdenr.oro/group/Irlstormwater-0p-renewals That's an internal website, so you'll have to log into the portal to access it. There is a PDF of the COCs and issuance letters from 2010 (and renewals for other years, too). You have to search the full PDF document for that particular permit's letter and COC, but its in there. I found it on pages 1217-1220 (three page letter + the COC). I attached it here for you. I hope that helps. Anyway, can you point me in the right direction if you are not the one to help me? I've had a request for a copy of a permit: NCG020738. According to BIMS, it expired 12/31/2014 and it doesn't appear to be in the process of renewal. The last permit copy we ever received dates back to 2008; a copy of the permit that ran from 2010 and expired in 2014 is fine — just don't know how to get a copy of it. A field inspection of the site was conducted on February 15, 2011 by Mr. James Trent of the Wilmington Regional Office and myself. The site has not been satisfactorily reclaimed at this time. According to Mr. Billy Whitehead, mining activities ceased at this site on October 15, 2009. Therefore, all reclamation must be completed by October 15, 2011. Mr. and Mrs. Whitehead are well aware of this deadline. In the event that reclamation is not completed by the deadline, enforcement may be taken against these individuals. Enforcement actions may well include bond forfeiture proceeding and civil penalty assessments. Any violations dealing with wetlands and wetland restoration are better addressed by individuals from the Division of Water Quality. You may want to contact Mr. Rick Shiver at (910) 796-7215 to discuss the wetland issues. The access road appears to be within the permit boundary limits. This Mining Act does not address right-of-ways and property ownership issues. These are better addressed through civil actions. Again, thank you for your letter. Whitehead issued October 11, 2006 Land Owner: Carlene Padgett Dear Ms. Boyer I represent Carlene Padgett, a landowner of a tract of land in Pender County NC who leased a portion of her land off the Shaw Highway to Janet G. Whitehead for the purpose of Billy Whitehead, her husband, mining sand. I have enclosed a copy of the lease. Ms Whitehead, acting through her husband, William Whitehead, applied for and obtained the above referenced permit back in 2006. 1 have enclosed the maps from the State's file showing the property and mine in question. The Padgetts have in no way been involved in the mining activities carried on by the Whiteheads. However, the Padgetts (Carlene's husband is Wayne Padgett) have been concerned for some time now that the mine has been inactive for over two years and the Whiteheads have failed to take any reclaii;atio'n action. It appears that Whitehead has abandoned the project for more than two years now. In addition, they are concerned that the Whiteheads have dug a second illegal pit or pond outside the permit area which neither the State nor the Padgett's authorized and which may have disturbed protected wetlands. This other pit or pond was dug on Tract 2 as shown on the enclosed map referenced above. Padgett's lease with Whitehead was for a five year tern beginning August 15, 2005. Although paragraph 5 of the Lease grants Whitehead the right to extend the lease for an additional five years "at Tenants option", Whitehead never -exercised this option, never contacted Padgett about exercising the option to extend and has never negotiated or even attempted to negotiate any new Lease price for such extension. The Padgett's want to make it clear that although the Lease has ended, they authorize Whitehead to come onto the property in question for the purpose of complying with reclamation requirements under the permit and to take such other action as may be necessary to correct wetland violations and restore/remediate the area wrongfully taken by Whitehead for the other pit or pond on Tract 2. With regard to the permit, Padgett asserts the mine has been inactive since on or about or November/December of 2008. Whitehead last paid Padgett for sand on March 9, 2009 (reference here is to four loads of sand mined in November 2008 as noted on the enclosed hand written statement). Pursuant to the Reclamation Plan provision of the mining permit, reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining or any mine segment under the permit. Final reclamation including re -vegetation, shall be completed within two years of completion or termination of mining. This has not happened. Padgett takes the position that mining was completed more than two years ago as evidenced by inactivity of Whitehead on the site (they live across the street from the permit site and thus are in a position to know when mining was or was not taking place) and as further evidenced by the last payment received by Whitehead for sand removed noting the four loads of sand removed November 2008. According the Mr. and Ms Padgett, no reclamation efforts appear to have been made by Whitehead. Padgett requests the State's help as follows: 1. Revocation, suspension or modification of the mining permit. 2. Enforcement of the continuing terms of the permit regarding all the land reclamation requirements, including that area where Whitehead mined or dug outside the permit area. We note there is an $11,500.00 Reclamation bond for this purpose. 3. Help from the NC Division of Mines or other state agencies in requiring Whitehead to remediate potential wetland violations for the other pit or pond Whitehead dug outside the permit area. Whitehead dug this other pit or pond outside the permitted area to dewater the pit inside the permitted area as documented by Mr. Trent James. In addition, the Padgetts believe that Whitehead took and removed sand from this other pit. Runoff from this other pit adversely affected the Padgett property in question and other adjoining property to the North. 4. Restoration of the road destroyed by Whitehead during mining. Whitehead relocated the existing road on Padgett property southwardly to an adjoining landowner's property, tearing up and ditching the existing road in the process. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage • A copy of stormwater General Permit NCG020000 • A copy of a Technical Bulletin for the General Permit • Two copies of the Tier 2 / Exceedence Discharge Monitoring Report (DMR) Form for Stormwater • One copy each of the Annual Summary DMR Forms for Stormwater and Wastewater • Two copies of the Limit Violation DMR Form for Wastewater • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. If your Certificate of Coverage (COC) restricts authorization to discharge Stormwater only (or other limited terms) based on your original application, or subsequent modifications to your COC, you must continue to meet these requirements or contact the Stormwater Permitting Unit to request a modification of this renewal COC. The more significant changes in the General Permit since your last Certificate of Coverage include the following: Part If: • Section B — Language referencing PAMS has been changed. Flocculants may now be used if evaluated by the Division and administered in accordance with maximum application doses and other requirements. Part III: • Section A —The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the mining industry, in lieu of a Stormwater BMP Plan. • Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after 0.5" (or more) of rain. To qualify, inactive mines must possess an "Inactive Renewal' from DLR or certify to DWQ the site has been stabilized. The permittee must notify the DWQ Regional Office of inactive status. Tier Two requires that the permittee institute monthly monitoring (reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring shall be done until three consecutive monitoring events show no benchmark exceedences. • Section B — This part contains a new provision that four exceedences of any benchmark will trigger increased DWO involvement in the permittee's stormwater management and control actions. DWO may direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the implementation or installation of specific stormwater control measures. • Section B — The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72 hours) of little or no precipitation to precede an RSE. • Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be monitored. • Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the remainder of the permit. • Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil & Grease parameter in the previous permit. • Section D — Qualitative monitoring must now be conducted during the same representative storm event as the analytical monitoring. • Section D — The permittee is required to keep a written record of his response to problems identified by his qualitative monitoring observations. • Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the permittee may be required by DWQ to perform corrective action. • Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for some Stormwater Discharge Outfalls (SDOs). • Section D — If mines do not respond to problems seen in visual monitoring, DWQ may now require that mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring, install or modify structural stormwater controls, or implement other controls. • Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and recorded in the Annual Summary DMR. • Section E — A lower TSS Wastewater limit for PNA waters is included in the permit. • Section E — All mining operations are now required to monitor TSS in wastewater effluent discharges (not only industrial sand mines). However, TSS limits only apply to industrial sand mining operations. • Section E —Turbidity limits on effluent discharges have been removed; however, turbidity standards still apply in the receiving waters. • Section E — Approval of a Pumping O&M Plan may be required prior to coverage (far sites with dewatering activities that have the potential to drain wetlands or other surface waters). • Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR). • Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified.
